    On the situation in Palestine and the war crime of transfer of civilians into occupied territory

    This paper considers the war crime at Article 8(2)(b)(viii) of the Rome Statute, 'the transfer, directly or indirectly, by the Occupying Power of parts of its own civilian population into the territory it occupies', by addressing the doctrinal elements of the provision in light of the impact which the practice of transfer of Israeli civilians into occupied territory has had on the application of the rule of international law to the broader situation in Palestine. The provision is distinct among war crimes within the Court's jurisdiction as it refers to the activity of a state – the occupying power – in addition to that of the individual perpetrator. This feature reflects the structural issues that the provision was designed to address, and emphasizes that its purpose is not so much to confront direct physical violence, but rather to prevent colonial practices. Despite the political significance of the underlying conduct there has been comparatively little analysis of the war crime itself. Following an overview of how Israel's transfer of civilians into occupied territory challenges international law's distinction between civilian and combatant and has given rise to the charge of apartheid, the paper considers the drafting history of Article 8(2)(b)(viii) of the Rome Statute, reflecting on the provision's unusual construction, before reviewing Israel's state responsibility for unlawful transfer, and considering the temporal jurisdiction of the ICC and the nature of continuing and continuous crimes

    Genome-wide association study for calving performance using high-density genotypes in dairy and beef cattle

    peer-reviewedBackground Calving difficulty and perinatal mortality are prevalent in modern-day cattle production systems. It is well-established that there is a genetic component to both traits, yet little is known about their underlying genomic architecture, particularly in beef breeds. Therefore, we performed a genome-wide association study using high-density genotypes to elucidate the genomic architecture of these traits and to identify regions of the bovine genome associated with them. Results Genomic regions associated with calving difficulty (direct and maternal) and perinatal mortality were detected using two statistical approaches: (1) single-SNP (single nucleotide polymorphism) regression and (2) a Bayesian approach. Data included high-density genotypes on 770 Holstein-Friesian, 927 Charolais and 963 Limousin bulls. Several novel or previously identified genomic regions were detected but associations differed by breed. For example, two genomic associations, one each on chromosomes 18 and 2 explained 2.49 % and 3.13 % of the genetic variance in direct calving difficulty in the Holstein-Friesian and Charolais populations, respectively. Imputed Holstein-Friesian sequence data was used to refine the genomic regions responsible for significant associations. Several candidate genes on chromosome 18 were identified and four highly significant missense variants were detected within three of these genes (SIGLEC12, CTU1, and ZNF615). Nevertheless, only CTU1 contained a missense variant with a putative impact on direct calving difficulty based on SIFT (0.06) and Polyphen (0.95) scores. Using imputed sequence data, we refined a genomic region on chromosome 4 associated with maternal calving difficulty in the Holstein-Friesian population and found the strongest association with an intronic variant in the PCLO gene. A meta-analysis was performed across the three breeds for each calving performance trait to identify common variants associated with these traits in the three breeds. Our results suggest that a portion of the genetic variation in calving performance is common to all three breeds. Conclusion The genomic architecture of calving performance is complex and mainly influenced by many polymorphisms of small effect. We identified several associations of moderate effect size but the majority were breed-specific, indicating that breed-specific alleles exist for calving performance or that the linkage phase between genotyped allele and causal mutation varies between breeds

    Three-year outcomes of a once daily fractionation scheme for accelerated partial breast irradiation (APBI) using 3-D conformal radiotherapy (3D-CRT).

    The aim of this study was to report 3-year outcomes of toxicity, cosmesis, and local control using a once daily fractionation scheme (49.95 Gy in 3.33 Gy once daily fractions) for accelerated partial breast irradiation (APBI) using three-dimensional conformal radiotherapy (3D-CRT). Between July 2008 and August 2010, women aged ≥40 years with ductal carcinoma in situ or node-negative invasive breast cancer ≤3 cm in diameter, treated with breast-conserving surgery achieving negative margins, were accrued to a prospective study. Women were treated with APBI using 3-5 photon beams, delivering 49.95 Gy over 15 once daily fractions over 3 weeks. Patients were assessed for toxicities, cosmesis, and local control rates before APBI and at specified time points. Thirty-four patients (mean age 60 years) with Tis 0 (n = 9) and T1N0 (n = 25) breast cancer were treated and followed up for an average of 39 months. Only 3% (1/34) patients experienced a grade 3 subcutaneous fibrosis and breast edema and 97% of the patients had good/excellent cosmetic outcome at 3 years. The 3-year rate of ipsilateral breast tumor recurrence (IBTR) was 0% while the rate of contralateral breast events was 6%. The 3-year disease-free survival (DFS), overall survival (OS), and breast cancer-specific survival (BCSS) was 94%, 100%, and 100%, respectively. Our novel accelerated partial breast fractionation scheme of 15 once daily fractions of 3.33 Gy (49.95 Gy total) is a remarkably well-tolerated regimen of 3D-CRT-based APBI. A larger cohort of patients is needed to further ascertain the toxicity of this accelerated partial breast regimen

