La obligatoriedad de la mediación derivada de la voluntad de las partes: las cláusulas de mediación
[spa] La voluntariedad constituye el presupuesto de cualquier análisis sobre la mediación. De entre sus diversas manifestaciones, destacan la libertad de acogerse al procedimiento y la posibilidad de desistir del mismo en cualquier momento. Sin embargo, en relación con su primera manifestación ―libertad de acogerse a la mediación―, el principio de voluntariedad parece admitir ciertas modulaciones, debidas, por una parte, a la exigencia legal, en algunos casos, del uso de la mediación como condición de procedibilidad ante los tribunales (mandatory mediation) y, por otra, a la discutida admisibilidad de las llamadas"cláusulas de mediación". El estudio se centra en estas últimas. En particular, se analiza el debate que éstas han generado, su eficacia ―tanto ordinaria (derivada de su cumplimiento) como extraordinaria (consecuencia de su incumplimiento)― y la cuestión de sus posibles contenidos.[eng] Voluntariness is a prerequisite of any study on mediation. Among its many implications, a mention has to be made of the parties' freedom to start mediation proceedings and to put an end to them at any time. However, regarding the former ―the freedom to opt in― the principle appears to admit a certain degree of flexibility. This is due, on the one hand, to the existence of cases of mandatory mediation prior to litigation and, on the other, to the controversial admissibility of mediation clauses. This paper focuses on the latter. In particular, it analyses the debate surrounding the validity of mediation clauses as such and their effectiveness, both when performance occurs and when one of the parties fails to comply, as well as the question regarding their possible content
Budget Feasible Mechanisms for Experimental Design
In the classical experimental design setting, an experimenter E has access to
a population of potential experiment subjects , each
associated with a vector of features . Conducting an experiment
with subject reveals an unknown value to E. E typically assumes
some hypothetical relationship between 's and 's, e.g., , and estimates from experiments, e.g., through linear
regression. As a proxy for various practical constraints, E may select only a
subset of subjects on which to conduct the experiment.
We initiate the study of budgeted mechanisms for experimental design. In this
setting, E has a budget . Each subject declares an associated cost to be part of the experiment, and must be paid at least her cost. In
particular, the Experimental Design Problem (EDP) is to find a set of
subjects for the experiment that maximizes V(S) = \log\det(I_d+\sum_{i\in
S}x_i\T{x_i}) under the constraint ; our objective
function corresponds to the information gain in parameter that is
learned through linear regression methods, and is related to the so-called
-optimality criterion. Further, the subjects are strategic and may lie about
their costs.
We present a deterministic, polynomial time, budget feasible mechanism
scheme, that is approximately truthful and yields a constant factor
approximation to EDP. In particular, for any small and , we can construct a (12.98, )-approximate mechanism that is
-truthful and runs in polynomial time in both and
. We also establish that no truthful,
budget-feasible algorithms is possible within a factor 2 approximation, and
show how to generalize our approach to a wide class of learning problems,
beyond linear regression
Maturation of biomimetic hydroxyapatite in physiological fluids: a physicochemical and proteomic study
Biomimetic calcium-deficient hydroxyapatite (CDHA) as a bioactive material exhibits exceptional intrinsic osteoinductive and osteogenic properties because of its nanostructure and composition, which promote a favorable microenvironment. Its high reactivity has been hypothesized to play a relevant role in the in vivo performance, mediated by the interaction with the biological fluids, which is amplified by its high specific surface area. Paradoxically, this high reactivity is also behind the in vitro cytotoxicity of this material, especially pro-nounced in static conditions. The present work explores the structural and physicochemical changes that CDHA undergoes in contact with physiological fluids and to investigate its interaction with proteins. Calcium-deficient hydroxyapatite discs with different micro/nanostructures, coarse (C) and fine (F), were exposed to cell-free complete culture medium over extended periods of time: 1, 7, 14, 21, 28, and 50 days. Precipitate formation was not observed in any of the materials in contact with the physiological fluid, which would indicate that the ionic exchanges were linked to incorporation into the crystal structure of CDHA or in the hydrated layer. In fact, CDHA experienced a maturation process, with a progressive increase in crystallinity and the Ca/P ratio, accompanied by an uptake of Mg and a B-type carbonation process, with a gradual propagation into the core of the samples. However, the reactivity of biomimetic hydroxyapatite was highly dependent on the specific surface area and was amplified in nanosized needle-like crystal structures (F), whereas in coarse specimens the ionic exchanges were restricted to the surface, with low penetration in the material bulk. In addition to showing a higher protein adsorption on F substrates, the proteomics study revealed the existence of protein selectivity to-ward F or C microstructures, as well as the capability of CDHA, and more remarkably of F-CDHA, to concentrate specific proteins from the culture medium. Finally, a substantial improvement in the material's ability to support cell proliferation was observed after the CDHA maturation process

Civil Registry of minor transgender in Brazil and Spain
This article aims to reflect on the adequacy of the name and gender in the Civil Registry of the minor transgender in Brazilian law and Spanish law, since the problem seems to be appeased only with regard to the transgender person of legal age and capable. Spain is slightly ahead of Brazil in this matter, as it already has a constitutional decision in favor of the smallest transgender, however, both countries still do not present rules applicable to these individuals, nor does it have pacification in the judiciary on the subject. Thus, through qualitative methodology, with an emphasis on bibliographic and normative research, elements are presented to bridge the legislative gap in relation to the smallest transgender, in both countries, aiming to alleviate the arduous and slow march of these individuals to ensure the adequacy of the first name and gender, justifying the present study. In this perspective, preventing the desired adequacy may constitute a restriction of their fundamental rights, in addition to preventing the free development of the minor's personality according to their gender

Es bien sabido que la Ciencia y la Tecnología de los Biomateriales es muy reciente. Tanto es así que todavía no existe una sòlida normativa relativa a la evaluación de la biocompatibilidad de los biomateriales. El presente trabajo pretende introducir el concepto de Biomaterial, así como describir sus tipos y sus aplicaciones médicas y quirúrgicas. El tema de los Biomateriales es un área interdisciplinaria donde deben intervenir tanto ingenieros mecánicos y de materiales, como diseñadores y biólogos celulares, así como médicos y cirujanos. La característica que debe cumplir todo biomaterial es ser biocompatible. En consecuencia se analiza de biocompatibilidad y las técnicas habituales para evaluarla
Control de la velocidad de degradación de materiales compuestos para aplicacions biomédicas
En este trabajo se ha utilizado la técnica del dipping, para practicar varios tipos de recubrimientos de ácido poliláctico sobre un nuevo material compuesto totalmente biodegradable formado por PLA + vidrio de fosfato; siendo ambos materiales biodegradables, y por tanto, también el compuesto.
El principio de funcionamiento que presenta este tipo de técnica es actuando como barrera física entre los fluidos biológicos y el material compuesto, protegiéndolo frente a la degradación y prolongando en el tiempo las propiedades mecánicas. El control de la velocidad de degradación se ha llevado a cabo variando el grosor y el número de capas.
Mediante diversas técnicas de análisis, como los ensayos a flexión o la microscopía electrónica, se han determinado las propiedades mecánicas durante las 4 semanas que ha durado el análisis, así como los cambios morfológicos del compuesto y de la capa o capas protectoras.
Los resultados mostraron cambios significativos en la morfología de los materiales después de 4 semanas de inmersión en fluido fisiológico simulado (SBF). El recubrimiento de menor espesor obtuvo los mejores resultados
