ISU-ISU BERKAITAN HUKUM PENGAGIHAN ZAKAT OLEH LEMBAGA ZAKAT SELANGOR (LZS): ANALISIS DARI PERSPEKTIF TEKS FIQH TURATH JAWI

Kajian ini bertujuan untuk menganalisis dan menilai beberapa isu mengenai pengagihan zakat yang dilihat menjadi perselisihan dari sudut hukum khusus di Lembaga Zakat Selangor (LZS). Permasalahan ini dikaji menurut perspektif syara’ dengan tumpuan rujukan terhadap teks fiqh turath jawi kerana ia dianggap sebagai sumber rujukan yang berautoriti dalam mengeluarkan hukum yang lebih sesuai dengan konteks Nusantara. Isu yang diketengahkan terdiri daripada empat perkara. Antaranya peruntukan asnaf amil digunakan bagi pengurusan asnaf muallaf dan riqab, agihan dana zakat di luar wilayah Selangor, bayaran perubatan pesakit kritikal sebagai asnaf al-gharimin dan pembayaran zakat kepada asnaf fakir dan miskin dalam bentuk latihan dan modal. Metodologi kajian yang diaplikasikan adalah ‘content analysis’

Tahap Pengetahuan, Kemahiran dan Sikap Guru Pendidikan Islam (GPI) Terhadap Kesediaan Pengajaran dan Pembelajaran (PdP) Mod Atas Talian

Kajian ini bertujuan untuk meninjau kesediaan GPI dalam PdP mod atas talian. Selain itu, kajian ini juga dijalankan untuk menentukan tahap pengetahuan, kemahiran dan sikap GPI terhadap kesediaan PdP mod atas talian. Seramai 236 orang guru Pendidikan Islam yang mengajar di sekolah kebangsaan daerah Kota Setar telah dipilih sebagai sampel kajian. Kajian ini menggunakan kaedah tinjauan dengan instrumen borang soal selidik. Analisis deskriptif menggunakan kekerapan, peratus dan min. Secara keseluruhan, dapatan kajian menunjukkan bahawa guru-guru Pendidikan Islam mempunyai tahap pengetahuan yang tinggi, tahap kemahiran yang sederhana dan tahap sikap yang sederhana terhadap kesediaan PdP mod atas talian ini. Dalam konteks PdP atas talian pula, ia diklasifikasikan kepada dua bahagian iaitu sikronis dan asikronis. Menjadi keperluan untuk guru-guru menambahkan ilmu perkakasan aplikasi digital semasa supaya seiring dengan arus pembangunan pendidikan moden masa kini

Elemen Perbelanjaan dalam Perkahwinan Melayu: Tinjauan Hukum dari Perspektif Fiqh Kontemporari

Terdapat beberapa jenis perbelanjaan dalam perkahwinan Melayu di Malaysia. Justeru, penulisan ini mengkaji elemen-elemen perbelanjaan tersebut. Antara elemen perbelanjaan tersebut ialah perbelanjaan bagi tujuan majlis perkahwinan iaitu hantaran kahwin dan kad kahwin. Sejarah menyaksikan masyarakat umumnya keliru tentang hantaran kahwin dan mas kahwin. Selain itu, ahli masyarakat juga gemar mengadakan majlis perkahwinan yang serba mewah sehingga menyebabkan mereka terbeban. Kajian ini turut membincangkan bagaimana hantaran kahwin yang rendah serta majlis perkahwinan yang sederhana mampu merealisasikan maqasid al- syariah iaitu memelihara harta. Kajian menggunakan satu metode utama iaitu kajian kepustakaan bagi mendapatkan sorotan sejarah hantaran kahwin dan nilainya dalam ‘urf Melayu di samping analisis elemen perbelanjaan yang dituntut dalam Islam. Hasil kajian mendapati bahawa Islam tidak melarang kewujudan elemen perbelanjaan perkahwinan tersebut tetapi ia perlulah dalam kadar yang sederhana dan tidak membebankan

Sumbangan Tok Guru Haji Abbas dalam penubuhan sekolah kluster kecemerlangan

Penulisan ini mengkaji latar belakang tokoh ulama Melayu yang bernama Tok Guru Haji Abbas. Beliau merupakan perintis salah sebuah sekolah kluster kecemerlangan di Terengganu. Beliau telah menubuhkan Pondok Tok Jiring pada tahun 1953 dan kini pondok tersebut telah dinaiktaraf menjadi salah sebuah sekolah kluster kecemerlangan terkenal di negeri Terenggganu. Sekolah yang dimaksudkan ialah SMKA Dato’ Haji Abbas. Kajian ini membincangkan sumbangan tokoh dalam bidang pendidikan. Kajian menggunakan satu metode yang utama iaitu kajian kepustakaan bagi mendapatkan latar belakang tokoh, pendidikan beliau dan sumbangannya dalam bidang pendidikan di Terengganu. Selain itu, kajian turut mengenalpasti mereka yang pernah berguru dengan tokoh. Hasil kajian mendapati bahawa Tok Guru Haji Abbas bukan sahaja perintis kepada Pondok Tok Jiring malahan turut mengasaskan beberapa tempat belajar di Terengganu dan Kelantan di samping menghasilkan beberapa karya ilmiah