    One-Dimensional Directed Sandpile Models and the Area under a Brownian Curve

    We derive the steady state properties of a general directed ``sandpile'' model in one dimension. Using a central limit theorem for dependent random variables we find the precise conditions for the model to belong to the universality class of the Totally Asymmetric Oslo model, thereby identifying a large universality class of directed sandpiles. We map the avalanche size to the area under a Brownian curve with an absorbing boundary at the origin, motivating us to solve this Brownian curve problem. Thus, we are able to determine the moment generating function for the avalanche-size probability in this universality class, explicitly calculating amplitudes of the leading order terms.Comment: 24 pages, 5 figure

    Carlow Virus, a 2002 GII.4 variant Norovirus strain from Ireland

    <p>Abstract</p> <p>Background</p> <p>Noroviruses are the leading cause of infectious non-bacterial gastroenteritis in Ireland (population 4 million). Due to the number of outbreaks, its massive impact on the Irish health service and its seasonality, Norovirus has gained public notoriety as The Winter Vomiting Bug. The increase in cases in Ireland in the 2002–2003 season coincided with the emergence of two new Genogroup II genotype 4 variant clusters of Norovirus worldwide.</p> <p>Results</p> <p>Little research has been done on the epidemiology or molecular biology of Norovirus strains in Ireland. In an effort to combat this discrepancy, we cloned a full length human norovirus genome as a cDNA clone (J3) which can produce full length transcripts in vitro. A polymerase mutant cDNA clone (X1), in addition to a sub genomic cDNA clone (1A) were produced for use in future work.</p> <p>Carlow virus (Hu/NoV/GII/Carlow/2002/Ire) genome is 7559 nts in length, excluding the 3-end poly A tail and represents the first Norovirus strain from Ireland to be sequenced.</p> <p>Conclusion</p> <p>Carlow virus is a member of the Farmington Hills variant cluster of Genogroup II genotype 4 noroviruses.</p

    Fatness, fitness, and cardiometabolic risk factors in middle-aged white men.

    The objective was to test the hypothesis that traditional and novel cardiometabolic risk factors would be significantly different in groups of men of different fatness and fitness. Total cholesterol, high-density lipoprotein cholesterol, low-density lipoprotein cholesterol, triglycerides, glucose, insulin, high-sensitivity C-reactive protein, alanine aminotransferase, aspartate aminotransferase, γ-glutamyltransferase, leptin, adiponectin, tumor necrosis factor-α, interleukin-6, interleukin-10, fibrinogen, and insulin resistance were assessed in 183 nonsmoking white men aged 35 to 53 years, including 62 who were slim and fit (waist girth ≤90 cm and maximal oxygen consumption [VO(2)max] above average), 24 who were slim and unfit (waist girth ≤90 cm and VO(2)max average or below), 39 who were fat and fit (waist girth ≥100 cm and VO(2)max above average), and 19 who were fat and unfit (waist girth ≥100 cm and VO(2)max average or below). Seventy-six percent gave blood on 2 occasions, and the average of 1 or 2 blood tests was used in statistical tests. Waist girth (centimeters) and fitness (milliliters of oxygen per kilogram of fat-free mass) were associated with high-density lipoprotein cholesterol, leptin, and insulin resistance after adjustment for age, saturated fat intake, and total energy intake. High-density lipoprotein cholesterol, triglycerides, alanine aminotransferase, and insulin resistance were significantly different in men who were fat and fit and those who were fat and unfit. These data suggest that differences in lipid and lipoprotein concentrations, liver function, and insulin resistance may explain why the risks of chronic disease are lower in men who are fat and fit than those who are fat and unfit

    Reducing mob size increases the survival of twin-born Merino lambs when feed-on-offer from pasture is limited and ewes are supplementary fed during lambing

    Improving the survival of twin-born lambs is a high priority for the Australian sheep industry. Higher mob sizes at lambing have been suggested to decrease the survival of twin-born lambs. However, our recent work indicated that this effect may not occur when feed-on-offer (FOO) exceeds 2400 kg DM/ha during the lambing period. Increasing mob size at lambing when FOO is limited may exacerbate the risk of mismothering due to the need for ewes to seek feed and thus result in poorer lamb survival. Therefore, this study tested the hypothesis that (i) a higher mob size at lambing will decrease lamb survival when FOO from pasture is limited and ewes are supplementary fed and (ii) that this is related to a greater rate of interaction with foreign ewes and lambs during the periparturient period. Twin-bearing Merino ewes (n = 795) were allocated into one of two treatments on day 140 of pregnancy; high (n = 210) or low (n = 55) mob size, with three replicates of each treatment. Feed-on-offer from live pasture at lambing was below 390 kg DM/ha and ewes were supplementary fed until lamb marking. Behaviour during the periparturient period was observed and dead lambs were collected for autopsy for 14 days during the peak of lambing. The survival of lambs to marking was recorded for each mob. Lamb survival was 6.2% higher at the low compared to the high mob size (P < 0.05). The proportion of ewes which interacted with a foreign ewe or foreign lamb at lambing did not differ significantly between mob sizes. Whilst the relationship between mob size, ewe-lamb behaviour and lamb survival remains unclear, this study has shown that the survival of twin-born Merino lambs is improved by lambing ewes in smaller mobs when FOO from live pasture is limited and ewes are supplementary fed
