    Prejudgment Remedies

This article examines the decisions of the United States Supreme Court regarding the constitutional due process requirements for validation of the prejudgment remedies of replevin, attachment, and garnishment. These decisions are analyzed with regard to Florida law as it presently exists as well as ways the law could be amended to comport with both the dictates of the Supreme Court and the traditional protections afforded the debtor by Florida law

Drawing on research from two cross-border course collaborations, we show that focused cross border online dialogues between Canadian and American graduate students can broaden students\u27 thinking beyond national borders, provide insight into how policies are implemented in schools, enable access to diverse perspectives on policy issues, and support learning about the influence of local, state/provincial, and national contexts on policy processes

Preparing politically savvy principals in Ontario, Canada

Purpose We argue that principal preparation programs should help candidates: 1) recognize the political role of the school principal; 2) develop political skills (including the ability to strategically appropriate policy); and 3) understand that the political approach of the principal influences teaching, learning, relationships, governance, and reform efforts. In addition, we report findings of our analysis of Ontario’s Principal Qualification Program guidelines to determine if they require principal preparation programs to develop aspiring school leaders’ political skills. Design/methodology/approach We reviewed theoretical arguments and empirical studies from the fields of school micropolitics, business, educational leadership, and critical policy studies to establish five political skills principals require. We then conducted a content analysis of Ontario’s Principal Qualification Program guidelines to determine if they require principal preparation programs to develop aspiring leaders’ political skills. Findings Ontario’s Principal Qualification Program guidelines do not explicitly direct principal preparation programs to help candidates develop political skills. However, the guidelines recognize that principals pursue political goals and work in political 2 environments, and they offer opportunities for appropriating the guidelines in ways that promote the development of principal candidates’ political skills. Originality/Value The paper is the first to analyze Ontario’s Principal Qualification Program guidelines to determine if they require principal preparation programs to develop aspiring leaders’ political skills. It also identifies policy appropriation as a political skill that should be developed in principal preparation programs and provides a model of how principal preparation policies themselves may be appropriated to support a focus on developing aspiring principals’ political skills

Designed with Me:Empowering People Living with Dementia

    Get PDF
This paper presents on- going research that adopts an open and truly collaborative approach to working with people living with dementia by recognising and utilising the inherent personal creative abilities that every individual possesses no matter their cognitive ability. The research project entitled " Designed with Me", via a series of carefully developed innovative co- design workshops, supports people living with dementia to express themselves fully in " live" design collaborations. Every individual's input in this research is highly valued and is held in the same esteem as any other collaborator. In this project, participants become collaborative designers helping to propose possibilities, evaluate and select solutions, give their knowledge and skills freely, and generally make things happen. " Designed with Me" highlights clearly that people living with dementia can continue to make a significant contribution to society long after a diagnosis of dementia

Slush-Ice Berm Formation on the West Coast of Alaska

    Get PDF
Some coastal communities in western Alaska have observed the occurrence of “slush-ice berms.” These features typically form during freeze-up, when ice crystal – laden water accumulates in piles on the shore. Slush-ice berms can protect towns from storm surge, and they can limit access to the water. Local observations from the communities of Gambell, Shaktoolik, Shishmaref, and Wales were synthesized to develop a taxonomy of slush-ice berm types and a conceptual process model that describes how they form and decay. Results indicated two types of slush-ice berm formation processes: in situ (forming in place) and advective (pushed in by storm winds). Several formation mechanisms were noted for the crystals that compose in situ berms. Cold air temperatures cool the surface of the water, and winds that translate surface cooling through a greater depth aid crystal formation. Snow landing in the water cools via melting of the snow and by contributing crystals directly to the water. A negative surge can expose the wet beach to cold air, allowing crystals to form on the beach, which are then picked up by waves. Slush crystals for advective berm events form offshore. Winds move the slush towards shore, where it accumulates, and wind-induced waves move it up onto the beach.

Polarisation of equine pregnancy outcome is associated with a maternal MHC class I allele

Identification of risk factors which are associated with severe clinical signs can assist in the management of disease outbreaks and indicate future research areas. Pregnancy loss during late gestation in the mare compromises welfare, reduces fecundity and has financial implications for horse owners. This retrospective study focussed on the identification of risk factors associated with pregnancy loss among 46 Thoroughbred mares on a single British stud farm, with some but not all losses involving equid herpesvirus-1 (EHV-1) infection. In a sub-group of 30 mares, association between pregnancy loss and the presence of five common Thoroughbred horse haplotypes of the equine Major Histocompatibility Complex (MHC) was assessed. This involved development of sequence specific, reverse transcriptase polymerase chain reactions and in several mares, EHV-1 specific, cytotoxic T lymphocyte activity. Of the 46 mares, 10 suffered late gestation pregnancy loss or neonatal foal death, five of which were EHV-1 positive. Maternal factors including age, parity, number of EHV-1 specific vaccinations and the number of days between final vaccination and foaling or abortion were not significantly associated with pregnancy loss. In contrast, a statistically significant association between the presence of the MHC class I B2 allele and pregnancy loss was identified, regardless of the fetus / foal’s EHV-1 status (p=0.002). In conclusion, this study demonstrated a significantly positive association between pregnancy loss in Thoroughbred mares and a specific MHC class I allele in the mother. This association requires independent validation and further investigation of the mechanism by which the mare’s genetic background contributes to pregnancy outcome
