    Обґрунтування авторської методики дослідження емоційного інтелекту

    Emotional intelligence is one of the new concepts in psychology, which is constantly being studied by many scientists. The article analyses the concepts of emotional intelligence, emotional competence and its structural components. The article considers various concepts of emotional intelligence of such scientists as P. Salovey, D. Mayer, D. Caruso, G. Gardner, R. Bar-On, S. Marcus, G. Dudchak, M. Mykolaychak. The article also analyses domestic concepts of emotional intelligence. As a result of the analysis of various scientific views on the concept of emotional intelligence and methods of its research, it has been made a decision to develop the author’s own psychodiagnostic test. The author has developed own test methodology for studying the emotional component, since there are no similar test methods in the national psychodiagnostics. The author's methodology includes five main and two additional scales. The main scales of the methodology include the following properties of emotional intelligence: 1. managing one’s own emotions; 2. managing the emotions of others; 3. understanding one’s own emotions; 4. understanding the emotions of others; 5. empathy. Additional scales of the methodology are the lying scale and the general level of emotional intelligence (calculated by adding the results of the 5 main scales). Subsequently, various test methods were considered to study emotional intelligence and its components. The following tests were chosen for correlation: Toronto Alexithymia Scale, N. Hall’s Self-Esteem Emotional Intelligence Inventory, and the Profile of Emotional Competence (PEC). A correlation analysis of the own methodology with existing test methods for the study of emotional intelligence has been carried out to confirm its validity. The study proved the validity and reliability of the developed test methodology. Therefore, the developed test methodology is indeed aimed at studying the general level of emotional intelligence and studying its components such as: managing one's own emotions and the emotions of others, understanding one's own emotions and the emotions of others, empathy.Проаналізовано поняття емоційного інтелекту, емоційної компетентності та структурні складові цих понять. Розглянуто трактування концепцій емоційного інтелекту такими вченими, як П. Саловей, Дж. Майер, Д. Карузо, Г. Гарднер, Р. Бар-Он, С. Маркус, Г. Дудчак, М. Миколайчак. Виокремлено головні компоненти емоційного інтелекту та розроблено власний тестовий інструментарій щодо його вивчення. Здійснено кореляційний аналіз показників авторської методики з наявними тестовими методами вивчення емоційного інтелекту з метою підтвердження надійності та валідності тесту. Доведено валідність і надійність розробленого тесту, який рекомендується використовувати для оцінки рівня емоційного інтелекту та його компонентів

    Today, all goods, regardless of the country of origin, are subject to classification, that is, codes are determined for goods in accordance with the classification groupings specified in the UCC of the Economic and Monetary Union. Expertise on determining the conformity of the characteristics of goods according to the UCC FEA, regardless of the purpose of establishing the code, is only a means of establishing the circumstances of implementation, that is, the characteristics on which the definition of the goods code is based, but by its task it cannot support the adoption of a decision on the determination interpretation of the product code according to the UCC FEA. Understanding the correctness of drawing up an expert's opinion allows to avoid difficulties when conducting a forensic commodity examination. The classification of goods is carried out in accordance with the requirements of the UCC FEA and is a technique that allows to present the classified goods in the form of a group of signs (product code) established by this classifier. When conducting a forensic commodity expert examination, a commodity expert may not exceed his or her powers and go beyond his or her competence when answering questions about determining the characteristics of the object of research according to the code of the UCC FEA. In the course of a commodity examination, a commodity expert determines only the characteristics of the goods, and the UCC FEA code is not determined. The article clarifies the peculiarities of determining the UCC FEA code, explains from a practical point of view what is the work of a forensic expert in conducting this type of forensic commodity examination. The article provides recommendations for forensic institutions on how to resolve the issues raised by forensic commodity expertise and the correctness of drawing up an expert's opinion, since this allows avoiding difficulties in conducting forensic commodity expertise.У статті з’ясовано особливості визначення коду в Українській класифікації товарів зовнішньоекономічної діяльності, роз’яснено з практичної точки зору, в чому полягає робота судового експерта при проведенні цього виду судової товарознавчої експертизи. Запропоновано низку практичних і дієвих інструментів для вирішення поставлених перед судовою товарознавчою експертизою питань. Пояснено, чому в процесі товарознавчого дослідження експертом-товарознавцем встановлюються лише характеристики товару, а не визначається код Української класифікації товарів зовнішньоекономічної діяльності. Вивчено можливості судової товарознавчої експертизи при визначенні відповідності товарів згідно з Українською класифікацією товарів зовнішньоекономічної діяльності. Наведено рекомендації судово-експертних установ для вирішення поставлених перед судовою товарознавчою експертизою питань і правильності оформлення висновку експерта, оскільки це дозволяє уникнути труднощів при проведенні судової товарознавчої експертизи

