The rule in Rylands v Fletcher

The thesis will commence with a brief study of the historical1background to the rule in Rylands v Fletcher (^1) with a view to considering the extent to which Blackburn J.'s statement of the rule was the exposition of a completely new principle of law. A detailed examination will be then made of the various component parts of the rule with chapters discussing the need for an escape, whether there is liability for personal injury and the concepts of non-natural user and dangerous object. Liability for the escape of fire will also be considered. Having clarified the precise nature and scope of the tort we will then consider to what degree the general claim that the tort is one of strict liability is justifiable. An important aspect of this part of the thesis will be the consideration of the effect which the five defences to the tort and the need for there to be a non-natural user of land have on the strictness of liability. Notice will also be taken of the fact that doubts about the strictness of liability in Rylands v Fletcher together with the modern tendency of the tort of negligence to form its basis of liability more on a concept of risk than of fault means that we are moving towards an equation of the two torts. Finally we must look to the future and consider the direction in which the tort may go. Will the gap between negligence and Rylands v Fletcher diminish further until the technicalities surrounding Rylands v Fletcher result in its disappearance as a separate entity into a wider principle of negligence or will some completely new system of compensation for personal injury supersede all the present rules and make both negligence and Rylands v Fletcher redundant

This presentation will discuss the anatomy of the lumbar spinal region (lower back), the possible causes of the illness, and non-invasive ways to treat this condition. Implementing the annual national assessment at an ordinary public primary school in the Eastern Cape: a case study analysis

This empirical study describes in rich detail five teachers’ perceptions of the Annual National Assessment [ANA] at one level of the school system (Grade Three of the Foundation Phase [FP]) at an ordinary public primary school in an urban area of the Eastern Cape. Secondly, the study described the process of preparing for, implementing and assessing the 2014 ANA at the selected school. In order to generate insights for a deep understanding of how teachers perceive, prepare for and implement the ANA, the challenges that arise, and how the ANA is impacting on curriculum and pedagogy, an interpretive qualitative research approach and case study method were adopted. The researcher, a participant observer operating from an insider position, used ethnographic techniques to describe, document and analyse teachers’ perceptions and experiences of implementing the 2014 ANA tests in a specific context (one school) and at one level of the school system (Grade 3). Data gathered through observations, semi-structured interviews and document analysis were coded and analysed in order to identify emerging themes. These are compared to trends and developments in contemporary literature on educational assessment. The findings revealed that while the teachers were compliant and efficient in their implementation and administration of the ANA, they have a narrow perception of the ANA as a summative assessment serving systemic purposes. There was little, if any, evidence of them using the ANA for the formative assessment purposes intended by policy. As a result, opportunities for using the ANA to enhance teaching and learning were lost. The study illuminated the roles and responsibilities of the teachers, the school management team and Eastern Cape [EC] Department of Education [DoE] in the ANA preparation and implementation process, and the need for strengthening the support provided by the EC DoE. Although context specific, the study sheds light on how Grade 3 teachers in an ordinary public school perceive and implement the ANA. The insights afforded and lessons that can be learned from this case study may be relevant to other Foundation Phase school contexts

A philosophy of language that incorporates the manifestation of divinity shed liberally upon the psyche of humanity without violence or chaos as in that which is common to the powers and sovereignties of human beings is critical to the understanding of Holy Writ. The discourse presented here is primarily intended to foster a better general understanding of the divine directive given to Moses by Yahweh to build the wilderness sanctuary in order to objectify his majestic presence among them and draw their attention periodically to his Shekinah glory. It is the author’s deep desire to encourage ministers of religion, students and teachers of theology, linguistics, philology, and grammar, to develop an approach to biblical studies that take into account the biblical languages that were the sheaths for the sword of the word. A cursory reading of this script should generate active interest in these languages

The challenge of evaluating pain and a pre-incisional local anesthetic block.

Background. Our objective was to test the effectiveness of a local anesthetic line block administered before surgery in reducing postoperative pain scores in dogs undergoing ovariohysterectomy (OVHX). Methods. This study is a prospective, randomized, blinded, clinical trial involving 59 healthy female dogs. An algometric pressure-measuring device was used to determine nociceptive threshold, and compared to three subjective pain scales. Group L/B received a line block of lidocaine (4 mg/kg) and bupivacaine (1 mg/kg) subcutaneously in the area of the incision site and saline subcutaneously as premedication; group L/BM (positive control) received a similar block and morphine (0.5 mg/kg) subcutaneously for premedication; and group SS (negative control) received a saline line block and saline premedication. Criteria for rescue analgesia were defined before the study. Dogs were assessed prior to surgery, at extubation (time 0) and at 2, 4, 6, 8 and 24 h post-recovery. The data were analyzed with one-way ANOVA, and a Split Plot Repeated Measures ANOVA with one grouping factor and one repeat factor (time). P < 0.05 was considered statistically significant. Results. Approximately 33% of dogs required rescue analgesia at some point during the study, with no significant difference between groups. There was no significant difference between treatment groups with any assessment method. Conclusions. As there were no statistically significant differences between positive and negative controls, the outcome of this technique cannot be proven

Language Sophistication in the New Testament

Language sophistication indicates the development of language that incorporates differentiation or diversity that is constrained by integration that facilitates organization or unity. This prelude provides the backdrop for discussing language sophistication. Of necessity, any language that was a part of the continuum of salvation history (Heilsgeschichte ) should: 1) possess the sophistication necessary to re-define OT terminology, 2) have the hegemony to launch the NT church, 3) enjoy the universality that allowed for translation into contemporary languages, and 4) retain the portability that enables interpretation in post-modern languages

Linguistic Relativity in the New Testament

This is a three part discussion on linguistic relativity and the New Testament which provides some perspectives towards understanding the inter-relatedness of society, culture, and language as they would have impacted the writers of the New Testament. The ideas discussed should provide useful information for further research into the application of modern linguistics to New Testament hermeneutics, systematic theology, and biblical exegesis. The implications of linguistic relativity theory applied to this genre of literature are of extreme importance in light of resurgence in interest and work in biblical languages and modern linguistics in the last quarter of a century. Demand for Information Technology Workers in Central Florida

This is a study which attempts to determine the current and future demand for Information technology (IT) employees. A total of fifty-two (52) organizations from Central Florida responded to this study. Several interesting findings included: 1) seventy-five percent of the companies surveyed have a current hiring freeze in place for IT positions; 2) by 2006 forty percent of the companies are expected to resume hiring some IT personnel; 3) the areas of security, client support, systems analysis and consulting show the greatest demand and; 4) the most essential skills for an entry level IT position include: communications (verbal and written), database, system analysis and project management
