    This course examines the process and substance of international trade law, focusing primarily on the law of the World Trade Organization and secondarily on the law of regional trade organizations and the foreign trade law of the United States. We will begin with an overview of issues relating to the concept of free trade, the institutionalization of international trade, the relationship between U.S. and international trade law, and WTO dispute settlement. Next, we will cover the legal principles and rules of international trade. Throughout the course, we will refer to economic and political debates and use analytical methods in these disciplines to augment our understanding of international trade law. A major objective of the course is to learn how to engage international trade law in a variety of different practice-oriented settings. Towards that end, this course feature case studies and case-based advocacy

    Seasonality in the Surface Energy Balance of Tundra in the Lower Mackenzie River Basin

    This study details seasonal characteristics in the annual surface energy balance of upland and lowland tundra during the 1998–99 water year (Y2). It contrasts the results with the 1997–98 water year (Y1) and relates the findings to the climatic normals for the lower Mackenzie River basin region. Both years were much warmer than the long-term average, with Y1 being both warmer and wetter than Y2. Six seasons are defined as early winter, midwinter, late winter, spring, summer, and fall. The most rapid changes in the surface energy balance occur in spring, fall, and late winter. Of these, spring is the most dynamic, and there is distinct asymmetry between rates of change in spring and those in fall. Rates of change of potential insolation (extraterrestrial solar radiation) in late winter, spring, and fall are within 10% of one another, being highest in late winter and smallest in spring. Rates of change in air temperature and ground temperature are twice as large in spring as in fall and late winter, when they are about the same. Rates of change in components of the energy balance in spring are twice and 4 times as large as in fall and late winter, respectively. The timing of snowpack ripening and snowmelt is the major agent determining the magnitude of asymmetry between fall and spring. This timing is a result of interaction between the solar cycle, air temperature, and snowpack longevity. Based on evidence from this study, potential surface responses to a 18C increase in air temperature are small to moderate in most seasons, but are large in spring when increases range from 7% to 10% of average surface energy fluxes

    Convicts and coolies : rethinking indentured labour in the nineteenth century

    This article seeks to shift the frame of analysis within which discussions of Indian indentured migration take place. It argues that colonial discourses and practices of indenture are best understood not with regard to the common historiographical framework of whether it was 'a new system of slavery', but in the context of colonial innovations in incarceration and confinement. The article shows how Indian experiences of and knowledge about transportation overseas to penal settlements informed in important ways both their own understandings and representations of migration and the colonial practices associated with the recruitment of indentured labour. In detailing the connections between two supposedly different labour regimes, it thus brings a further layer of complexity to debates around their supposed distinctions

    Another Brick in the Wall: An Empirical Look at Georgia Tort Litigation in the 1990s

    It has been four years since we prepared our first profile of tort litigation in Georgia. It is against this backdrop that we undertook to update and expand upon our original research. We have updated our study by collecting data from tort cases filed in the superior courts of Bibb, Gwinnett, Irwin, and Oconee counties between 1994 and 1997. Thus, for these four counties we now have data regarding the filing and disposition of tort cases for an eight-year period. We also have collected data from tort cases filed in Cobb and Fulton County superior courts between 1994 and 1997. Finally, we have collected data from state court tort filings in Cobb, Fulton, and Gwinnett counties. This is the first time a study has included state court filings

    Sexual Functioning Among Endometrial Cancer Patients Treated With Adjuvant High-Dose-Rate Intra-Vaginal Radiation Therapy

