The uses and abuses of constitutional pluralism: undermining the rule of law in the name of constitutional identity in Hungary and Poland
This article explains why autocrats love constitutional pluralism and constitutional identity. Though these concepts were developed by scholars and jurists with the best of intentions in mind, we explain why they are also attractive to and inherently prone to abuse by autocrats. We then describe how the regimes in Hungary and Poland have made use of these concepts in their drive to consolidate autocracy. We conclude that given the dangers inherent in constitutional pluralism and its susceptibility to abuse, it should be replaced with a more traditional understanding of the primacy of EU law
Questioning and organization studies
This essay identifies a cleavage in the organisation literature that separates âquestionsâ and âquestioningâ at a very fundamental philosophical level. On the one hand, the objective notion of âquestionsâ has already been well addressed within organization studies, evident in how scholars have scrutinized questions as objects of analysis; for example, paying close attention to the forms and functions of questions as instruments of research. More recently, the linguistic turn within the social sciences has influenced how organization studies researchers have considered organizations as discursive entities, with debate extending to the discursive nature of âquestionsâ. On the other hand, the process of âquestioningâ remains under-researched. From one perspective, questioning the process of questioning is challenging, but, as we submit, this is precisely where American pragmatism can be helpful. As we explore in this essay, the forward-looking quality of pragmatist inquiry is what motors the process of questioning. Our pragmatist-inflected argument is that questioning does not have to always serve critique and position building in the organization studies field. Rather, questioning out of curiosity can build new dialogue and open up new methodological avenues. This may help change the habitual ways in which we explore ideas, problems and situations in organization studies as well as lead to more democratic forms of organizing. Crucially, in this essay we are not looking for ultimate âanswersâ; rather we hope to excite discussion about questioning by giving prominence to something that is so ubiquitous and taken-for-granted as to be invisible to many of us as an object of inquiry
Analysis of the Swift Gamma-Ray Bursts duration
Two classes of gamma-ray bursts have been identified in the BATSE catalogs
characterized by durations shorter and longer than about 2 seconds. There are,
however, some indications for the existence of a third type of burst. Swift
satellite detectors have different spectral sensitivity than pre-Swift ones for
gamma-ray bursts. Therefore it is worth to reanalyze the durations and their
distribution and also the classification of GRBs. Using The First BAT Catalog
the maximum likelihood estimation was used to analyzed the duration
distribution of GRBs. The three log-normal fit is significantly (99.54 %
probability) better than the two for the duration distribution. Monte-Carlo

Repeated Testing Sessions and Scholastic Aptitude in College Studentsâ Metacognitive Accuracy
We performed three experiments to examine the effects of repeated studyâjudgementâtest sessions on metacognitive monitoring, and to see if better students (those with higher Scholastic Aptitude Test or SAT scores) outperform low SAT students. In all experiments, mean metacognitive accuracy (bias scores and Gamma correlations) did improve with practice. Most improvement involved studentsâ ability to predict which items would not be recalled later. In addition, students with high SAT scores recalled more items, were less overconfident, and adjusted their predictions more effectively. Thus, high SAT students may be able to adjust their metacognitive monitoring effectively without feedback, but low SAT students appear unlikely to do so. Educators may need to devise more explicit techniques to help low SAT students improve their metacognitive monitoring during the course of a semester
Influence of material and gear parameters on the safety of gearing in metallurgical industry
This paper deals with the appropriate choice of parameters to obtain the desired level of safety of gears in a gearbox to drive the conveyor in the metallurgical industry under increased load. Steel with surface hardness up to 350 HBW, or heat treated steel with hardness of 500 - 650 HBW are used. As a final heat treatment are used surface hardening, cementation and hardening, nitridation. Good properties of heat-treated steels are at the correct thickness of the heat-treated layer of the tooth. Results are presented for dual-ratio gearbox with spur gears from operation of an integrated steel company
Activity of 50 Long-Period Comets Beyond 5.2 AU
Remote investigations of the ancient solar system matter has been
traditionally carried out through the observations of long-period (LP) comets
that are less affected by solar irradiation than the short-period counterparts
orbiting much closer to the Sun. Here we summarize the results of our
decade-long survey of the distant activity of LP comets. We found that the most
important separation in the dataset is based on the dynamical nature of the
objects. Dynamically new comets are characterized by a higher level of activity
on average: the most active new comets in our sample can be characterized by
afrho values >3--4 higher than that of our most active returning comets. New
comets develop more symmetric comae, suggesting a generally isotropic outflow.
Contrary to this, the coma of recurrent comets can be less symmetrical,
ocassionally exhibiting negative slope parameters, suggesting sudden variations
in matter production. The morphological appearance of the observed comets is
rather diverse. A surprisingly large fraction of the comets have long, teniouos
tails, but the presence of impressive tails does not show a clear correlation
