Isto é contra a natureza? Decisões e discursos sobre conjugalidades homoeróticas em tribunais brasileiros

Tese (doutorado) - Universidade Federal de Santa Catarina, Centro de Filosofia e Ciências Humanas, Programa de Pós-Graduação Interdisciplinar em Ciências Humanas, Florianópolis, 2009Partindo de dados encontrados em pesquisa de campo realizada em quatro Tribunais de Justiça brasileiros, e com o fundamento teórico dos estudos de gênero e antropologia do parentesco, analiso as posições jurídicas e políticas sobre casamento e família, identificadas pela leitura de 185 acórdãos judiciais e interlocução com 25 desembargadores acerca do tema das uniões entre pessoas do mesmo sexo. Considerando as transversalidades entre os discursos jurídicos e as convicções morais e políticas de seus/suas autores/as, a análise aponta, entre outras questões, a forte influência destes fatores sobre a tomada de decisões judiciais relativas ao acesso a direitos sexuais e possíveis implicações na (re) produção de subjetividades marginais ao acesso aos direitos de família. A análise dos discursos de documentos e de entrevistas com desembargadores sobre o enquadramento das conjugalidades homoeróticas ora no conceito de sociedade de fato ora no de união estável demonstra que a tendência jurisprudencial acentua as disputas políticas sobre a interpretação jurisprudencial, concretizadas nas distintas posições assumidas pelos relatores dos tribunais em estudo, e que se materializam basicamente na controvérsia quanto à necessidade de existência de lei específica para tomada de decisão e/ou interpretação da constituição federal como tarefas impostas aos juízes da atualidade para a resolução dos conflitos postos pela demanda de reconhecimento e de redistribuição de direitos. Os resultados apontam ainda para uma tendência que pode ser considerada mais "positiva" do que "negativa" dos tribunais em estudo, se a discussão for relativizada de um ponto de vista da partilha de bens, central nas disputas judiciais. Por outro lado, a maioria dos relatores mantêm o conceito de família num lugar "naturalizado", seja pelas convicções expressas em entrevistas e acórdãos acerca da conversão em matrimônio civil prevista como conseqüência deste enquadramento, seja pela consideração que se faz acerca do valor patrimonial ou não do trabalho doméstico nas relações entre pessoas do mesmo sexo, ou mesmo sobre a posição das crianças junto ao casal de gays ou de lésbicas, gerando conseqüências que por outro lado são reconhecidas como variáveis e instáveis para a vida dos sujeitos que litigam sob o vazio da lei. From data found on field research conducted in four Brazilian Courts of Justice, and the basis of theoretical studies of gender and anthropology of kinship, I analyze the legal positions and policies on marriage and family, identified by the reading of 185 judicial rulings and interlocution with 25 magistrates about the issue of unions between persons of the same sex. Considering the cross between the words legal and moral and political beliefs of his / her author / as the analysis shows, among other issues, the strong influence of these factors on judicial decision-making on access to sexual rights and possible implications for (re) production of subjectivities marginal access rights of the family. The analysis of speeches of documents and interviews with magistrates on the environment of conjugality homoerotic moment in the concept of society in fact now in the stable case law shows that the trend highlights the political disputes on the case-law, implemented in different positions taken by the rapporteurs the courts under study, which is basically materialized in dispute as to the need of specific law in making decisions and / or interpretation of the federal constitution as tasks imposed on judges of today to resolve the conflict posed by the demand for recognition and redistribution of rights. The results also point to a trend that can be considered more "positive" than "negative" study in the courts if the thread is relativised from a sharing of property, central in judicial disputes. Moreover, most of the rapporteurs retains the concept of family in a place "naturalized" is the belief expressed in interviews and judgments about the conversion to civil marriage planned as a result of this framework is the consideration that is about the value or non-domestic work in the relations between persons of the same sex, or even the position of the couple with children of gays and lesbians, creating consequences that the other variables are known to be unstable and subject to the life of that audience in the vacuum of law

(In) visíveis casais: conjugalidades homoeróticas e discursos de magistrados brasileiros sobre seu reconhecimento jurídico

