    Tinjauan Akad Murabahah Li Al-amr BI Ashira

    This article aim to examine the term of mura>bah}a li al-a>mr bi ashira> (MLAB) is not widely known by practitioners and observers of Islamic economics. MLAB is a term of contemporary fikih that is different from classical mura>bah}a, the difference is not located at the level of the concept, but lies in the procedures performed. The most fundamental difference between mura>bah}a and MLAB is located on the parties to a contract; in MLAB parties directly involved are the sellers, banks and customers as a buyer, while the mura>bah}a parties involved only the seller and buyer. In addition, there is necessity in carrying out the promise of MLAB (wa\u27ad al-mulzim) the sale and purchase of a promise by the bank and the customer. The method of this article is to review the opinion of Islamic scholars in many books and articles, meanwhile the aim of this article is to explain the controversial behind of two contracts such as mura>bah}a, and mura>bah}a li al-a>mr bi ashira>>> in the implementation of Islamic Finance and Islamic Banks

    Implementasi Sistem Small Claims Court dalam Perkara Perdata Guna Mewujudkan Peradilan Sederhana, Cepat, dan Biaya Ringan di Pengadilan Negeri Jambi

    Tujuan penelitian ini adalah: (1) mengetahui dan menganalisis perkara-perkara perdata apa saja yang dapat diselesaikan dengan mekanisme penyelesaian sengketa melalui small claims court; (2) mengetahui apakah mekanisme small claims court dapat membantu terwujudnya asas peradilan sederhana, cepat dan biaya ringan. Penelitian ini adalah penelitian yuridis empiris, yaitu dengan mempelajari dan mengkaji asas-asas hukum dan kaidah-kaidah hukum positif peraturan perundang-undangan, dan bahan-bahan kepustakaan yang berkaitan dengan penyelesaian sengketa perdata dan mekanisme small claims court di Pengadilan Negeri Jambi. Analisis data dilakukan secara kualitatif, hasil analisis dideskripsikan dan disajikan sebagai pernyataan dan dalam bentuk laporan. Hasil penelitian bahwa selama tahun 2017 terdapat dua kasus yang diselesaikan dengan mekanisme small claims court yakni kasus wanprestasi, penyelesaian perkara sesuai azascepat, sederhana dan biaya ringan sebagaimana yang ditentukan dalam PERMA No. 2 Tahun 2015tentang Tata Cara Penyelesaian Gugatan Sederhana. Adanya pengaturan asas peradilan yang sederhana, cepat dan biaya ringan selain dalam rangka menghilangkan rasa kekhawatiran tentang penegakan hukum (law enforcement) dari para investor asing yang menanamkan modalnya di Indonesia, kekhawatiran dari negara-negara lain yang merupakan mitra bisnis Indonesia dalam pelaksanaan perdagangan bebas, serta untuk mengurangi penumpukan perkara di Mahkamah Agung terutama pada tingkat Kasasi.

    The Comparison of Sound Level of Islamic Banks in Indonesia and Malaysia

    In facing of financial integration in the ASEAN Economic community (AEC) by 2020, Islamic banks in Indonesia must have a high level of continuity of operations to ensure business continuity and increase assets rapidly in order to boost market share of Islamic banking in Indonesia. This study was conducted to analyze the soundness comparison of Islamic banks in Indonesia and Malaysia in order to measure the readiness of Islamic banks in both countries. The study uses data of annual financial statements of 10 Islamic banks in Indonesia and 10 Islamic banks in Malaysia in 2012–2014. The results of this study indicate that Islamic banks in Malaysia are relatively better prepared compared to Islamic banks in Indonesia. Islamic banks in Malaysia have more derivative and liquidity instruments, accomodating regulation from the government, low level of non-performing financing (NPF) and the high public attention makes Islamic banks in Malaysia potentially better to compete on the era of financial integration in the AEC in 2020. In contrast, Islamic banks in Malaysia tend to be more sound than the Islamic banks in Indonesia during the period of 2012–2014.     Keywords: capital, assets quality, management, profitability, liquidity, sensitivity of risk

    Perlindungan Hukum Konsumen Terhadap Peredaran Beras Yang Tidak Berstandar Di Kota Jambi