    It has been noted that in the course of military events on the territory of Ukraine, where the Russian Federation has fired thousands of ballistic and cruise missiles, killing thousands of Ukrainians, interest in the topic of rocket and space technology has increased significantly. The interest of the Ukrainian population in information about the possibilities for the development of the rocket and space industry in Ukraine and its position in the global space services market has grown especially. One of the fundamental problems in the study of the historical development of the rocket and space industry is the closed nature of archival information resources due to the fact that the vast majority of these material carriers of information have access restrictions and are stored in the archival departments of the development organisations, while other documents that lose their technical relevance are destroyed. It has been noted that the List of topics whose scientific and technical documentation is to be included in the National Archival Fond and transferred to state storage contains very little information on rocket and space issues. An important source in the field of rocket and space activities is the museum collections of organisations where certain equipment was developed and produced. Another important source of information is interviews with direct participants in the development of rocket and space technology, i.e. oral sources of information. First-hand details of the formation and development of rocket and space technology provide a lot of valuable information, and it is advisable to use the practice of “oral sources of information” as long as it is possible. The possibility of granting such oral sources of information the status of an official document in the legal field has been considered. An emphasis is placed on the need to verify the reliability of information obtained from interviews, which is carried out through an examination of the value of such information. In addition, the need to guarantee the preservation of oral sources of information on rocket and space activities in the archives of Ukraine and ensure their availability for use by the public of today and future generations has been stressed.Розкрито проблему закритості архівних інформаційних ресурсів у сфері дослідження розвитку ракетно-космічної галузі. Важливим джерелом у сфері ракетно-космічної діяльності вказано фонди музеїв організацій, де розроблялась і випускалась певна техніка, а також інтерв’ю безпосередніх учасників створення ракетно-космічної техніки, тобто усні джерела інформації. Розглянуто можливість надання таким усним джерелам інформації статусу офіційного документа у правовому полі. Наголошено на необхідності гарантованого збереження усних джерел інформації щодо ракетно-космічної діяльності в архівах України та забезпеченні їх доступності для використання нинішніми користувачами та майбутніми поколіннями, що потребує відповідного правового забезпечення та регулювання

    It has been established that the constitution is the fundamental law of any modern state, which ensures the integrity of the country's legal system. The said legal act contains the most important provisions defining the basic guarantees for the protection of rights, freedoms and interests of a person and a citizen, as well as the key principles of functioning of the State as a whole and its legislative, executive and judicial branches. It is noted that the priority of the constitutional provisions is due to the fact that all other legal acts of different legal force are developed in accordance to it. Attention is drawn to the fact that the constitutional reform in Ukraine implemented in 2016 was important for our country, since: firstly, it was aimed at strengthening democracy and observance of the rule of law in Ukraine; secondly, the powers of the President of Ukraine and the Verkhovna Rada of Ukraine to elect judges to office were adapted in accordance with international standards; thirdly, the requirements for the personality and professionalism of judges were significantly increased. It has been noted that the constitutional reform of 2016 had a significant impact not only on the activities of the judiciary, but also on the development of the legal system of the Ukrainian State. Thus, among the positive aspects of the relevant reform are the following: the content of the legal provisions enshrined in the Constitution of Ukraine defining human rights and freedoms has become one of the broadest among European countries; the reform significantly changed the approach to the content of the principle of judicial immunity, in particular, a functional approach to ensuring judicial immunity was applied; the activities of the bodies responsible for the judiciary were reformed in accordance with European requirements and standards.Спираючись на аналіз наукових поглядів учених, визначено поняття Конституції України як Основного Закону нашої країни. Розкрито зміст і значення конституційної реформи.     