    Purpose—We used the Female Sexual Function Index (FSFI) to investigate the prevalence of sexual dysfunction (SD) and factors associated with diminished sexual functioning in early stage endometrial cancer (EC) patients treated with simple hysterectomy and adjuvant brachytherapy. Methods and Materials—A cohort of 104 patients followed in a radiation oncology clinic completed questionnaires to quantify current levels of sexual functioning. The time interval between hysterectomy and questionnaire completion ranged from 5 years. Multivariate regression was performed using the FSFI as a continuous variable (score range, 1.2–35.4). SD was defined as an FSFI score of <26, based on the published validation study. Results—SD was reported by 81% of respondents. The mean (±standard deviation) domain scores in order of highest-to-lowest functioning were: satisfaction, 2.9 (±2.0); orgasm, 2.5 (±2.4); desire, 2.4 (±1.3); arousal, 2.2 (±2.0); dryness, 2.1 (±2.1); and pain, 1.9 (±2.3). Compared to the index population in which the FSFI cut-score was validated (healthy women ages 18–74), all scores were low. Compared to published scores of a postmenopausal population, scores were not statistically different. Multivariate analysis isolated factors associated with lower FSFI scores, including having laparotomy as opposed to minimally invasive surgery (effect size, −7.1 points; 95% CI, −11.2 to −3.1; P<.001), lack of vaginal lubricant use (effect size, −4.4 points; 95% CI, −8.7 to −0.2, P = .040), and short time interval (<6 months) from hysterectomy to questionnaire completion (effect size, −4.6 points; 95% CI, −9.3–0.2; P = .059). Conclusions—The rate of SD, as defined by an FSFI score <26, was prevalent. The postmenopausal status of EC patients alone is a known risk factor for SD. Additional factors associated with poor sexual functioning following treatment for EC included receipt of laparotomy and lack of vaginal lubricant use

    'To live and die [for] Dixie': Irish civilians and the Confederate States of America

    Around 20,000 Irishmen served in the Confederate army in the Civil War. As a result, they left behind, in various Southern towns and cities, large numbers of friends, family, and community leaders. As with native-born Confederates, Irish civilian support was crucial to Irish participation in the Confederate military effort. Also, Irish civilians served in various supporting roles: in factories and hospitals, on railroads and diplomatic missions, and as boosters for the cause. They also, however, suffered in bombardments, sieges, and the blockade. Usually poorer than their native neighbours, they could not afford to become 'refugees' and move away from the centres of conflict. This essay, based on research from manuscript collections, contemporary newspapers, British Consular records, and Federal military records, will examine the role of Irish civilians in the Confederacy, and assess the role this activity had on their integration into Southern communities. It will also look at Irish civilians in the defeat of the Confederacy, particularly when they came under Union occupation. Initial research shows that Irish civilians were not as upset as other whites in the South about Union victory. They welcomed a return to normalcy, and often 'collaborated' with Union authorities. Also, Irish desertion rates in the Confederate army were particularly high, and I will attempt to gauge whether Irish civilians played a role in this. All of the research in this paper will thus be put in the context of the Drew Gilpin Faust/Gary Gallagher debate on the influence of the Confederate homefront on military performance. By studying the Irish civilian experience one can assess how strong the Confederate national experiment was. Was it a nation without a nationalism

    Listeriolysin O Causes ENaC Dysfunction in Human Airway Epithelial Cells.

    Pulmonary permeability edema is characterized by reduced alveolar Na⁺ uptake capacity and capillary barrier dysfunction and is a potentially lethal complication of listeriosis. Apical Na⁺ uptake is mainly mediated by the epithelial sodium channel (ENaC) and initiates alveolar liquid clearance. Here we examine how listeriolysin O (LLO), the pore-forming toxin of Listeria monocytogenes, impairs the expression and activity of ENaC. To that purpose, we studied how sub-lytic concentrations of LLO affect negative and positive regulators of ENaC expression in the H441 airway epithelial cell line. LLO reduced expression of the crucial ENaC-α subunit in H441 cells within 2 h and this was preceded by activation of PKC-α, a negative regulator of the channel\u27s expression. At later time points, LLO caused a significant reduction in the phosphorylation of Sgk-1 at residue T256 and of Akt-1 at residue S473, both of which are required for full activation of ENaC. The TNF-derived TIP peptide prevented LLO-mediated PKC-α activation and restored phospho-Sgk-1-T256. The TIP peptide also counteracted the observed LLO-induced decrease in amiloride-sensitive Na⁺ current and ENaC-α expression in H441 cells. Intratracheally instilled LLO caused profound pulmonary edema formation in mice, an effect that was prevented by the TIP peptide; thus indicating the therapeutic potential of the peptide for the treatment of pore-forming toxin-associated permeability edema
