    This Comment will analyze the CFPB’s proposed rule prohibiting companies from including a ban on class actions within their arbitration provisions. The CFPB’s proposed rule5 has created a political firestorm, resulting in strong opposition to the ban on class action waivers amongst both House and Senate legislators. Further, the current proposed rule has already been rejected by the House, utilizing the Congressional Review Act, an act passed in 1996 that allows the legislature to “fast-track” votes on legislation with only a simple majority from both houses of Congress, to enable a vote. The debate that surrounded the rule reflects the modern debate surrounding the efficacy of using arbitration provisions in consumer contract

    Teaching ERP Systems: Results of a Survey at Research-Oriented Universities and Universities of Applied Sciences in Germany

    Because of the increasing importance of enterprise resource planning (ERP) systems and their educational value, as well as the rapidly-changing ERP market, many universities use, or want to use, ERP systems for their courses. The aim of these courses is to teach and demonstrate different ERP-related concepts and processes. To support these courses, some ERP manufacturers co-operate closely with universities and offer their systems and resources for academic teaching. However, there are very few empirical insights on system usage in academia. Therefore, we developed a questionnaire to determine the current status of ERP system usage and integration in courses at IS chairs of German-speaking, research-oriented universities (response rate 41.4%) and universities of applied sciences (response rate 53.1%). The results show that, among the respondents, more than two-thirds of the universities and nearly all of the universities of applied sciences use ERP systems practically in their courses. Though, almost every university chair (35 out of 38) and every professor/lecturer at the universities of applied sciences (47 out of 47) that are providing practical courses for students are using at least SAP ERP systems. In comparison with a former study we could show that the taught ERP functionalities have shifted throughout the last years from selected transactions towards selected modules or even towards the complete ERP system’s core

    Today, standardised enterprise resource planning (ERP) systems are used in a majority of enterprises. There are many ERP systems with different technologies and philosophies available on the market. Therefore, the need for providing ERP knowledge by teaching the concepts of ERP systems in study courses and above all the possibilities of using these systems themselves in courses are frequently discussed in literature. Thus, we suggest a 2-course combination for teaching ERP systems at German universities where single courses dominate with mainly one large ERP system. Within this paper we present our approach for setting up the courses, the description of the courses as well as the student evaluation of this combination

    Critical success factors of ERP system implementation projects – A literature review

    The aim of our study was to gain an insight in the research field of critical success factors (CSF) of ERP implementationprojects. Therefore, we conducted a literature review – a systematic review in five different databases and among severalproceedings of international conferences. All in all, we identified 185 relevant papers – 95 single or multiple case studies, 55surveys and 35 literature reviews or articles where CSFs are derived from chosen literature. From these existing studies wederived 31 different CSFs. The top three factors identified are: Top Management Support and Involvement, ProjectManagement and User Training. Most of the relevant papers focus large enterprises. Only 12 papers explicitly focus onsmaller and medium-sized enterprises (S&ME) which can be seen as research gap in this field

    Characterization of the outer membrane proteins of Bordetella avium

    The outer membrane proteins (OMPs) of Bordetella avium were examined by sodium dodecyl sulfate-polyacrylamide gel eletrophoresis (SDS-PAGE). Profiles of Sarkosyl-insoluble OMPs from 50 virulent B. avium isolates were very similar with major 21,000- and 37,000-molecular-weight proteins (21K and 37K proteins) and at least 13 less-intensely stained proteins with molecular weights ranging from 13,500 to 143,000. Both major proteins were heat-modifiable as indicated by increased mobility when solubilized at higher temperatures prior to SDS-PAGE. The major proteins and the 27K and 31K OMPs were noncovalently associated with the underlying peptidoglycan. It was necessary to treat cell envelopes with 2% SDS and temperatures in excess of 60°C for 15 min to release the proteins from the peptidoglycan layer. Cell-surface accessibility to radioiodination was determined by labeling whole cells with [superscript]125I followed by SDS-PAGE. At least 13 bands were present in profiles from surface-labeled cells. Of the surface-labeled bands, eight corresponded to bands in a radiolabeled outer membrane preparation. The most prominent surface-labeled band corresponded to the major 37K OMP band. The OMP profile of B. avium was compared to OMP profiles from other Bordetella spp., including B. avium-like organisms and B. bronchiseptica strains isolated from turkeys. The OMP profile of B. avium was distinct from profiles of the other bordetellae. The effect of variations in growth medium on the expression of OMPs of B. avium was examined. Expression of the 22K, 24K, and 56K OMPs was decreased by addition of either 20 mM MgSO[subscript]4 or 500 ug of nicotinic acid per ml of medium;The amino acid composition and amino-terminal amino acid sequence of the major 21K OMP were determined. Proteins in an OMP-enriched preparation were separated by SDS-PAGE and electroblotted onto a polyvinylidene difluoride membrane. The band containing the 21K OMP was excised and used for amino acid analysis and amino-terminal sequencing. Aspartic acid and asparagine, glutamic acid and glutamine, and alanine were the most prevalent amino acids in the 21K protein. An amino-terminal sequence of QTVDN was obtained