Partindo de estudo de caso realizado nos Tribunais de Justiça do Rio Grande do Sul, Rio de Janeiro, São Paulo e Minas Gerais, articulo questões teóricas presentes no campo dos estudos de gênero e antropologia com as posições jurídicas sobre casamento, união estável e família, identificadas pela análise de decisões judiciais e interlocução com vinte e cinco desembargadores acerca de recursos judiciais sobre as “conjugalidades homoeróticas”. A análise aponta a influência do “sexo/gênero” das partes na tomada de decisões judiciais. Constata-se ainda a desvalorização do trabalho doméstico em particular de homens gays, que litigam em inventários pelo espólio de parceiro falecido a fim de garantir sua condição de herdeiros. Contudo, há uma tendência que pode ser considerada mais “positiva” que “negativa” nas decisões dos tribunais em estudo se a discussão for relativizada do ponto de vista da concessão de partilha de bens a alguns sujeitos

Gênero, direitos humanos e impacto socioeconômico da Aids no Brasil

Foi realizada análise crítica, levando-se em consideração as questões de gênero, dos resultados oficiais do relatório do governo brasileiro para o Programa Conjunto das Nações Unidas para o HIV/Aids - UNAIDS. Mais especificamente, foi abordado o cumprimento das metas resultantes da Declaração de Compromisso sobre HIV/Aids, nos itens Direitos humanos e Redução do Impacto Social e Econômico da Aids até o ano de 2003. Foram apontados os conceitos chave incluindo reflexões sobre os indicadores e estratégias que auxiliam a sociedade civil organizada a efetivar seu monitoramento até 2010.The paper critically analyzes, from the gender standpoint, official results presented in the Brazilian government report to the Joint United Nations Programme on HIV/AIDS (UNAIDS). Specifically, the fulfillment of 2003 targets set forth in the United Nations Declaration of Commitment on HIV/AIDS, under the category of Human Rights and Reduction of the Economic and Social Impact of AIDS, are evaluated. Key concepts are highlighted, including indicators and strategies that may help civilian society better monitor these targets until 2010

Para uma crítica da razão androcêntrica

Programa de Pós-Graduação em Direito.O presente trabalho foi desenvolvido valendo-se da metodologia de pesquisa bibliográfica e documental, contando com dados coletados junto ao Tribunal de Justiça do Estado do Rio Grande do Sul e a grupos informais, pessoas e organizações não-governamentais que trabalham com o tema do homoerotismo em Porto Alegre, Rio Grande do Sul. Partindo da contribuição teórica trazida pela epistemologia feminista, tomamos como marco teórico principal a formulação de Michel Foucault - sobre os saberes, a busca da verdade em torno da sexualidade humana, e o exercício de poder e controle sociais aí implicados - bem como a metodologia proposta por Alda Facio para análise do fenômeno jurídico. Procuramos desvendar, a partir daí, nos marcos da filosofia do direito, os reflexos produzidos pela postura androcêntrica sobre a ciência jurídica, que historicamente conduziram à segregação não apenas das mulheres como sujeitos de direito, mas excluíram a expressão homoerótica da esfera protetiva que o moderno estado de direito propôs. Destacamos, para tanto, o questionamento que a jurisprudência obtida no Rio Grande do Sul atualmente tem provocado a esta impostura excludente, à luz do princípio de igualdade, bem como a mobilização social que tem sido catalisadora deste processo de renovação, também em nível legislativo

