    Kesadaran dan pengetahuan masyarakat tentang maladministrasi oleh Penyelenggara Negara masih minim, dengan kenyataan seperti ini tentunya menempatkan masyarakat di posisi pasif dalam kehidupan bernegara yang hanya menerima apapun kualitas pelayanan yang diberikan oleh Penyelenggara Negara, dengan kata lain tidak ada keadilan dan kepastian bagi masyarakat dalam hal mendapatkan pelayanan publik. Penyalahgunaan kewenangan melalui bentuk maladministrasi tersebut sangat tidak dibenarkan. Maka dalam penulisan artikel ini dijabarkan pengertian maldminstrasi adalah setiap pelayanan publik yang tidak sesuai dengan standar pelayanan, kepatutan (etika) administrasi, prosedur (syarat formiil), dan ketentuan peraturan perundang-undangan. Di mana dari perbuatan maladministrasi oleh Penyelenggara Negara yang menyebabkan kerugian materiil atau immateriil dapat dilakukan penuntutan atau aduan ganti rugi seperti yang diatur dalam Undang-Undang Nomor 37 Tahun 2008 tentang Ombudsman dan Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik.     There is an adagium that the material guarantees holder have an absolute right to be enforced when juxtaposed with individual guarantees holder. Decision of the Constitutional Court number 67 / PUU-XII / 2013 laid down the payment of wages of workers should take precedence of payment when juxtaposed with the payment of creditors separatis and state claim rights. Based on the decision of the Constitutional Court above, it can be concluded that material rights are not always absolute. It is a big question about the existence of a material right that can be upheld when compared to individual guarantor holders.Keyword : Material Guarantees Holder, Constitutional Court Decision, labor wagesTerdapat suatu adagium bahwa pemegang jaminan kebendaan memiliki hak yang mutlak dapat ditegakkan apabila disandingkan dengan pemegang jaminan perorangan. Putusan mahkamah konstitusi nomor 67/PUU-XII/2013 meletakkan pembayaran upah buruh harus didahulukan pembayarannya apabila disandingkan dengan pembayaran kreditor separatis dan hak tagih Negara. Berdasarkan putusan mahkamah konstitusi di atas, dapat disimpulkan bahwa hak kebendaan tidak selalu bersifat mutlak.     Tesis ini berjudul ā€œPerlindungan Hukum Pemegang Jaminan Kebendaan Pasca Putusan Mahkamah Konstitusi Nomor 67/PUU-XI/2013ā€ dengan 2 (dua) pokok permasalahan yaitu : (1) Ratio decidendi putusan mahkamah konstitusi yang mendudukkan pemegang jaminan kebendaan tidak dapat menegakkan haknya; (2) Kedudukan Hukum Pemegang Jaminan Kebendaan Pasca Putusan Mahkamah Konstitusi Nomor 67/PUU-XI/2013. Penelitian ini adalah jenis penelitian hukum dengan menggunakan metode penelitian hukum normatif. Disamping itu juga penelitian ini menggunakan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan kasus (case approach). Hasil penelitian tesis ini menunjukan bahwa, Ratio Decidendi dalam putusan Mahkamah Konstitusi terdiri dari 3 aspek. Pertama, aspek subjek hukum yang melakukan perjanjian, perjanjian kerja merupakan perjanjian yang dilakukan antara pengusaha dan pekerja/buruh yang secara sosial ekonomis, keduanya tidaklah sejajar. Kedua, Aspek objek perjanjian, dalam perjanjian jaminan kebendaan yang menjadi objeknya adalah properti, sementara itu, perjanjian kerja yang menjadi objeknya adalah tenaga atau keterampilan (jasa). Ketiga, Aspek risiko, bagi pengusaha risiko merupakan bagian dari hal yang wajar dalam pengelolaan usahanya, Sementara itu, bagi pekerja/buruh upah merupakan sarana untuk memenuhi kebutuhan hidup bagi diri dan keluarganya. Terjadi perubahan kedudukan pemegang jaminan kebendaan pasca putusan Mahkamah Konstitusi Nomor 67/PUU-XI/2013. Pembayaran upah buruh lebih didahulukan jika dibandingkan dengan kreditor separatis. Bentuk perlindungan hukum terhadap pemegang jaminan kebendaaan yakni dengan penambahan klausul, yakni klausula asuransi yang dapat menjamin risiko yang akan timbul

    Pseudo-legislation (pseudovetgeving) in the Dutch Legal Dictionary is defined as ā€œregelstelling door een bettokken bestuursorgaan zonder dat dit op grond van een uitdrukkelijke wettelijke bepaling die bevoegdheid bezitā€. Which can be understood as a regulation made by the competent Administrative Body but the policy does not have the power based on explicit statutory provisions. In writing this article, there are three main ideas related to the background of the problems raised, namely the use of the legal system by the Indonesian state which is more inclined to the common law system or civil law system, the ordering of laws and regulations in Indonesia, and the position of pseudo legislation (pseudowetgeving) or policy regulations (beleidsregels) against existing laws and regulations in Indonesia. To provide comprehensive results, in writing articles used research methods that are normative juridical. The conclusions obtained in this study are that Indonesia is a state of law with a civil law system character that makes so many legal products issued by the executive body, including pseudo legislation. However, this is not explicitly regulated in Law Number 12 of 2011 Jo. Law Number 15 of 2019 concerning the Establishment of Legislation, but it is implied in the regulation of the National Archives of the Republic of Indonesia Number 5 of 2021 concerning General Guidelines for the Administration of Service Manuscripts, specifically in the section "regulation official documents and determination official documents". The conclusions obtained in this study are that Indonesia is a state of law with a civil law system character that makes so many legal products issued by the executive body, including pseudo legislation.
