    Penyelesaian Perkara Pidana Melalui Mekanisme Mediasi

    In the Indonesian legal aspect, mediation can be applied to all civil cases, even before the judge checks the lawsuit in court, the judge must direct the disputing parties to take part in the mediation session. On the contrary, mediation cannot be applied to criminal cases because it is not regulated in criminal procedural law. In Islamic criminal law, cases that can be resolved through mediation are qisas, diyat and ta`zir. Qisas and diyat known as penalties that have been determined by the nash which violate human rights (individuals) so that victims or their heirs can forgive the perpetrators. To get forgiveness from the victim's heirs, the perpetrator can ask someone, organization or government as a mediator to consult so that the victim's heirs will forgive the perpetrator's mistake. Furthermore, ta’zir is fully handed over to government policy (ulil amri), including the material law and procedural law. The government can make regulations that adopt mediation mechanisms to resolve conflicts that occur in the community

    Progress Report on Programmes and Activities of SEAMEO Regional Centre for QITEP in Language in Fiscal Year 2009/2010

    SEAMEO Regional Centre for QITEP in Language is pleased to present its first progress report on programmes and activities in Fiscal Year 2009/2010. This progress report contents programmes and activities organised by the Centre for the quality improvement of language teachers, especially for Indonesian, Arabic, Chinese, Japanese, and German. One of the programmes was training. Prior to that, the Centre conducted Training Needs Analysis (TNA) in most SEAMEO Member Countries to accomodate relevant programmes to serve teachers and education personnel in the area of language education. In addition to training, the Centre organised study visits to the exisiting SEAMEO Centres in Indonesia and some institutions in the SEA region and beyond to obtain benchmark in the areas of management and human resources development systems as well as initiation to Centre’s collaboration. The Centre also held a number of other programmes and activities for language teachers such as the First Annual International Symposium on Foreign Language Learning (1st AISOFOLL) on “Exploring Standard for Language Learning in Southeast Asia”. With regard to its operation, the Centre also organised its first Governing Board Meeting. Realising the fact that these activities could be executed due to the immense support of stakeholders and other parties, I on behalf of the Centre’s officials and staff would like to express our deepest gratitude to them. We hope that we would be able to give better services to SEAMEO Member Countries in the coming years

    KAJIAN SISTEM PENGERINGAN IKAN DENGAN METODE HYBRID (ENERGI SURYA DAN ENERGI BAHAN BAKAR GAS)

    Sistem Pengeringan dengan metode hybrid merupakan sistem pengeringan yang menggunakan dua atau lebih sumber energi untuk proses penguapan air. Pengering hybrid pada penelitian ini menggunakan sumber energi matahari dengan bantuan solar kolektor dan energi bahan bakar gas. Penelitian ini merupakan alternatif teknologi untuk kasus pengeringan ikan. Tujuan dari penelitian ini adalah untuk meningkatkan temperatur udara panas ruang pengering hybrid, melakukan optimalisasi waktu pengeringan dan menghitung kadar air pada ikan. Penelitian ini dilakukan di halaman Fakultas Teknik Universitas Syiah Kuala. Hasil pengukuran temperatur tertinggi ruang pengering tanpa bahan/ikan dengan menggunakan kolektor surya adalah 43 oC dengan intensitas cahaya matahari tertinggi 915 W/m2, setelah menggunakan metode hybrid temperatur tertinggi ruang pengering dengan kondisi ada bahan/ikan meningkat sampai 67 oC dengan intensitas cahaya matahari tertinggi 908 W/m2. Pengeringan menggunakan energi hybrid relatif lebih singkat yaitu 8,5-13 jam sedangkan pengeringan secara tradisional membutuhkan waktu selama 3 hari dengan kondisi cuaca cerah dan intensitas cahaya matahari yang tinggi. Tingkat penguapan kadar air mencapai 30,25% - 38,18 % untuk ikan karang/ikan kakap merah, dan 53,30% - 57,13% untuk ikan teri. PLN (Persero) Wilayah Aceh dengan jumlah responden sebanyak 137 orang. Untuk menganalisis data digunakan The Structural Equation Modelling (SEM) dari paket software statistik AMOS 22.0 dalam model dan pengkajian hipotesis.Hasil penelitian menunjukkan bahwa gaya kepemimpinan, kerjasama tim dan kompensasi berpengaruh terhadap kepuasan kerja karyawan PT. PLN (Persero) Wilayah Aceh. Kemudian hasil yang lain menunjukkan bahwa gaya kepemimpinan, kerjasama tim dan kepuasan kerja tidak berpengaruh terhadap kinerja karyawan PT. PLN (Persero) Wilayah Aceh, sedangkan kompensasi berpengaruh terhadap kinerja karyawan PT. PLN (Persero) Wilayah Aceh.     This paper discusses descriptively the instructional leadership from an Islamic perspective. It also attempts to review the literature pertinent to the instructional leadership and to discuss the concepts and roles of the principal as an instructional leader and their tasks or dimensions. The effective instructional education characteristics comprises the education through good example, education through norms, education through advise and counselling, education through observation and supervision and education through rewards and punishment also discussed in the paper.     A Site-Specific Fertilizer Recommendation Based on the Phosphorus and Potassium Status in Mempawah District, West Kalimantan

