(Excerpt) Recently, the United States Bankruptcy Court for District of New Jersey held in In re Kara Homes, Inc., 363 B.R. 399 (Bankr. D.N.J. 2007) that secured construction lenders of affiliated chapter 11 debtors were entitled to expedited relief from an automatic stay of foreclosure pursuant to section 362(d)(3) of the Bankruptcy Code because the court determined each debtor constituted single asset real estate case under section 101(51B) of the Code. The significance of expedited relief under section 362(d)(3) is it imposes an “expedited time frame for filing a plan” of reorganization in chapter 11 for single asset real estate cases, which historically are viewed as abusive postponements of foreclosure filed for the single purpose of holding on to the property, encumbered by a “major lender who is grossly undersecured,” with “no real hope . . . [of] a viable confirmable Chapter 11 plan.” In re Kkemko, Inc., 181 B.R. 47, 49, 51 (Bankr. S.D. Ohio 1995). The expedited time frame requires a debtor to file a reasonable plan of reorganization or commence making monthly payments either within 90 days after an entry of order for relief by the creditor or if there is an issue as to whether the debtor is a single asset real estate case then 30 days after court determines a debtor to be a single asset real estate case under section 101(51B) and if debtor fails to file a plan or commence payments, then the automatic stay will be lifted allowing the creditor to foreclose on the property. Furthermore, in other chapter 11 cases, there is no statutorily specified time period for reorganization and thus debtors would want to avoid being determined a single asset real estate in order to avoid the time constraints set by section 362(d)(3). Therefore, the Kara Homes approach as to what constitutes a single asset real estate case significantly increases the level of difficulty for large developers to reorganize in bankruptcy as current market conditions are hindering real estate developers from honoring commitments to their lenders

Matthias Nawrat, born in 1979 in Opole, has been living in Germany since 1989. In his latest novel Die vielen Tode unseres Opas Jurek (2015) the author returns to the country of his birth in order to recount one century of the Polish as well as of the Polish-German history. The ghastly-comical family-story uses mobile parts of stage scenery from a picaresque novel – in the centre stands a man (grandfather Jurek) who, in spite of all the atrocities of the 20th century, won’t let others prevent him from leading a joyful life. While staging the story of a struggling artist, he refers back to stereotypes, obviously with the intention of strenghtening the existing models. “It is annoying to suffer from something that causes one no pain” – in regard to Stephen Thomes’ literary attempts of insight into precarious desire

The essay is devoted to the novels of the German writer Stephen Thome. The writer’s narrative attention is focused on the puzzlement regarding intimate relations between males and females, aiming at captur-ing to what extent love, “a warming and intoxicating drug in the social coldness” (Volkmar Sigusch) is capable of making life meaningful. In the very centre of the analysis stands on the one hand the ‘in-each other-reflection’ of the male and female positions, on the other hand the palpable ambivalence between the inner freezing of the figures and their desire for gentle intimacy. The attempt has been made in order to open the arranged forms of the fulfillment of the desire – i.e. love and sexuality – to the possibility of depicting the phenomenon which is – according to Sigusch – significant for the late-modern era: more important than the sexual act for the partners is a steady relationship in which they feel accepted and preserved.The essay is devoted to the novels of the German writer Stephen Thome. Temperatures of desire. Sensual presence and cultural representations

The aim of the article is to present the interdisciplinary theoretical framework for the analysis of the constellation of temperature and desire as well as its representations in literature and culture, which have not been the subject of a broad reflection in the area of literary and cultural studies so far. The question therefore is: What is the role of the literary, iconographic and media discourses of temperature in the processes of the creating and transformations of emotional cultures, social phenomena, political condi-tions, and last but not least in the critical reflection of these processes.The aim of the article is to present the interdisciplinary theoretical framework for the analysis of the constellation of temperature and desire as well as its representations in literature and culture, which have not been the subject of a broad reflection in the area of literary and cultural studies so far. Grenzgänge. Zu (männlichen) Ausbrüchen aus emotionaler Routine im Romanwerk von Stephan Thome

