Entre contrainte et incitation : analyse juridique de la qualification au titre de l'agriculture raisonnée

Dans les années quatre-vingt-dix, l'agriculture raisonnée est apparue comme une réponse des professionnels de l'agriculture intensive à la prise de conscience des pollutions d'origine agricole. Depuis 2002, elle est l'objet d'une procédure de qualification volontaire des exploitations et des produits. L'analyse juridique montre que le dispositif correspond à la mise en place d'une politique incitatrice dans un domaine déjà couvert par des réglementations définissant des obligations juridiques. Les pouvoirs publics, combinant contraintes et incitations, instituent une politique hybride dont la validité juridique est susceptible d'être mise en cause.

Time and Presence in Agamben’s Critique of Deconstruction

Enmeshed with Agamben’s critique of metaphysics is his critique of deconstruction. Following the sentiment he first outlined in Language and Death: The Place of Negativity (1982), deconstruction’s alleged attempt to displace the privileging of speech with that of writing to thereby dispel the negativity at the core of Western metaphysics, to the contrary has the effect of reifying this problem by expressing its terms most perfectly. Agamben takes this criticism further in the Homo Sacer series by suggesting that not only does deconstruction reiterate the problem of metaphysics, it mimics the conditions of the state of exception as rule in the temporal suspension of its infinite deferral of signification. As a counter to deconstruction’s “thwarted messianism,” in The Time That Remains: A Commentary on the Letter to the Romans (2001), Agamben posits a messianic time immanent to every instant, likening it to both the speech act and the very structure of thought itself. Giorgio Agamben, a philosopher both celebrated and reviled, is among the prominent voices in contemporary Italian thought today. His work, which touches upon fields as diverse as aesthetics and biopolitics, is often understood within a framework of Aristotelian potentiality. With this incisive critique, Doussan identifies a different tendency in the philosopher's work, an engagement with the problem of time that is inextricably bound up with language and visuality. Founded in his early writings on metaphysics and continuing to his present occupation with inoperativity, Time, Language and Visuality in Agamben's Philosophy forges an original path through Agamben's extensive commentary on the linguistic and the visual to illuminate the recurrent temporal theme of capture and evasion—the cat-and-mouse game—that bears the foundational violence of not just representation but concept-formation itself. La gestion contractuelle de l’eau avec les agriculteurs est-elle durable ? Approche politique et juridique

La diversité des modes de protection des captages d’eau potable en France révèle le polymorphisme des négociations organisées entre pouvoirs publics et agriculteurs. Une réflexion juridique et politique sur l’outil contractuel permet d’aborder certains des aspects contemporains de la gestion de l’eau : inadaptations et évolutions du droit, conditions sociologiques d’émergence des arrangements locaux, défis et enjeux d’une protection durable. Deux études de cas, l’une sur le site-pilote de Vacquières dans l’Hérault, l’autre sur les forages de Narbonne, analysées avec les outils de la science politique, permettent d’identifier la variabilité des pratiques contractuelles mises en œuvre par les acteurs locaux, publics et privés : arrangement à l’amiable avec espoir de valorisation labellisée des bonnes pratiques dans un cas ; dans l’autre, soutien financier ponctuel octroyé de façon inédite et plutôt informelle par l’entreprise délégataire du service public. Mais plusieurs questions demeurent : dans quelle mesure et pour combien de temps, cette territorialisation des réponses publiques, supposée adaptée à la diversité des contextes, permet-elle de garantir à tous une qualité de l’eau que l’on peut interpréter de façon sanitaire (le respect des normes de potabilité) ou environnementale (la préservation à long terme des milieux aquifères) ? Comment harmoniser au mieux incitations contractuelles et garde-fous législatifs ou réglementaires ?The variety of protection of drinking water catchments in France reveals many sorts of negociations between authorities and farmers. A legal and political reflexion about contractual tool leads to some contemporary trends of water management: limits and evolutions of law, sociological conditions of local arrangements, challenges and stakes for a sustainable protection. Two case studies, one in Vacquières (Hérault) and the other in Narbonne (Aude), have been analysed with the tools of the political science and they show a large diversity of contractual practices deployed by public and private stakeholders. However, two principal issues are emerging: is this territorialization of public action, which is supposed to be efficient, adapted to ensure to everybody a sanitary or even an environmental water quality? A 1-D modelling of streaming potential dependence on water content during drainage experiment in sand

The understanding of electrokinetics for unsaturated conditions is crucial for numerous of geophysical data interpretation. Nevertheless, the behaviour of the streaming potential coefficient C as a function of the water saturation Sw is still discussed. We propose here to model both the Richards' equation for hydrodynamics and the Poisson's equation for electrical potential for unsaturated conditions using 1-D finite element method. The equations are first presented and the numerical scheme is then detailed for the Poisson's equation. Then, computed streaming potentials (SPs) are compared to recently published SP measurements carried out during drainage experiment in a sand column. We show that the apparent measurement of DV / DP for the dipoles can provide the SP coefficient in these conditions. Two tests have been performed using existing models for the SP coefficient and a third one using a new relation. The results show that existing models of unsaturated SP coefficients C(Sw) provide poor results in terms of SP magnitude and behaviour. We demonstrate that the unsaturated SP coefficient can be until one order of magnitude larger than Csat, its value at saturation. We finally prove that the SP coefficient follows a non-monotonous behaviour with respect to water saturation.