    The recommendations of Phosphorus (P) and Potassium (K) fertilization for rice are still not site-specific yet due to a lack of required soil data information.  The P and K status of the paddy fields that provide information on the low, medium, and high P and K nutrient status are very useful for determining recommended the site-specific fertilizer in the the district area. The purpose of the research was to determine the site-specific fertilizer recommendation for paddy field based on their P and K status. This research was based on the field survey and the soil analysis in the laboratory. The soil samples were taken using a grid system, and the P and K levels were assessed by using a 25% HCl extraction. Soil samples were taken in a composite manner on all paddy fields in which their status have been identified. The composite soil samples were determined from 10 - 15 individual samples (sub-samples) with a sampling distance of each sub-sample of 25-50 m in the field.  The soil samples were taken in the overlay with a depth of 0-20 cm. Taking sub-samples were done by a diagonal or a zigzag method according to the conditions of paddy fields. The results of the study presented that the nutrient status of P and K and the fertilizer recommendations in paddy fields for rice plants located in 9 sub-districts in Mempawah Dsitrict had shown that nutrient status of P, on average, were from moderate to high levels, meanwhile, the nutrient status of K was from low to high levels. Recommendations for fertilizing rice fields in several sub-districts in Mempawah Regency are mostly 150 kg NPK (15:15:15) ha-1, 200 kg Urea ha-1 and 25 kg KCl ha-1

    The Position of Expert Witnesses in Medical Malpractice Cases in Indonesia

    Medical malpractice is one of the most difficult professional errors to prove. In solving medical malpractice cases, law enforcement is always assisted by doctors by connecting experts to reveal the truth with their expertise. The position of doctors as experts is very important and strategic. However, it is not easy for a doctor who wants to become a expert witness because the relationship of the suspect is a colleague. If the doctor want to be an expert witness then his testimony in court is not objective or impressed protect his colleagues. This study suggests that in the completion of medical malpractice cases in court can apply the system of proof by changing the proof to the doctor. In addition, this study also suggests to resolve medical malpractice cases that can be solved through the way of mediation before pursuing litigation settlement. In the aspect of Islamic law, the position of expert witness (ra`yu al-khābir) is very important to explain or interpret a case that is vague and difficult to prove. However, an evidentiary system unable to prove the medical malpractice case then Islamic law can justify by using other methods that can bring benefit in general.[]Malpraktik medik adalah salah satu kesalahan professional yang sangat sulit dibuktikan. Dalam menyelesaikan kasus malpraktik medik, penegak hukum selalu dibantu oleh dokter sebagai saksi ahli untuk mengukapkan kebenaran sesuai dengan keahlian yang dimilikinya. Kedudukan dokter sebagai saksiahli sangat penting dan strategis. Namun, tidak mudah mendapatkan dokter yang mau menjadi saksi ahli terhadap tersangka karena saksi ahli dengan tersangka adalah teman sejawat. Apabila dokter mau menjadi saksi ahli maka kesaksiannya di pengadilan dinilai tidak objektif atau terkesan melindungi teman sejawatnya. Penelitian ini menyarankan supaya dalam penyelesaian kasus malpraktik medik di pengadilan dapat menerapkan sistem pembuktian terbalik dengan memindahkan beban pembuktian kepada dokter. Selain itu, penelitian ini juga me­nyarankan supaya penyelesaian kasus malpraktik medik dapat diselesaikan melalui jalur mediasi sebelum menempuh penyelesaian secara litigasi. Dalam aspek hukum islam, kedudukan saksi ahli (ra`yu al-khābir) sangat penting untuk menerangkan atau menafsirkan suatu perkara yang kabur dan sulit dibuktikan. Namun, apabila sistem pembuktian dengan menggunakan saksi ahli tidak mampu membuktikan perkara malpraktik medik maka hukum islam dapat membenarkan menggunakan metode lain yang dinilai dapat mendatangkan maslahat secara umum
