    Part I documents how courts have failed to faithfully apply Daubert’s criteria for scientific validity to this type of evidence. It describes how ambiguities and flaws in the terminology adopted in Daubert combinedwith the opaqueness of forensic-science publications and standards have been exploited to shield some test methods from critical judicial analysis. Simply desisting from these avoidance strategies would be an improvement. Part II notes how part of the U.S. Supreme Court’s opinion in Kumho Tire Co. v. Carmichael has enabled courts to lower the bar for what is presented as scientific evidence by mistakenly maintaining that there is no difference between that evidence and other expert testimony that need not be scientifically validated. It suggests that a version of Rule 702 that explicitly insists on more rigorous validation of evidence that is promoted or understood as being “scientific” would be workable and more clearly compatible with the rule’s common law roots. Part III sketches various meanings of the terms “reliability” and “validity” in science and statistics, on the one hand, and in the rules and opinions on the admissibility of expert evidence, on the other. It discusses the two-part definition of “validity” in the PCAST report and the proposed criteria for demonstrating scientific validity of subjective pattern-matching testimony. It contends that if “validity” means that a procedure (even a highly subjective one) for making measurements and drawing inferences is fit for its intended use, then whether test results that have higher error rates than the ones selected in the report might nevertheless assist fact finders who are also appropriately informed of the evidence’s probative value must be evaluated. Finally, Part IV articulates two distinct approaches to informing judges or jurors of the import of similarities in features: the traditional one in which examiners opine on the truth and falsity of source hypotheses and a more finely grained one in which criminalists report only on the strength of the evidence. It suggests that the rules for admitting scientific evidence need to be flexible enough to accommodate the latter, likelihood-based testimony when it has a satisfactory empirically established basis

Copyright OSA (www.osa.org/pubs/osajournals.org)A laser light scattering instrument has been designed to facilitate the real-time detection of potentially hazardous respirable fibers, such as asbestos, within an ambient environment. The instrument captures data relating to the spatial distribution of light scattered by individual particles in flow using a dedicated multi-element photodiode detector array. These data are subsequently processed using an artificial neural network which has previously been trained to recognise those features or patterns within the light scattering distribution which may be characteristic of the specific particle types being sought, such as for example, crocidolite or chrysotile asbestos fibers. Each particle is thus classified into one of a limited set of classes based upon its light scattering properties, and from the accumulated data a particle concentration figure for each class may be produced and updated at regular intervals. Particle analysis rates in excess of 103 per second within a sample volume flow-rate of 1 litre per minute are achievable, offering the possibility of detecting fiber concentrations at the recommended maximum exposure limit of 0.1 fibers/ml within a sampling period of a few seconds.Peer reviewe

    Space processes for extended low-G testing

    Results of an investigation of verifying the capabilities of space processes in ground based experiments at low-g periods are presented. Limited time experiments were conducted with the processes. A valid representation of the complete process cycle was achieved at low-g periods ranging from 40 to 390 seconds. A minimum equipment inventory, is defined. A modular equipment design, adopted to assure low cost and high program flexibility, is presented as well as procedures and data established for the synthesis and definition of dedicated and mixed rocket payloads

    Scattering of non-uniform incident fields by long cylinders

    Copyright University of BremenWe investigate experimentally far-field scattering from cylinders with illumination non-uniform along the axis of the cylinder. Scattered intensity as a function of angle in two orthogonal directions is examined. Variation along the scattering angle is found to be little affected by the illumination profile. However, variation in the transverse direction follows closely the Fourier transform of the illumination pattern and reproduces the angular distribution of the incident wave. These finding apply to circular as well as hexagonal cross-section cylinders
