    Facing up to Facebook: politicians, publics and the social media(ted) turn in New Zealand

    Social media have an increasingly important place in the lives of citizens, and their potential to expand the reach of communication messages beyond individual networks is attractive to those looking to maximise message efficiency. The influence of Facebook in Obama’s 2008 campaign success galvanised many politicians into taking it seriously as a campaign tool. Our study explored the Facebook wall posts (1148 in total) of New Zealand Members of Parliament (MPs) leading up to the 2011 general election to determine posting behaviours and differences. Among other things, we found that women posted more frequently than men and that Labour MPs posted more than their National counterparts. Additionally, most politicians do not invite dialogue with readers of their posts, rarely get involved in comment threads and mostly take a monologic approach, using Facebook as a way of broadcasting information rather than as a medium enabling two-way flow.     Complicity in the Perversion of Justice: The Role of Lawyers in Eroding the Rule of Law in the Third Reich

    A fundamental tenet of the legal profession is that lawyers and judges are uniquely responsible—individually and collectively—for protecting the Rule of Law. This Article considers the failings of the legal profession in living up to that responsibility during Germany’s Third Reich. The incremental steps used by the Nazis to gain control of the German legal system—beginning as early as 1920 when the Nazi Party adopted a party platform that included a plan for a new legal system—turned the legal system on its head and destroyed the Rule of Law. By failing to uphold the integrity and independence of the profession, lawyers and judges permitted and ultimately collaborated in the subversion of the basic lawyer–client relationship, the abrogation of the lawyer’s role as advocate, and the elimination of judicial independence. As a result, while there was an elaborate facade of laws, the fundamental features of the Rule of Law no longer existed and in their place had grown an arbitrary and chaotic system leaving people without any protection from a violent, totalitarian government

    Mesoscale Optoelectronic Design of Wire-Based Photovoltaic and Photoelectrochemical Devices

    The overarching theme of this thesis is mesoscale optical and optoelectronic design of photovoltaic and photoelectrochemical devices. In a photovoltaic device, light absorption and charge carrier transport are coupled together on the mesoscale, and in a photoelectrochemical device, light absorption, charge carrier transport, catalysis, and solution species transport are all coupled together on the mesoscale. The work discussed herein demonstrates that simulation-based mesoscale optical and optoelectronic modeling can lead to detailed understanding of the operation and performance of these complex mesostructured devices, serve as a powerful tool for device optimization, and efficiently guide device design and experimental fabrication efforts. In-depth studies of two mesoscale wire-based device designs illustrate these principles—(i) an optoelectronic study of a tandem Si|WO3 microwire photoelectrochemical device, and (ii) an optical study of III-V nanowire arrays. The study of the monolithic, tandem, Si|WO3 microwire photoelectrochemical device begins with development and validation of an optoelectronic model with experiment. This study capitalizes on synergy between experiment and simulation to demonstrate the model’s predictive power for extractable device voltage and light-limited current density. The developed model is then used to understand the limiting factors of the device and optimize its optoelectronic performance. The results of this work reveal that high fidelity modeling can facilitate unequivocal identification of limiting phenomena, such as parasitic absorption via excitation of a surface plasmon-polariton mode, and quick design optimization, achieving over a 300% enhancement in optoelectronic performance over a nominal design for this device architecture, which would be time-consuming and challenging to do via experiment. The work on III-V nanowire arrays also starts as a collaboration of experiment and simulation aimed at gaining understanding of unprecedented, experimentally observed absorption enhancements in sparse arrays of vertically-oriented GaAs nanowires. To explain this resonant absorption in periodic arrays of high index semiconductor nanowires, a unified framework that combines a leaky waveguide theory perspective and that of photonic crystals supporting Bloch modes is developed in the context of silicon, using both analytic theory and electromagnetic simulations. This detailed theoretical understanding is then applied to a simulation-based optimization of light absorption in sparse arrays of GaAs nanowires. Near-unity absorption in sparse, 5% fill fraction arrays is demonstrated via tapering of nanowires and multiple wire radii in a single array. Finally, experimental efforts are presented towards fabrication of the optimized array geometries. A hybrid self-catalyzed and selective area MOCVD growth method is used to establish morphology control of GaP nanowire arrays. Similarly, morphology and pattern control of nanowires is demonstrated with ICP-RIE of InP. Optical characterization of the InP nanowire arrays gives proof of principle that tapering and multiple wire radii can lead to near-unity absorption in sparse arrays of InP nanowires.</p

    Reporting rural news : perspectives on public radio restructuring : a thesis presented in partial fulfilment of the requirements for the degree of Master of Philosophy in Business Studies at Massey University