The article demonstrates the doctrinal interpretations of digitalisation as a general legal phenomenon. The emphasis is placed on the fact that the analysis of the content of scientific publications in the field of digitalisation of social relations indicates that priority in this area is still given to highly specialised issues which are studied mainly within the framework of branch legal sciences, primarily constitutional, judicial, administrative and civil law. Therefore, the study of digitalisation usually lacks a comprehensive nature, since the relevant issues are analysed without clarifying the conceptual basis of digitalisation. The approaches proposed in the national legal science to improve certain legal regulators and reorient legislation to regulate social relations in the field of digitalisation often fall behind the rapid development of the relevant processes. It is indicated that along with traditional law which is rapidly being digitised (moving into the virtual space from paper carriers), the phenomenon of digital law is emerging which is an intersectoral formation mediating social relations which take place in the virtual space (from cryptocurrency circulation to the provision of administrative services). Furthermore, emphasis is placed on the fact that in practice, the formation of new legal models of digitalisation of public relations in general and public administration in particular takes place outside the doctrine of social relations legalisation which has been developed by theoretical and legal science. Such an approach fundamentally contradicts the existing social needs, leads to managerial and law-making chaos and the lack of distinction between the truly objective needs for legal regulation of new relations and opportunistic managerial decisions which only selectively stimulate the regulatory impact of law on digitalisation. It also fails to ensure timely and effective legal regulation of the relevant range of rapidly emerging social relations that significantly transform the conventional way of life of society, the political, legal and value “image” of the state, its institutional and functional foundations, as well as the lifestyle of each citizen, including the set of his or her personal rights exercised in the public life of the digital age.У статті продемонстровано доктринальні інтерпретації дигіталізації як загальноправового феномена. Акцентовано увагу на тому, що аналіз змісту наукових публікацій у сфері дигіталізації суспільних відносин свідчить, що пріоритет поки що надається вузькоспеціальним питанням, які досліджуються в межах переважно галузевих правових наук, насамперед конституційного, судового, адміністративного та цивільного права.     It has been noted that drug addiction is a person’s mental and physical dependence on narcotic substances that occurs as a result of systematic drug use. In the course of drug addiction, a pathological dependence on any narcotic substance develops, which is accompanied by physical and mental addiction to the drug, which in turn negatively affects the psychophysiological functioning of the body. It has been argued that the key problems of drug addiction in Ukraine are the following: socio-economic problems in the country; insufficient preventive work among the population; perception of drugs as a means of social interaction; lack of alternatives in solving personal problems; unproductive justice system; high level of corruption; low level of self-awareness; open borders. It has been stated that the criminological characteristic of drug addiction in Ukraine can be revealed through a combination of the following factors: drug addiction is a factor that contributes to the commission of crimes in order to obtain funds to buy drugs; drug addiction causes changes in the behaviour and thinking of the addict, and therefore may lead to an increase in the likelihood of committing crimes; it may be the cause of violence or other crimes, as it promotes aggressive behaviour and reduces inhibition; it reduces the social adaptation of the addict, which increases the likelihood that the person will become a criminal; drug addiction can cause a loss of control over one's own behaviour and a decrease in self-esteem, which, in turn, is a determining factor in crime. It has been summarised that crime and drug addiction are directly interrelated, which requires a comprehensive approach to counteract them. To combat this problem, it is necessary not only to provide medical care for drug addicts, but also to develop social and criminal policies that will help reduce the spread of drug addiction and the number of crimes committed.У статті, спираючись на аналіз наукових поглядів вчених, запропоновано авторське визначення поняття наркоманії як суспільно небезпечного явища. Виявлено чинники, які зумовлюють виникнення та поширення наркоманії в Україні. Аргументовано, що злочинність та наркоманія мають прямий взаємозв’язок, що потребує комплексного підходу для вирішення проблем, пов’язаних із ними.     