The certainty required in conveyancing transactions is not to be lightly compromised. However much circumstances of unconscionability may I in appropriate cases, warrant equityā€™s intevention on behalf of a purchaser, the role of equity in rescuing a purchaser late with payment, even by only a few minutes I must be carefully circumscribed. The author argues for a cautious and pragmatic approach to such cases. A balance must be struck between the competing considerations of commercial certainty on me one hand, traditionally safeguarded through rigorous rules of the common law, and that of fair play and conscionability on me other.published_or_final_versio

She declared to them, 'So says Yhwh, the God of Israel': An examination of female prophets in ancient Israel

The prophet as a religious functionary with an intermediating role has been presented in the academic literature of the post-Enlightenment West largely as a category that is exclusive of the category "woman." Biblical scholarship has produced definitions of prophecy that are so narrow that they regularly exclude many of the individuals to whom biblical tradents applied the term. The category "prophet" was fluid not only in its usage by biblical tradents and redactors, but also continued to be flexible in its application by the canon shapers. Rabbinic application of the prophetic designation to biblical women will be considered as a foreground to the ongoing process of analysis. Lists of female prophets from the Mishnah, Talmud and Midrashim will be compared to biblical citations to discern one set of fluid criteria that may be applicable to a larger number of biblical characters. The broad category of professional religious intermediaries who mediate divine-human encounters in the Hebrew Bible first will be defined and evaluated, through close readings of the biblical texts that contain the relevant technical vocabulary. All of the Hebrew biblical texts referring to female prophets then will be examined with attention to their linguistic, historical, cultural, redaction and interpretive contexts. The oracles of female prophets in the ancient Near East (ANE) will be closely considered for similarities and divergences with the Israelite corpus. Biblical women whose words and actions conform to the prophetic practices of recognized prophets in the Hebrew Scriptures and in the ANE will be identified as prophets.Thesis (Ph.D.)--Duke University, 2006.School code: 0066