The evaluation of V-Hajj: A courseware for Hajj learning procedures

Previous researches and current initial findings have shown that conventional approaches used in most Hajj supplementary learning materials are less effective in providing clear understanding to users, particularly the pilgrims.Most of the materials are based on passive learning.Thus, in order to cater for those limitations , this study incorporates virtual environment (VE) and multimedia technology in developing V -Hajj courseware as an attempt to provide a better learning aid for supporting active and self-directed learning for Hajj.In addition, this courseware is also intended to persuade users, and in this case elders to use computer technology as their main supplementary learning material. Thus, this study adapted the persuasive design guidelines from persuasive technology. Generally, this paper elaborates the evaluation that has been conducted on the V-Hajj courseware. It also reviews some related literatures about Hajj, multimedia, VE and persuasive technology. Lastly, this paper discusses on the results of the evaluation on the targeted users

The model of persuasive Hajj learning environment

Hajj is one of five pillars of Islam.Every capable and able-bodied Muslim is obliged to make the pilgrimage to Mecca at least once in their lifetime.Even though comprehensive courses were provided before the pilgrimage particularly in Malaysia, additional learning material is still needed.This is due to the complexity of Hajj procedures comprehension including the practical parts. Multimedia (MM) and virtual environment (VE) technology adaptation seems appropriate to be used for Hajj learning.Nevertheless, to design and develop a Hajj learning procedure application needs thorough preparation to achieve the objectives of use, particularly when it deals with elderly peoples who are not really interested in the technological approach learning.Thus, this paper proposed a model of persuasive Hajj learning environment and the theories usage; covering constructivist, MM principles, persuasive design principle and CTML use.This prototype was developed based on the model, and a heuristic evaluation also has been discussed in the end of topic.The methodology used in this study is an adaptation of the research design used by Vaishnavi and Kuechler in 2008.This paper is hoped to bring ideas and help designers and developers in the future

The application of regression analysis on users tolerance to prolonged waiting time: the case of KTM Komuter services of Malaysia

Public transport routes and services are the vital movement agents in urban areas. Amongst issues of public transport performances are waiting time and transfer penalties incurred during multi-modal journey undertakings. This study has applied regression analysis on prolonged waiting time in order to quantify passengers’ tolerance to inconsistencies in train departure and arrival times. Some 1000 users of KTM Komuter services, in Kuala Lumpur, Malaysia have participated in this study. The regression analysis model which is being developed shows that high tolerance to waiting time have been persistent among many commuters of the rail services. Several independent variables including socio-demographic and rail services characteristics have been found to have influenced this high level of tolerance. Other models have also been developed for variation to tolerance to punctuality (time arriving), modified ticketing systems, delays time, changing frequency, increased safety eleme n! ts, and convenience levels. The regression analysis results have shown that if these inefficiencies and inconsistencies are not addressed in a timely and systematic manner, public transport services will experience more dwindling numbers of passengers in the near future. The models developed, are deemed to be useful for the services operators and regulators since they are planning and developing various systems improvements in the coming years to encourage mode switching behaviours from private vehicles to public transport use

فقه المعاملات المالية: دراسة تحليلية وصفية لنظرية الملكية في الإسلام = Fiqh of financial transaction: descriptive and analytical study on ownership concept in Islam

إن الملكية ظاهرة من ظواهر المجتمع لا تنفك عنه أبدا وتعتبر لازمة من لوازم الحياة. وقد جاء الإسلام بمنهج شامل للحياة كلها ومن ذلك من يتعلق بالملكية. وحب التملك غريزة فطر الإنسان عليها. والمال محور النشاط الاقتصادي في كل مجتمع وحجر الزاوية في بنيانه الاجتماعي. لذا، فقد تناول الإسلام الملكية من كافة جوانبه ونظمه تنظيما دقيقا حتى لا يؤدي إلى التعدي بين الناس. تحاول هذه الدراسة أن تلقي الضوء على نظرية الملكية في الفقه الإسلامي من خلال تعريفها، وحقيقتها، وأنواعها، وما يرد عليها من قيود. وباستخدام المنهج التحليلي من خلال الدراسة المكتبية، ثم جمع أهم الموضوعات التي تتعلق بالمكية من بعض الكتب والأبحاث التي كتبها المؤلفون من الفقهاء وغيرهم، وجعلها في صورة التنظير الفقهي جمعا للمتفرقات، وتيسيرا لتناول نقاطها المتشعبة، واختصارا لمطولاتها التي قد تؤدي إلى صعوبة القراءة وفهمها. ومن نتائج هذه الدراسة أن نظام الملكية في الإسلام جعل معاملات الناس تسير وفق تعاليمه بشكل صحيح بحيث لا يكون هناك ظلم واعتداء فيما بينهم. أن الإسلام أباح أخذ أنواع وسائل الكسب والتملك التي لم يرد فيها نهي أو تحريم من الشرع خلال أسباب الملكية المشروعة وحرم أسباب الملكية غير المشروعة. ولأجل المحافظة على صلاح الناس في معاملاتهم وإزالة الضرر منهم وضع الإسلام قيودا على أسباب التملك وأقر جواز نزع المليكة الخاصة جبرا في حال الضرورة