The scientific work focuses on reviewing the works of scholars who have studied various aspects of the implementation of judgments of the European Court of Human Rights. However, the issues of human rights protection and observance of the principle of competition during the consideration of an administrative offence case remain unaddressed. A scientific analysis has been made of the positions of the European Court of Human Rights with regard to the protection of fundamental human rights in proceedings on administrative offences, and the involvement of the prosecutor in the proceedings with a view to ensuring that the parties are competitive and that the prosecutor fulfils his/her main purpose under administrative law, which is to supervise compliance with and correct application of the provisions of current legislation. It has been proved that as a result of amendments to the Constitution of Ukraine, it was excluded Section VII “Prosecution” and was supplemented Section VIII “Justice” with a new Article 131-1. Therefore, under the new Ukrainian constitutional legal order, the prosecutor’s office as an institution performing the function of criminal prosecution is structurally integrated into the general system of justice. Considering that the place and role of the prosecutor's office is defined in the title of Section VIII of the Constitution of Ukraine “Justice”, this indicates that the special status of the prosecutor’s office in the constitutional system of power is enshrined, and that there is a functional link between the court and the prosecutor’s office, which forms the legal basis of the prosecutor’s office and directly affects the practical activities of the prosecutor's office as an institution of public power. Based on the review of law enforcement practice, it has been noted that there is a need to revise the approach to administrative cases (under Article 130 of the Code of Ukraine on Administrative Offences) in the context of the European Court of Human Rights case law. It has been proposed to amend and supplement the Code of Ukraine on Administrative Offences with provisions on the protection of fundamental rights of persons involved in administrative proceedings and to establish the appropriate procedural role of the prosecutor in the administrative process.У межах наукової праці здійснено аналіз рішень Європейського суду з прав людини в частині захисту основних прав особи у провадженні у справах про адміністративні правопорушення та залучення прокурора до участі в розгляді справи з метою забезпечення змагальності сторін і виконання відповідно до адміністративного законодавства свого основного призначення, що має прояв у здійсненні нагляду за додержанням і правильним застосуванням норм чинного законодавства.     The article is devoted to the study of the peculiarities of legal qualification of criminal offences entered into the Unified Register of Pre-trial Investigations on the facts of disappearance of a person under the conditions of temporary occupation and force majeure circumstances in the period from 20.02.2014 to the present. The actions of an investigator at various stages of pre-trial investigation of such criminal offences have been analysed, taking into account investigative situations directly related to premeditated murder as a result of violation of the laws and customs of war. The grounds for changing the legal qualification in criminal proceedings on the facts of missing persons have been proposed. The variability of legal qualifications in criminal proceedings based on the facts of the missing person under special circumstances that occurred in the temporarily occupied territory, due to the influence of force majeure, forced migration of the population, the lack of a unified approach of investigative units, the prosecutor's office and the court to this issue at various stages of the pre-trial investigation is a problem that affects the assignment of a fair punishment to persons whose guilt has been proven by the court in the commission of criminal offenses of a violent nature, the consequence of which is first the disappearance of a person, and then the establishment of the fact of his/her death or violent death, extrajudicial execution. The objectivity of the pre-trial investigation in criminal proceedings on the facts of intentional murders resulting from violations of the laws and customs of war that preceded the disappearance of a person is ensured by establishing reliable and confirmed data on the circumstances of the crime, absolutely all the facts that have preceded it, all information characterising the missing person, his or her lifestyle, connections, political preferences. Under special conditions and the force majeure factor, investigative situations of missing persons at the initial stage of the pre-trial investigation are almost typical. However, high-quality documentation of such criminal offences and bringing the perpetrators to justice is ensured through the proper organisation of interaction between the investigative and operational units of the National Police and other law enforcement agencies with the military, forensic experts and volunteer search organisations. Currently, the military aggression continues.Статтю присвячено дослідженню особливостей правової кваліфікації кримінальних правопорушень, відомості про які було внесено до Єдиного реєстру досудових розслідувань за фактами безвісного зникнення особи за умов тимчасової окупації та впливу фактора непереборної сили у період з 20 лютого 2014 р. і дотепер. Проаналізовано дії слідчого на різних етапах досудового розслідування таких кримінальних правопорушень з урахуванням слідчих ситуацій, безпосередньо пов’язаних з умисним вбивством як наслідком порушенням законів та звичаїв війни.     