    The purpose of this study was to identify and analyze legal protection against consumer legal protection against non-standard rice circulation in Jambi City and also to find out and analyze the legal responsibility of business actors according to Law No. 8 of 1999 concerning Consumer Protection. This type of research is juridical empirical, also known as field research, which examines the prevailing legal provisions and what happens in the realities of society and also examines the gap between das sollen and das sein or the gap between what should be according to law and reality in the field. The location of this research is the Food Security Service of Jambi Province. The population in this study counted as many as 23 consumers who suffered losses from the amount of rice that was not officially licensed by the Ministry of Agriculture in Jambi City. The sampling technique was carried out by purposive sampling (purposive sampling is a sampling technique and data source based on certain considerations). The background of the problem is that there are still many un-certified KEMTAN rice markets that are still being traded, because according to Umdang Law Number 8 of 1999 concerning Consumer Protection, business actors are prohibited from producing or trading goods and / or services that do not meet or do not comply with the standards required. requirements and provisions of laws and regulations. Based on this research, it is known that there are many differences between the forms of rice labeled according to the rules and rice that are not according to the rules which are still marketed. In this study, the authors found the reason why the rice is still circulating because rice that does not have a KEMTAN license on the market of Jambi City is supplied from outside the city of Jambi and there is still a lack of responsibility for certified rice, while the effort to overcome it is socialization. as well as an inspection conducted by the food security office of the province of Jambi to determine the development of non-standard rice circulation in the city of Jambi.   Abstrak Tujuan Penelitian ini adalah untuk mengetahui dan menganalisis perlindungan hukum terhadap Perlindungan hukum Konsumen terhadap peredaran beras yang tidak berstandar di Kota Jambi serta juga Untuk mengetahui dan menganalisis tanggung jawab hukum dari pelaku usaha menurut Undang-Undang No 8 Tahun 1999 Tentang Perlindungan Konsumen. Tipe penelitian ini adalah yuridis empiris dapat disebut pula dengan penelitian lapangan, yaitu mengkaji ketentuan hukum yang berlaku serta apa yang terjadi dalam kenyataan masyarakat dan juga meneliti kesenjangan antara das sollen dan das sein atau kesenjangan antara seharusnya menurut hukum dan kenyataan di lapangan. Lokasi penelitian ini yaitu di Dinas Ketahanan Pangan Provinsi Jambi. populasi dalam penelitian ini terhitung sejumlah 23 konsumen yang mengalami kerugian terhadap banyaknya beras yang tidak berlisensi resmi dari kementrian pertanian di Kota Jambi. Teknik penarikan sampel dilakukan secara Purposive Sampling (Purposive Sampling adalah teknik pengambilan sampel dan sumber data berdasarkan pertimbangan tertentu). Yang menjadi latar belakang masalah yaitu masih banyaknya tersebar di pasaran beras yang tidak bersertifikasi KEMTAN yang masih diperjual belikan, karena menurut UmdangUndang Nomor 8 tahun 1999 Tentang Perlindungan Konsumen pelaku usaha dilarang memproduksi atau memperdagangkan barang dan/atau jasa yang tidak memenuhi atau tidak sesuai standar yang dipersyaratkan dan ketentuan peraturan perundang-undangan. Berdasarkan penelitian ini diketahui bahwa banyak perbedaan antara bentuk beras yang berlabel sesuai aturan dan beras yang tidak sesuai aturan yang masih dipasarkan. Dalam penelitian ini penulis menemukan sebab mengapa beras tersebut masih beredar dikarenakan beras yang tidak memiliki lisensi KEMTAN yang ada di pasaran kota jambi merupakan beras yang di pasok dari luar kota jambi serta masih kurangnya tanggung jawab pelaku usaha akan beras yang bersertifikasi, sedangkan upaya penanggulangannya yaitu sosialisasi serta sidak kepasaran yang dilakukan dinas ketahanan pangan provinsi jambi untuk mengetahui perkembangan peredaran beras tidak berstandar di kota jambi

    Penataan Struktur Hukum Hak Atas Tanah dalam Rangka Keadilan dan Investasi

    Land issues in Indonesia are increasingly complex, throughout the 63 years of the UUPA as the main land regulation it has not been able to realize justice for land. The investment climate and development complexity caused by the plurality of social structures and overlapping land policies, especially since the issuance of the Job Creation Law, has now become Law no. 6 of 2023 concerning the stipulation of PERPU Law NO. 2 of 2022 concerning Job Creation becoming a law has a great influence on land law. The problem is how the political development of land law in Indonesia is developed and how to create a legal structure for control, ownership, use and exploitation of land that can fulfill the principles of justice and investment. This research is normative research with a statutory regulatory approach, a historical approach and a conceptual approach. The results of the research are that 1. the current development of land law politics tends to ignore the principles contained in the UUPA and deny agrarian reform. This is reflected in various land law regulations which give rise to ambiguity and multiple interpretations because the issuance of sectoral laws is driven by economic growth and investment and the emergence of various land conflicts at the empirical level 2. The legal structure of control, ownership, use and utilization of land can realize justice if it continues to pay attention to the principles enshrined by the UUPA, including the maximum use of land for the prosperity of the people. Suggestions, there is a need to review land law policies in the context of balancing control, ownership, use and utilization of land between providing justice for the community and facilitating investment
