    The Oversimplification of Deregulation: A Case Study on Clinical Decision Support Software

    Until the December 2016 passage of the Cures Act, the FDA had regulatory power over clinical decision support (CDS) software; however, the Act removed a large group of CDS software from the FDA’s statutory authority. Congressional intent was to increase innovation by removing regulatory blockades—such as device testing and certification—from the FDA’s purview. This note argues that the enactment of this specific provision of the Act will instead stymie innovation and overlook the unfortunate safety consequences inherent in its deregulation. CDS software is a burgeoning field ripe for innovation; however, rapid innovation can often lead to a slew of mistakes—mistakes in software coding, mistakes in software implementation, and even mistakes in software design. This note considers the issues with deregulating CDS software, focusing on the health and safety concerns, as well as the lack of incentive for software creators to share algorithms. This note then proposes other, less-invasive regimes for CDS software regulation to address these problems

    This Essay examines the legal profession’s role in sexual harassment, particularly in the federal courts. It argues that individuals in the profession have both an individual and collective responsibility for the professional norms that have allowed harassment to happen with little recourse for the people subject to the harassment. It suggests that the legal profession should engage in a sustained, public reflection about how our words, actions, attitudes, and institutional arrangements allow harassment to happen, and about the many different ways that we can prevent and address harassment

    The Joule-Thomson effect and the non-equilibrium thermodynamics of sliding nano-contact

    Dynamical systems, having the space-timevarying behavior, takes place in the range of processes. Especially interesting are those which affect the structure and properties complex materials during its formation because of thermal communication between the different parts of the system. One of the most important features of the study is the temperature behavior in the contact area under sliding interaction. This behavior results from the large contribution of the heat capacity to the entropy. We investigate the influence of the Joule-Thomson effect on the behavior and thermal characteristics of contact area formed by debris and lubricant between the sliding surfaces when they are brought into contact with one another in commutator-and-brush assembly as an example. The model reflecting the influence of the change in the third body temperature on the material properties, geometry of the debris and the surrounding environment is proposed. The result shows the strong correlations between Joule-Thomson effect and mechanical fluctuations of the wear particles that are responsible for the size of the contact area

The conducted research allows one to assert that the models involved in the process of the metaphorical conceptualization in the framework of the national worldview are universal. The comparative analysis of the metaphorical fragments of the Russian and English terminological systems showed the asymmetry of both the qualitative and quantitative types

    Fluid Flow Prediction with Development System Interwell Connectivity Influence

    In this paper interwell connectivity has been studied. First of all, literature review of existing methods was made which is divided into three groups: Statistically-Based Methods, Material (fluid) Propagation-Based Methods and Potential (pressure) Change Propagation-Based Method. The disadvantages of the first and second groups are as follows: methods do not involve fluid flow through porous media, ignore any changes of well conditions (BHP, skin factor, etc.). The last group considers changes of well conditions and fluid flow through porous media. In this work Capacitance method (CM) has been chosen for research. This method is based on material balance and uses weight coefficients lambdas to assess well influence. In the next step synthetic model was created for examining CM. This model consists of an injection well and a production well. CM gave good results, it means that flow rates which were calculated by analytical method (CM) show matching with flow rate in model. Further new synthetic model was created which includes six production and one injection wells. This model represents seven-spot pattern. To obtain lambdas weight coefficients, the delta function was entered using by minimization algorithm. Also synthetic model which has three injectors and thirteen producer wells was created. This model simulates seven-spot pattern production system. Finally Capacitance method (CM) has been adjusted on real data of oil Field [omega]. In this case CM does not give enough satisfying results in terms of field data liquid rate. In conclusion, recommendations to simplify CM calculations were given. Field [omega] is assumed to have one injection and one production wells. In this case, satisfying results for production rates and cumulative production were obtained

    In this paper we present the interesting Behavioral Constraint Miner (iBCM), a new approach towards classifying sequences. The prevalence of sequential data, i.e., a collection of ordered items such as text, website navigation patterns, traffic management, and so on, has incited a surge in research interest towards sequence classification. Existing approaches mainly focus on retrieving sequences of itemsets and checking their presence in labeled data streams to obtain a classifier. The proposed iBCM approach, rather than focusing on plain sequences, is template-based and draws its inspiration from behavioral patterns used for software verification. These patterns have a broad range of characteristics and go beyond the typical sequence mining representation, allowing for a more precise and concise way of capturing sequential information in a database. Furthermore, it is possible to also mine for negative information, i.e., sequences that do not occur. The technique is benchmarked against other state-of-the-art approaches and exhibits a strong potential towards sequence classification.
