Realization of anisotropic compass model on the diamond lattice of Cu2+^{2+} in CuAl2_2O4_4

Spin-orbit (SO) Mott insulators are regarded as a new paradigm of magnetic materials, whose properties are largely influenced by SO coupling and featured by highly anisotropic bond-dependent exchange interactions between the spin-orbital entangled Kramers doublets, as typically manifested in $5d$ iridates. Here, we propose that a very similar situation can be realized in cuprates when the Cu$^{2+}$ ions reside in a tetrahedral environment, like in spinel compounds. Using first-principles electronic structure calculations, we construct a realistic model for the diamond lattice of the Cu$^{2+}$ ions in CuAl$_2$O$_4$ and show that the magnetic properties of this compound are largely controlled by anisotropic compass-type exchange interactions that dramatically modify the magnetic ground state by lifting the spiral spin-liquid degeneracy and stabilizing a commensurate single-$\boldsymbol{q}$ spiral

The subject of the research is the principle of proportionality as an intersectoral principle of legal responsibility. It has a constitutional nature and guarantees fairness in resolving the cases of constitutional responsibility. This principle provides individualization of constitutional-legal sanction and its proportionality to the constitutional tort, circumstances, reasons, conditions and consequences of its commission. The purpose of the article is to confirm or dispute the hypothesis that the principle of proportionality should be taken into account both in the description of the constitutional torts of elected officials in the legislation, and in the application of the rules on constitutional responsibility Methodology. The method of legal comparison is the main method of the research. The authors carry out the comparative analysis of practice of the foreign constitutional courts, the European Court of Human Rights concerning the subject of research. Traditional methods of legal academic knowledge – the analysis, synthesis, deduction, induction and a formal legal interpretation – were used also. The main results of the research and the scope of their application. The authors research the theoretical foundations, foreign experience, problems of applying the principle of proportionality in the process of implementing the constitutional-legal responsibility of elected officials in order to formulate the proposals for improving the Russian legislation and the law enforcement practice. The principle of proportionality of constitutional responsibility should be reflected in the legislation and implemented in the law enforcement practice. The measures of constitutional liability to elected officials can be based not on any, but only on a serious, gross violation of the Constitution and laws, indicating the guilty conduct. Such constitutionally punishable conduct should cause damage to the protected constitutional values or pose a threat of such damage and therefore be incompatible with the further exercise of the public legal duties and powers. Conclusions. The composition of constitutional torts should be formulated with a certain degree of abstraction in such way that conditions are created for the enforcer to take into account the repetition, systematic, duration, severity or insignificance of the committed tort and the other factors that can individualize the constitutional responsibility. Judicial and the other enforcement bodies should enforce early termination of the powers of an official as an exceptional, extreme measure of constitutional responsibility based on the principle of proportionality. The nature and severity of the constitutional offence committed, the causes, conditions and consequences thereof, the degree of guilt of the offender, consequences of the sanction for the further exercise by the person of his constitutional rights and freedoms in the political and legal sphere and the other important circumstances must be considered in case of early termination of the powers of an official. The law enforcement body should assess each time whether such measure is proportionate to the constitutional offence committed, and whether it was strictly necessary to protect the constitutional values.В статье анализируется принцип пропорциональности (соразмерности), применяемый зарубежными конституционными судами и Европейским судом по правам человека при рассмотрении дел, связанных с досрочным прекращении полномочий выборных должностных лиц. Metaphor power and language typology: Analysis of correlation on the material of the United Nations Declarations

The established approaches to language typology share the notion that the features used as a starting point for any classification are linguistic rather than discursive. This study aims to reveal the connection between typological characteristics of languages and linguacultural patterns of expressing metaphoric meaning in discourse. We seek to answer the question: is there a correlation between the way the human mind processes metaphors, and typological characteristics of languages in which those metaphors are verbalised? The research material includes the texts of the United Nations Millennium Declaration and A Universal Declaration on a Nuclear-Weapon-Free World in three languages – Russian, English and Chinese. The methodological framework is based on the quantitative analysis of indicators connected with language typology (synthesis, agglutination and isolation) and metaphor power in discourse. To determine the degree of text metaphorisation, we employed the Metaphor-driven discourse analysis (MDDA) based on the calculation of metaphor indices: Metaphor Density Index (MDI), Metaphor Intensity Index (MII), and Metaphor Functional Typology Index (MfTI). The study further juxtaposed the typology indices and metaphorisation indices to identify the correlation between the typology index values and metaphor power on the example of the UN Declarations in three languages. Research results indicate that isolating analytical languages tend to be more figurative than synthetic ones, which is reflected in higher metaphoric density, intensity of metaphor use and frequent employment of structural metaphors. The example of the Chinese language has demonstrated that its typological characteristics on the levels of graphics, word formation and syntactic structures act as prerequisites for metaphor use. The findings contribute to the understanding of the connection between fundamental frameworks of thinking, typological characteristics of languages and linguacultural patterns of expressing identical or similar meanings in discourse