Der Aufsatz ist zwei Romanen des deutschen Schriftstellers Stephan Thome gewidmet. Den Kristallisationspunkt der teils melancholischen, teils witzig pointierten Narrationen bilden sowohl in Grenzgang (2009) als auch in Fliehkräfte (2012) die verzweifelten, mehr oder minder geglückten Versuche männlicher Protagonisten, sich aus emotionaler Routine zu befreien, die in Zeiten des Abgesangs auf habituelle Männlichkeitsnormen, in unterschiedlicher Ausprägung dem männlichen Subjekt als ein notdürftiger Schutzbau für ‚sein geschundenes Ego‘ dient. Den Ausgangspunkt bilden die soziokulturell angelegten Studien, die die These widerlegen, dass das Spektrum männlicher Emotionen sich auf die Unterdrückung der Gefühle und die Disziplinierung pathologischer Leidenschaften beschränke.The article is devoted to two novels of the German writer Stephen Thome: Grenzgang (2009) and Fliehkräfte (2012). The essential element of those partly melancholic, partly witty narratives are desperate, more or less successful attempts to free the literary heroes from emotional routine which – after the fall of habitual norms of masculinity – manifests itself as a makeshift shelter for the ‚plagued ego‘ of the male subject. The point of departure in relation to those deliberations are sociological and cultural works which debunk the thesis that the spectrum of male emotions limits itself to suppressing emotions as well as to disciplining pathological desires.Artykuł poświęcony jest dwóm powieściom niemieckiego pisarza Stephana Thome: Grenzgang (2009) oraz Fliehkräfte (2012). Punktem ciężkości tych po części melancholijnych, po części dowcipnych narracji są desperackie, mniej lub bardziej udane próby uwolnienia się bohaterów z emocjonalnej rutyny, która po upadku habitualnych norm męskości przejawia się jako prowizoryczny schron dla ‚udręczonego ego‘ męskiego podmiotu. Punktem wyjścia rozważań są prace socjologiczne i kulturoznawcze, które obalają tezę, jakoby spektrum męskich emocji ograniczało się do tłumienia uczuć i dyscyplinowania patologicznych namiętności. &nbsp

Podręcznik szkolny w poglądach pedagogów i dydaktyków Drugiej Rzeczypospolitej : próby poszukiwania teorii podręcznika

Jak wynika z dotychczasowej historiografii pedagogicznej, problematyka podręczników szkolnych z okresu Drugiej Rzeczypospolitej nie była dotąd przedmiotem dociekań poznawczych wielu współczesnych autorów. A prze­cież, podobnie jak dzisiaj, zainteresowanie tą tematyką było zawsze żywe, zarówno wśród pedagogów i dydaktyków, jak i wśród nauczycieli praktyków1. Od poziomu bowiem podręczników szkolnych, od spełnianych przez nie funkcji, od układu zawartych w nich informacji, doboru ćwiczeń i zadań do rozwiązania, od umiejętności posługiwania się nimi, zarówno przez uczniów, jak i nauczycieli, zależą przecież także efekty pracy dydaktyczno-wychowaw­czej szkoły. Poglądy na treści kształcenia (w tym także na podręczniki szkolne) ule­gały zmianom pod wpływem zmieniającej się filozofii i teleologii edukacyjnej. Ponadto wpływy i przykłady zagraniczne oraz potrzeby polskiej szkoły w Drugiej Rzeczypospolitej — podobnie zresztą jak i obecnie — stawiały przed dydaktyką poważne zadania w zakresie formułowania nowych treści i ich teorii oraz opracowywania nowych podręczników (Lewowicki, 1995). Spróbujmy zatem w niniejszym artykule odpowiedzieć na następujące pyta­nia: Jak rozumiano termin „podręcznik szkolny” w 20-leciu międzywojennym oraz jak go definiowano? Jakie miejsce i rolę przypisywano podręcznikowi w szkolnictwie ogólnokształcącym II Rzeczypospolitej i dlaczego? Na czym polegały funkcje i zadania podręcznika szkolnego w okresie międzywojennym? Pytania te wyznaczają zarazem strukturę treściową niniejszego artykułu, w którego końcowej części zostaną zawarte konkluzje, wynikające z zapre­zentowanych badań