The article is devoted to a scientific and theoretical study of the principles of administrative legal proceedings in the updated conditions of the Ukrainian State development, based on the needs for high-quality provision and implementation of legal rights, freedoms and interests of individuals and legal entities in the field of public law relations. It has been established that the principles of administrative proceedings at the current stage of development of administrative procedural law should be understood as the basic, initial rules which are stipulated by the provisions of national legislation, as well as generally accepted provisions of international law and standards of administration of justice, and which determine the organisational and functional (procedural) conditions for the administration of justice in administrative cases, and which are reflected and enshrined in the relevant provisions of the Code of Administrative Procedure of Ukraine. It has been noted that by their functional purpose, the principles of administrative justice form a stable basis for the functioning of the mechanism of administrative and procedural regulation. Based on the analysis of the existing scientific developments on this issue, the author supports and further develops the scientific position on determining the characteristic features inherent in the principles of administrative justice in the modern context, namely a) each principle is based on a certain idea, determined by the socio-legal and ideological values of public life, the state and law at this stage of development and functioning; b) the principles have an external expression, i.e. they are textually concentrated in the norms of administrative procedure legislation and reflect the content, essence and internal structure of administrative proceedings, the entire process of the dynamics of its implementation; c) the principles perform a safeguarding function, as they contribute to the main task of administrative proceedings to ensure the proper level of exercise and protection of individuals and legal entities of their rights, freedoms and legitimate interests from violations by public authorities; d) each principle should be logical and scientifically grounded, internally balanced, aimed at ensuring the orderly administration of justice in administrative cases, while not repeating the content of other principles of administrative justice and not contradicting each other.Статтю присвячено науково-теоретичному дослідженню сучасної системи принципів адміністративного судочинства в оновлених умовах розвитку української держави, виходячи з потреб якісного забезпечення та реалізації законних прав, свобод та інтересів фізичних і юридичних осіб у сфері публічно-правових відносин. Проаналізовано нормативні приписи адміністративно-процесуального законодавства, положення доктрини адміністративного процесуального права щодо визначення сутності і значення основних засад, які, з одного боку, визначають характер, побудову, соціальну спрямованість і основні властивості правового регулювання цієї галузі права, а з іншого – створюють належні організаційні та функціональні умови для реалізації адміністративно-процесуальної діяльності учасників судового процесу та адміністративного суду.     The article analyses the provisions of the Administrative Procedure Code of Ukraine on interim relief through suspension of a regulatory legal act and examines the Supreme Court’s case law with regard to the efficiency of application of this administrative procedure institution. In fulfilling the main tasks of administrative proceedings, the institution of interim relief is of great importance, as it allows the plaintiff to protect his or her rights and interests at the stage of applying to an administrative court by suspending the effect of an unlawful decision of a public authority. In the course of the court practice study, a gap in the current legislation and law enforcement practice has been identified, namely: when an interim relief order is cancelled by an appellate court, the authority believes that during the time its decision was suspended, such a legal act gives rise to rights and obligations for the parties. However, such a position of the authority is inconsistent with the provisions of the Constitution of Ukraine and the decision of the Constitutional Court of Ukraine, but is applied by the Supreme Court. To address this problem, it has been proposed to amend the Code of Administrative Procedure of Ukraine to provide that appellate and cassation courts, when issuing a decision to set aside a ruling on interim relief by suspending the effect of a regulatory act, should determine that the court ruling loses legal force from the date of the court's decision. In this case, the legislation should clearly state that during the time when the court of first instance ruling was in force, the effect of the legal act was suspended and did not give rise to any rights and obligations for the parties to the litigation, and in case the court ruling on interim relief is cancelled, the effect of the legal act does not have retroactive effect. The institution of interim relief should be effective and protect the violated rights of individuals.Проаналізовано норми Кодексу адміністративного судочинства України та практику Верховного Суду щодо застосування заходу забезпечення позову шляхом зупинення дії правового акта, виявлено неоднозначну практику застосування норм Кодексу та проблемні питання, з якими стикаються учасники судового процесу на практиці при застосуванні норм права, запропоновано шляхи вирішення описаних у науковій статті проблем