Green and construction supply chain management: The Malaysian scene

Construction industry concerns not only property development but the built-environment as a whole.As the construction industry continues to develop the built environment within the natural environment, stakeholders are accountable to achieve the highest standards of quality, occupational safety and health, and environmental practices.As business operations expand in scope and borders,many successful companies of today are exploring new ways of gaining ground over their competitors in the market. The environmental aspects is considered as one of the key thrusts in the development of the Malaysian construction industry.This paper addresses some issues concerning the applicability of supply chain management in the context of the construction industry, with Malaysia being the backdrop to this research effort.More specifically, this paper will present the results of an initial effort in identifying the awareness level of the key construction industry players, namely the developer/client, contractor, and supplier on the green issue in context of the Construction Supply Chain Management (CSCM).From the results of the study, it was revealed that there were several issues regarding the environment that needs looking at.A discussion based on these findings, which was obtained through a mix of qualitative and quantitative approaches, is also presented. Finally, this paper rounds of the research with a conclusion and some recommendations for future endeavours

RUKUN-RUKUN AL-BAY’ DAN AL-IJARAH DALAM KITAB SULLAM AL-MUBTADI KARANGAN SYEIKH DAUD AL-FATANI : ANALISIS DARI PERSPEKTIF MAQASID AL-SYARIAH: Principles of Al-Bay’ And Al-Ijarah In The book Sullam Al-Mubtadi Written by Syeikh Daud Al-Fatani: An Analysis within the Perspective of Maqasid Al-Syariah

The development of discussion on Fiqh Muamalat began since the Prophet Muhammad SAW. This is because one of the aspects contained in the Qur'an and al-Sunnah is about the aspects of economy and muamalat. With the development of Islamic civilization, the discussion of it also flourished, especially with the emergence of fiqh scholars and fiqh schools of thought (mazhab). The scholars of fiqh are among those who have played an important role in introducing ideas based on the naqli and aqli evidences and they conducted discussions on fiqh muamalat and economy. Traditional scholars in the archipelago such as Sheikh Daud al-Fatani are considered among those who played the role in the Malay World. One of the major issues discussed in fiqh muamalat is al-Bay' (sale and purchase) and al-Ijarah (rents). In this regard, the related issues arise as to the principles of Maqasid al-Syariah which lead to the discussion. Based of the mentioned fact, this study aims to analyze the principles of Maqasid al-Syariah contained in Rukun (principle) of al-Bay 'and al-Ijarah with a focus on one of Syeikh Daud works namely the book Sullam al-Mubtadi by adopting Content Analysis' method.Perkembangan perbincangan mengenai fiqh muamalah bermula sejak perutusan Nabi Muhammad s.a.w. kerana salah satu aspek yang terkandung dalam al-Quran dan al-Sunnah ialah mengenai aspek-aspek perekonomian dan muamalah. Dengan berkembangnya tamadun Islam maka perbincangan mengenainya turut berkembang, terutamanya dengan kemunculan ahli-ahli fiqh dan mazhab-mazhab fiqh. Ahli-ahli fiqh adalah antara golongan yang telah memainkan peranan penting dalam mengemukakan idea berdasarkan dalil-dalil naqli mahupun aqli dan menyusun perbincangan mengenai fiqh muamalah dan ekonomi (Muhammad Nejatullah Siddiqi (1981). Ulama-ulama tradisi di Nusantara juga seperti Syeikh Daud al-Fatani tidak ketinggalan dalam memainkan peranan tersebut di Alam Melayu. Salah satu bahagian yang utama dalam perbincangan fiqh muamalah adalah mengenai al-Bay’ (jual-beli) dan al-Ijarah (sewa-menyewa). Sehubungan dengan itu, isu berkaitan yang timbul adalah mengenai prinsip-prinsip Maqasid al-Syariah yang melatari perbincangan tersebut. Maka, kajian ini bertujuan untuk menganalisis prinsip-prinsip Maqasid al-Syariah yang terkandung dalam Rukun al-Bay’ dan al-Ijarah dengan tumpuan terhadap salah satu karya beliau iaitu kitab Sullam al-Mubtadi dengan menggunapakai kaedah ‘Content Analysis’