Heparin Increases HLA-G Levels in Primary Antiphospholipid Syndrome

Objectives. The aim of this study was to investigate the HLA-G serum levels in Primary Antiphospholipid Syndrome (PAPS) patients, its impact on clinical and laboratory findings, and heparin treatment. Methods. Forty-four PAPS patients were age and gender matched with 43 controls. HLA-G serum levels were measured using an enzyme-linked immunosorbent assay (ELISA). Results. An increase in soluble HLA-G levels was found in patients compared to controls (3.35 (0–22.9) versus 1.1 (0–14), P = 0.017). There were no significant differences in HLA-G levels between patients with and without obstetric events, arterial thrombosis, venous thrombosis, or stroke. Sixty-six percent of patients were being treated with heparin. Interestingly, patients treated with heparin had higher HLA-G levels than ones who were not treated with this medication (5 (0–22.9) versus 1.8 (0–16) ng/mL, P = 0.038). Furthermore, patients on heparin who experienced obstetric events had a trend to increased HLA-G levels compared to patients who were not on heparin and did not have obstetric events (5.8 (0–22.9) versus 2 (0–15.2) ng/mL, P = 0.05). Conclusion. This is the first study to demonstrate that serum HLA-G levels are increased in APS patients. We also demonstrated that heparin increases HLA-G levels and may increase tolerance towards autoantigens

Atendimento online em bibliotecas: a experiência da Universidade de São Paulo

Os serviços de informação aliados às tecnologias evoluíram em sua forma de atuação à\ud medida que oferecem, em menor tempo possível, informação segura de alcance maior aos\ud usuários das bibliotecas. São inúmeros os conceitos de Serviço de Referência\ud Virtual (SRV) que compartilham a ideia de que o uso das tecnologias de informação facilitam\ud a comunicação entre bibliotecários e usuários. As Bibliotecas do Sistema Integrado de\ud Bibliotecas da Universidade de São Paulo (SIBi/USP), detectaram a relevância de\ud modernizar o Serviço de Atendimento ao Usuário, utilizando novos meios de comunicação e\ud melhorando a interação com os usuários por meio de recursos que são de domínio e uso\ud cotidiano dos mesmos. A Biblioteca da Faculdade de Medicina Veterinária e Zootecnia\ud (FMVZ) da Universidade de São Paulo (USP) implantou o serviço de Atendimento Online por\ud chat, disponibilizando aos seus usuários um novo canal de comunicação que permite o\ud esclarecimento de dúvidas e solicitações em tempo real com atendentes. A experiência foi\ud extremamente positiva convergindo para a implantação do sistema em outras quatro\ud bibliotecas da USPThe information services allied to technologies have evolved in how they act as they offer in\ud the shortest time secure longer-range information to the library users. A Temática de Propriedade Intelectual como Parte da Formação dos Alunos dos Cursos Técnicos dos Institutos Federais da Região Norte

Considering the importance of disseminating and providing essential knowledge to technical high school students about intellectual property, linked to innovation and entrepreneurship, the general objective of the work was to analyze how technical education, in Federal Institutes of Education, deals with the topic in the context of curriculum. The research was based on the collection of primary data (bibliographic survey) and on documental research. There was a curricular gap in technical secondary education in Federal Institutes, in relation to the approach to intellectual property. Specific disciplines dealing with the subject should be created, in addition to curricular activities that allow offering knowledge to students, enabling them to recognize the importance of protecting creative activity, as innovation and the basis of entrepreneurship. The final product of the research was the elaboration of a comic book, as an instrument that can arouse students' interest on the subject, considering the dynamic, simple informative character, but with effective educational potential.Considerando a importância de divulgar e fornecer conhecimentos essenciais aos alunos do ensino médio técnico sobre a propriedade intelectual, vinculada à inovação e ao empreendedorismo, o objetivo geral do trabalho foi analisar como o ensino técnico, em Institutos Federais de Educação, trata do tema no âmbito curricular. A pesquisa baseou-se na coleta de dados primários (levantamento bibliográfico) e em pesquisa documental. Constatou-se uma lacuna curricular no ensino médio técnico nos Institutos Federais, com relação à abordagem da propriedade intelectual. Devem ser criadas disciplinas específicas tratando do tema, além de atividades curriculares que permitam oferecer conhecimentos aos discentes, capacitando-os para que reconheçam a importância de se proteger a atividade criadora como inovação e base do empreendedorismo. O produto final da pesquisa foi a elaboração de uma história em quadrinhos, como instrumento que pode despertar o interesse dos alunos sobre o tema, considerando o caráter informativo dinâmico, simples, mas com efetivo potencial educacional
