Clinique juridique des droits fondamentaux – CRDFED

La loi nº 69-3 du 3 janvier 1969 institue un régime dérogatoire du droit commun à l’égard des Gens du voyage. Sollicitée en ce sens, la Clinique juridique des droits fondamentaux soulève les restrictions apportées aux droits et libertés des intéressés (droit à la libre circulation, droit de vote, etc.) et en interroge la constitutionnalité et la conventionnalité. Ce travail a pour finalité de soutenir les avocats et les associations spécialisées dans leurs recours devant différentes instances juridictionnelles.Law No. 69-3 (3 January 1969) establishes vagrancy as an exception to the general law. Approached in that sense, the Fundamental Rights Law Clinic raises the limits applied to the Travellers’ rights and freedoms (right to free movement, to vote, etc.) and questions the constitutionality and conventionality of this law. À l’emphase romantique des gouffres tels qu’exprimés dans Les Fleurs du Mal répond la banalité des gouffres baudelairiens du Spleen de Paris, ceux de la vie moderne. Cette autre poésie des gouffres nous incite à relire l’œuvre poétique et critique de Charles Baudelaire, en particulier Le Peintre de la vie moderne dans lequel il théorise la modernité, c’est-à-dire le rapport entre la vie moderne et la création artistique. Aussi, cette étude se propose, dans un second temps, d’interroger la conception baudelairienne de la modernité et de la relier à son expression poétique.The banal character of Baudelaire’s abysses from Paris Spleen, the abyss of modern life, corresponds to the romantic and emphatic depiction of the abyss in Flowers of Evil. This other and different poetry of the abyss encourages us to re-read Baudelaire’s poetic and literary-critical work - especially Painter of Modern Life, in which Baudelaire developed theoretical thought about modernity, i.e. about the relationship between modern life and artistic creation. Therefore, this study re-examines Baudelaire’s conception of the modern and connects it with its poetic expression.Romantičarskom, emfatičkom prikazivanju ponora u Cveću zla odgovara banalni karakter bodlerovskih ponora iz Pariskog splina, ponora modernog života. Ta druga i drugačija poezija ponora nas ovde podstiče na ponovno iščitavanje Bodlerovog pesničkog i književno-kritičkog dela – posebno Slikara modernog života u kojem Bodler razvija teorijsku misao o modernosti, to jest o odnosu između modernog života i umetničkog stvaralaštva. Stoga, ova studija ima zadatak da preispita bodlerovsku koncepciju modernog kao i da je poveže sa njenim pesničkim izrazom

Contemporary Woman in Modern Egyptian Prose

The thesis examines the image of the modern Egyptian woman in the prose narrative of four contemporary women writers of Egypt. They are Hala El Badry, Salwa Bakr, Mona Prince and Miral al-Tahawy. Based on the interpretation and analysis of six selected literary texts this paper will aim at uncovering the authors' view on the woman of today's Egypt. The thesis will try to answer its research question, considering the historical development of woman's role and standing in Egyptian society, as well as taking into account the development of women's literature in Egypt. The research question is as follows: What is the woman's role in contemporary Egypt and how her standing in society is reflected in literary works of contemporary women writers of Egypt? The thematic analysis of the selected works will therefore focus on the fate of the main female protagonists, it will examine the extent of personal fulfilment within the field of their family life, love, intimacy and relationships, work and many others; it will point at difficulties a woman in Egypt might be facing nowadays; the analysis will also present the world women live in and it will study their opinion on societal norms, mores and religious traditions which originate in the patriarchal organisation of Arab societies and can be in a direct..

Relations économiques, libre concurrence et vulnérabilités en Europe

Le droit de la libre concurrence est, à la fois en droit européen et en droit interne, un instrument juridique singulier dans l’appréhension des vulnérabilités. Aux yeux de certains, il incarne la logique de marché, pourvoyeuse et porteuse de fragilités. Pour d’autres, il se pose au contraire en protecteur et pourfendeur des faiblesses. Entre deux, qu’en est-il ? Cette étude propose d’envisager à la fois ses forces et ses insuffisances dans la protection du marché, des concurrents et des utilisateurs. Une mention singulière est réservée à ce dernier égard aux acheteurs publics, lesquels se trouvent au cœur des enjeux économiques, sociaux, environnementaux, territoriaux et sanitaires de la problématique.In both european law and in national law, the right to free competition is an odd legal instrument regarding vulnerabilities. According to some, it embodies a market-driven rationale, necessarily carrying frailties; to others, it poses itself as a protector phasing out weaknesses. What is the position to adopt in between? This study proposes to consider both its strengths and its limits as for the protection of users, of competitors, and of the market itself. The former also benefits from a particular treatment concerning public purchasers, who stand at the intersection of economical, social, environmental, territorial and sanitary aspects of the conundrum