    This thesis looks at the restructuring of the rural programming on New Zealand's public radio station. National Radio. The overall aim is to provide a holistic account of the changes which includes establishing their impact on programme content, and documenting the reaction of the farming community, and other stakeholders (eg. rural reporters) to them. Content analysis, defined by Berelson as "a research technique for the objective, systematic, and quantitative description of the manifest content of communication" (quoted in Kaid and Wadsworth, 1989, p.198), explores what the restructuring has meant for the content of Rural Report and Country Life (previously Country Saturday). While content analysis is central to the research, it is combined with other methodologies, namely a survey questionnaire and qualitative interviews, in an effort to more fully investigate the changes. The viewpoints of key groups are explored through a mail survey and qualitative interviews. Conference lists maintained by the Faculty of Agriculture at Massey University are used to survey members of the farming community as to their attitude toward rural programming and aspects of the restructuring. The interviews allow for input from one former and two current rural reporters, Rangitikei MP Denis Marshall, and Radio New Zealand's Programme Commissioner. The results demonstrate that the restructuring has impacted upon programme content (especially in regard to the number of stories covered, place of origin, story length and depth, issue coverage, source speaking time and use of the interview technique), and show differences between mainstream and specialist rural coverage which suggest Rural Report and Country Life are vital if National Radio is to maintain a comprehensive rural news service. Survey respondents are overwhelmingly disappointed with the restructuring and its results, while indicating that National Radio is one of the three most important sources of news for them, and the single most important broadcaster. In the interviews, reporters suggest the changes were motivated by management policy (particularly their desire to use the reporters' skills elsewhere, and a move toward de-specialising generally) and budgetary constraints. Radio New Zealand justifies the changes on the basis of income loss and the need to better cover the regions, and former Rural Report editor Peter Burke, and Rangitikei MP Denis Marshall, address wider issues, such as urbanisation. The financial and structural problems being faced by public radio have been referred to throughout the research, and these resource issues make it futile to recommend that the rural news service be restored to its previous level. However, the thesis is important for its use of content analysis to establish characteristics of rural news on National Radio, both before and after the restructuring, and its collection of a range of perspectives on the change. Despite the fact that the agricultural sector remains vital to the economic success of New Zealand, and is entwined with the history and psyche of those who live here, rural news has not been the subject of empirical inquiry here. Therefore, it is also hoped that the research, in identifying key areas of interest, will act as a springboard for further research into agricultural news

    Have License, Will Travel: An Analysis of the New ABA Multijurisdictional Practice Rules

    Multijurisdictional practice (“MJP”)—that is, law practice in a host state by an out-of-state lawyer who is licensed in a different home state—raises two primary issues: (1) is the out-of-state lawyer violating the host state’s unauthorized practice of law (“UPL”) regulations; and (2) if the lawyer is permitted to practice in the host state, what ethical rules must the lawyer follow while carrying out the work in the host state? These issues are even more complicated by issues of whether or not litigation is pending, and if so, whether it is pending in state or federal court. ABA Model Rules of Professional Conduct (“Model Rules”) 5.5 and 8.5 are designed to regulate MJP. Recognizing important deficiencies in these rules, the ABA recently adopted significant amendments. The primary goals of the amendments are formally to recognize the cross-border nature of modern law practice and to promote uniform rules that will enable lawyers to accurately predict the limits of their authority to represent their clients’ cross-border interests. First, this Article will describe some of the shortcomings of the old Model Rules in regulating MJP. Second, the Article will introduce and explain the new rules governing MJP. The Article will conclude that the amendments succeed in recognizing the realities of modern cross-border law practice and in providing a more effective model framework for MJP regulation, but the amendments do not fully achieve the ABA’s central goal of creating uniform rules that will ensure predictability in MJP

    This article considers TVNZ's audience discussion programme,&nbsp;State of the Nation, as a moment of public sphere discourse. The programme's pre-broadcast branding and deliberate construction of a bicultural television space is examined, while particular attention is given to the hosts' framing of the discussion and the programme was a questionable public sphere contribution, partly because the structuring of the discussion reinforced the established polarities of the Aotearoa/New Zealand 'race relations' debate, over-privileged producer control at the expense of audience participation and was, more generally, indicative of the limits of TVNZ's post-Charter commitment to public service broadcasting.&nbsp

    Acute Post-Activation Potentiation in NCAA Division II Female Athletes

Post-activation potentiation (PAP) is a phenomenon in which the power output of a muscle is immediately enhanced after heavy resistance exercise. Whereas the majority of PAP research has examined males, minimal research exists as to how female athletes respond. Therefore, the purpose of this study was to investigate the acute PAP response of back squats on static squat jump (SSJ) performance among NCAA Division II female athletes. Female athletes (n=29) who were current roster members from basketball, softball, and volleyball, performed 3 SSJ prior to 3 repetitions of the back squat exercise at 90% 1RM. After a 5-min rest, athletes once again performed 3 SSJ for maximal height, with peak power calculated using the Sayers equation. There was a significant interaction effect observed between time and team, p=0.022; post-hoc tests indicated that the volleyball team had a significant decrease in power, p=0.008. The main effect for time was not significant, p=0.279, indicating for the group as a whole, there was no evidence of a PAP response. The main effect for team was also nonsignificant, p=0.173, indicating no difference in power outputs by team. Strength and conditioning coaches who work with female athletes should be aware that the successful implementation of PAP complexes within this population appears to be highly individualized. Therefore, the use of PAP complexes in female athletes should consider both the absolute and relative strength of each athlete in conjunction with the length of the rest period when attempting to optimize the PAP response

    Mesoscale modeling of photoelectrochemical devices: light absorption and carrier collection in monolithic, tandem, Si|WO_3 microwires

    We analyze mesoscale light absorption and carrier collection in a tandem junction photoelectrochemical device using electromagnetic simulations. The tandem device consists of silicon (E_(g,Si) = 1.1 eV) and tungsten oxide (E_(g,WO3) = 2.6 eV) as photocathode and photoanode materials, respectively. Specifically, we investigated Si microwires with lengths of 100 ”m, and diameters of 2 ”m, with a 7 ”m pitch, covered vertically with 50 ”m of WO_3 with a thickness of 1 ”m. Many geometrical variants of this prototypical tandem device were explored. For conditions of illumination with the AM 1.5G spectra, the nominal design resulted in a short circuit current density, J_(SC), of 1 mA/cm^2, which is limited by the WO_3 absorption. Geometrical optimization of photoanode and photocathode shape and contact material selection, enabled a three-fold increase in short circuit current density relative to the initial design via enhanced WO_3 light absorption. These findings validate the usefulness of a mesoscale analysis for ascertaining optimum optoelectronic performance in photoelectrochemical devices
