From Usul Fiqh to Legal Pluralism: An Autoethnography of Islamic Legal Thought

This article seeks to introduce an autoethnography as a method in studying Islamic law. Through an autoethnography, a scholar could share a unique and subjective experience, which would not only contribute to the understanding of social phenomenon but also reflect on possible different situations upon knowing the reality. It not only makes a sequence of events and their interpretation, but it also asks readers to emotionally ‘relive’ the events with the writer of autoethnography. This article uncovers processes and dynamics of my own thought in approaching and comprehending law in Islam including topics such as usul fiqh and legal pluralism. It discloses the development of my research interest and scope, both nationally and internationally in the past three decades. The article argues that knowledge is not necessarily produced by research work. In fact, personal narratives are considered scientific in that they could contribute knowledge to what we know about the world in which we live. And, last but not least, personal stories are valuable if they could: 1) provide a legitimate claim or justification, 2) offer something new to learn, and 3) help other people cope with or better understand world issues.Keywords: autoethnography, Islamic law, legal pluralism, usul fiqh

Competing Political Ideologies on the Implementation of Islamic Law in Indonesia: Historical and Legal Pluralist Perspectives

A contest between different political ideologies took place in the early years after the independence of the Republic of Indonesia. The debate centered on whether the new state would officially apply Islamic law. This article looks at the past events that demonstrated the recurring contest between various ideological camps at different levels and forms. Employing both historical and legal pluralist perspectives, this article ponders several themes at different time and places to show typologies of political ideologies throughout Indonesian modern history. DOI: 10.15408/ajis.v17i2.623

Dari hakim tunggal ke majelis hakim: telaah atas transformasi pranata hakim agama di Indonesia

Penelitian didorong oleh kenyataan bahwa hingga saat ini belum ada penjelasan yang cukup memuaskan mengenai alasan terjadinya transformasi pranata hakim agama di Indonesia; dari hakim tunggal ke majelis hakim. Pada umumnya, pranata hakim agama yang berbentuk majelis hakim itu diterima secara bulat (taken for granted) oleh umat Islam Indonesia sebagai tradisi yang berasal dari ajaran Islam. Padahal, sebenarnya, format majelis hakim seperti itu bukanlah tradisi orisinal Islam. HasH penelitian ini menunjukkan bahwa terbentuknya tradisi majelis hakim sedemikian itu bukanlah berasal dari Staatsblad nomor 152 tahun 1882 yang dikeluarkan pemerintah kolonial Hindia Belanda, melainkan bersumber dari kerajaan Muslim Mataram pada abad ke-17, persisnya pada masa pemerintahan Sultan Agung (1613-1645). Terbentuknya tradisi majelis hakim itu merupakan hasil proses adopsi, adaptasi, dan modifikasi antara ketentuan hukum acara Islam dan warisan tradisi peradilan dari kerajaan Hindu Majapahit. Ada beberapa alasan yang dapat ditunjuk mengapa kerajaan Muslim Mataram menyimpang dari tradisi Islam, khususnya dalam hal format pranata hakim agama. Pertama, faktor proses pertumbuhan dan pembentukan kerajaan Muslim Mataram. Kedua, faktor geografis wilayah kerajaan Mataram. The storage of perishable products: A decision-support tool to manage temperature-sensitive products warehouses

With the growth of customer awareness and regulations in force on quality and safety of perishable products, the handling of environmental conditions experienced by products along the supply chain assumes increasing relevance. The storage temperature is one of the most important drivers in controlling the physicochemical properties of a perishable product throughout the distribution chain. Therefore, a fair strategy for ensuring the quality and safety of products to the final consumer is to monitor the temperature conditions experienced by products during their storage time spent in warehouses, through dedicated location-mapping activities. However, the warehousing literature reveals a lack of methods and tools to lead managers through temperature warehouse mapping. In view of this, this chapter proposes a tool tailored for the calculation and visualization of temperature profiles of each storage location over a given time period. The proposed tool is validated through a multiple case study provided by two third-party logistics (3PL) companies that deal with the storage of biomedical products and beverages, respectively. Then, a support-decision model devoted to the storage assignment problem for a perishable item warehouse is formulated. This model, properly fueled by the proposed tool, can be used to handle operational decisions and the put-away process when stored items can be affected by thermal stresses
