Waste management, especially in the regions, is a challenge for the government. Areas that have dense populations and limited availability of land for waste processing make there a solution to overcome this. One of the waste that has not been treated properly in urban areas is organic waste. Therefore, the cultivation of BSF (Black Soldier Fly) larvae as a decomposer of organic waste can be a solution to reduce organic waste while increasing people's income through marketing BSF larvae as animal feed. One of the government institutions that conducts education, cultivation, and marketing of BSF larvae is Food Security and Agriculture Department of Surakarta City. Study aims to determine the marketing mix of BSF larvae in the Food Security and Agriculture Department of Surakarta City by using a descriptive method. The results showed that there are 7 factors that influence the marketing mix, namely product, price, promotion, place, people, process and physical evidence. The problem faced is that because BSF larvae are marketed alive, in the distribution process they must have special treatment. Fresh BSF larvae also have a short time before turning into pre-pupae. In addition, not many people are familiar with BSF larvae as an alternative feed for fish and poultry

    Get PDF
The Covid 19 pandemic, and the legal sanction for lockdowns and curfews in 2020, had a profound impact on workers even as economic downturn, reduction of labour demand, unemployment, severe financial distress, forced migration or confinement, assailed the labour sector. The informal, contractual, migratory, daily wage, and blue-collar workers across the world were especially vulnerable and most deleteriously affected, by the pandemic. A review of the legislative, legal, and judicial responses to labour rights during the pandemic, in different States provides crucial insights into how the variegated national Constitutional philosophies regarding labour and associated rights, were originally conceived, and are presently perceived, negotiated, and implemented resulting in divergent outcomes in praxis. This article based on secondary sources, critically analyses the jurisprudence underlying the legislative, legal and judicial reflexivity to labour rights during the pandemic lockdown in 2020 and 2021 in India and Indonesia, which are the two hegemonic developing economies of Asia in their respective regions, to identify the lacunae and susceptibilities in constitutional conception and its legal articulation which may be amenable to reforms for making law more socially responsive for a more egalitarian and humane society

Water is an inseparable element of human life. Data from National Geographic shows that Indonesia holds 6% of the world’s water supply or about 21% of Asia Pacific water supply. Indonesia’s potential water resource reserves are around 3,900 billion cubic meters per year. That potential lies in 5,886 streams and 521 lakes. The amount of potential water can be utilized around 690 billion liters per year. As much as 82 percent of surface water nationally is in Kalimantan, Papua, and Sumatra. Unfortunately, the potential of water is prone to run out because it is not managed responsibly. Regional autonomy that becomes the basis of independence of natural resource management in each region, is often misinterpreted. As a result, many areas experience drought in the dry season and floods in the rainy season. Through normative legal research methods, this study tries to find the root cause of water privatization in the regional autonomy regime. The problematic was then analyzed using prescriptive methods to find new concepts related to legal protection efforts against the symptoms of privatization of water management in the region. The results of this study show that: 1) Symptoms of privatization of water management are almost all over Indonesia; and 2) Legal protection efforts that can be done is to amend the Law on Water Resources and issue Local Regulations relating to the conservation and protection of water resources in the region. The recommendations given through this research are in the form of efforts to provide proper education on the management of water resources in the region

In the Indonesian constitution, the President is the holder of government power as well as the head of state. The Constitutional Court in Indonesia through its Decision Number 013-022/PUU-IV/2006 and Number 6/PUUV/2007 stated that the articles contained in the Criminal Code are in principle contrary to basic human rights. This study aims, First, to analyze the reformulation of articles on crimes against the dignity of the President and Vice President after the decision of the Constitutional Court. Second, reformulation of the regulation of criminal offenses against the dignity of the President and Vice President in the future. The research method used is normative juridical by examining library materials, both primary legal materials, and secondary legal materials. The results of the research, firstly, the articles on insulting the President and the Vice President do not explicitly mention limitations so that it can create legal uncertainty. Second, the provisions regarding haatzai articlesen and lese majeste do not have a binding force so that their inclusion in the draft Criminal Code is unconstitutional. The implications of the decision of the Constitutional Court in the legal system in Indonesia require that policymakers pay attention to the principles of human rights which in practice prioritize equality before the law, protection of freedom of opinion by the constitutional mandate

Execution of Mortgage Object Against Bankruptcy Debtors

    Get PDF
The problems arise when the company is unable to pay its debts to the bank and then the bank submits a legal remedy for bankruptcy which results in the debtor (company) being declared bankrupt. So that in the event the debtor has been declared bankrupt, the curator will carry out the execution process under the power of the supervisory judge. The execution of collateral when the debtor goes bankrupt is related to two main issues, namely, the legal regulations regarding execution and the status of collateral related to the debtor’s bankruptcy. In connection with the legal regulations regarding the execution and status of collateral when a debtor goes bankrupt, it is found that there are two different regulations, namely Law no. 37 of 2004 regarding KPKPU and Law no. 4 of 1996 regarding Mortgage Rights, so that a principle is needed to solve these problems, namely lex specialis derogate legi generalis (Special Laws defeat general laws). Therefore, based on these problems, research is carried out using normative legal research methods, by taking an approach, namely, a statute approach related to execution

Legal Protection of Indonesian Migrant Workers Affected by Covid-19

    Get PDF
Covid-19 has interrupted the fulfillment of Indonesian migrant workers’ rights, while the State has promulgated Law Number 11 of 2020 concerning Job Creation and revised Law Number 18/2017 concerning Protection of Indonesian Migrant Workers. This research aims to find out how protection and law reinforcement are given to Indonesian migrant workers by the state during the pandemic according to Law Number 18/2017 in conjunction with Law Number 11/2020. This research employed a normative method and a statutory approach. The research results have revealed that according to Law Number 18/2017, the protection given to the migrants only took repatriation, and another form of protection is still deemed to be not optimal since it did not take the engagement of roles of the companies sending Indonesian migrants. Moreover, pursuant to Law Number 11/2020, there is no reinforcement implied since the changes taking place are likely to ease administrative measures, contrary to the fact that strict permits could reduce the likelihood of illegal and non-procedural placement of migrant workers. This issue affects the fulfillment of the rights of Indonesian migrant workers, especially during the pandemic. Thus, it is essential that the state reinforce the protection given to Indonesian migrant workers during the pandemic by reinforcing legal protection every company providing labor placement service has to take into account and by imposing administrative measures as sanctions or sentencing in case of failing to abide by regulations. Moreover, permit issuance to the companies running labor placement services for Indonesian migrants has to be made stricter to ensure that only credible companies pass the requirement of migrant placement services, allowing the status of the rights of Indonesian migrant workers to be properly met amidst the pandemic.Β Keywords: legal protection; Indonesian migrant workers; COVID-19Β Perlindungan Hukum Buruh Migran Indonesia yang Terdampak Covid-19AbstrakCovid-19 telah mengganggu pemenuhan hak-hak pekerja migran Indonesia, sedangkan negara telah menerbitkan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dan merevisi Undang-Undang Nomor 18 Tahun 2017 tentang Perlindungan Tenaga Kerja Indonesia.
