Management, Control, and the Dilemmas of Presidential Leadership in the Modern Administrative State
To assess the virtues of strong presidential leadership in the regulatory process, we need to have a richer sense of the dimensions of presidential leadership in regulatory decisionmaking. The set of proposals put forward by the National Performance Review (NPR), a task force established by the Clinton administration last year, provides a useful focal point for the examination of this issue. In Part I, the author considers how the trend toward President-led initiatives fits with our growing skepticism about the capacities of legislators and bureaucrats to improve regulation and administration. In Part II, the author traces some of the conceptual underpinnings of the President\u27s expanding regulatory role. The author adds to this mostly theoretical discussion the particulars of the NPR Report in Part III. Ultimately, the Clinton administration\u27s opening salvo into the thicket of regulatory reform is of a piece with contemporary trends in presidential politics and regulatory administration
Canonical Construction and Statutory Revisionism: The Strange Case of the Appropriations Canon
In this article, we consider the impact of positive political theory on legislative interpretation and, in particular, the debate over interpretive canons. Our vehicle for this consideration is the appropriations canon. By virtue of this canon, courts construe narrowly legislative changes to statutes made through the appropriations process. We consider the underlying logic and rationale of this canon -- essentially, that the appropriations process is unrepresentative and insufficiently deliberative -- and use this analysis to investigate, more broadly, the processes of canonical construction in the modern statutory interpretation jurisprudence. Canonical construction, we argue, must be attentive to the equilibrium effects of judicial approaches and, moreover, it must be based upon a normatively compelling theory of lawmaking and the legislative process. The appropriations canon fails both of these tests; and, in its structure, it reveals some of the weaknesses of the contemporary reliance on canons to illuminate statutory meaning
What is New in the New Statutory Interpretation? Introduction to The Journal of Contemporary Legal Issues Symposium
Detta examensarbete är utfört på WSP i Skellefteå på uppdrag av Rönnskärverket i Skelleftehamn. Rönnskärverkets började byggas av Boliden AB 1928 och var färdigt för produktion år 1930. Man producerar koppar, bly, zinkklinker, guld och silver. År 2010 producerade Rönnskär 190 000 ton koppar och år 2013 producerades 206 000 ton. Här jobbar 866 medarbetare i dagsläget. Elförbrukningen för verksamheterna inom NEW Bolidens uppgår till ca 1,2 TWh/år. Rönnskärs industriområdes elförsörjning är mycket högprioriterad och transformatorhaverier leder till långa stilleståndstider och dyra reparationer. Krafttransformatorerna måste ha hög drifttillgänglighet och transformatorerna som inhandlas till produktionsanläggningarna måste vara robusta. Syftet med detta examensarbete är att göra en jämförande studie mellan torrisolerade och oljeisolerade transformatorer som resulterar i en rekommendation med tanke på framtida inköp. Arbetet ska belysa parametrar för drifttillgänglighet och driftsäkerhet, göra beräkningar för korslutningsströmmar och förluster på transformatorer utifrån transformatortillverkarens uppgifter. Examensarbetets mål är att jämföra olika parametrar på torr- och oljeisolerade transformatorer från olika tillverkare som resulterar i en jämförelsetabell beroende på skenbar effekt och spänning, visar skillnaden mellan olika typer av transformatorer. I arbetet finns en litteraturstudie främst inom transformatorteori som underlag parallellt med en löpande dialog med uppdragsgivaren och transformatortillverkaren. Rekommendationerna ska ses som en förstudie. En djupare analys och ytterligare utredning krävs vid inköp av transformatorer, beroende på omständigheterna och driftsvillkoren. En ekonomisk analys har inte utförts på grund av den begränsade informationen. In 2010 Rönnskär produced 190000 tons of copper and in 2013 it produced 206 000 tons. Current number of employees is 866. The electricity supply of the industrial area of Rönnskär is in very high priority and transformer failures leading to lengthy downtime and expensive repairs. Power transformers must have high operational availability transformers which purchases for production must be robust. This is a comparative study between dry type and oil insulated transformers which summarized in form of recommendation for the future purchases. The work will highlight the parameters of operational availability and operational safety make calculations for rated short time currents and losses in transformers based on manufacturers data. The aim of this thesis is to compare various parameters of dry and oil immersed transformers from different manufacturers summarized in a comparison table according to the apparent power and voltage which shows the difference between various types of transformers. This work is primarily based on the theory of transformers and at the same time on continuous dialogue with the client and the transformer manufacturer. The recommendations should be viewed as a preliminary study, a deeper analysis and further investigation is required when purchasing transformers, depending on the circumstances and the conditions. Deorbitalization strategies for meta-GGA exchange-correlation functionals
We explore the simplification of widely used meta-generalized-gradient
approximation (mGGA) exchange-correlation functionals to the Laplacian level of
refinement by use of approximate kinetic energy density functionals (KEDFs).
Such deorbitalization is motivated by the prospect of reducing computational
cost while recovering a strictly Kohn-Sham local potential framework (rather
than the usual generalized Kohn-Sham treatment of mGGAs). A KEDF that has been
rather successful in solid simulations proves to be inadequate for
deorbitalization but we produce other forms which, with parametrization to
Kohn-Sham results (not experimental data) on a small training set, yield rather
good results on standard molecular test sets when used to deorbitalize the
meta-GGA made very simple, TPSS, and SCAN functionals. We also study the
difference between high-fidelity and best-performing deorbitalizations and
discuss possible implications for use in ab initio molecular dynamics
simulations of complicated condensed phase systems

Over the past decade, as obesity has continued to rise among both youth and adults, interest has grown in developing policies to promote community environments that support healthy lifestyles.1 A broad range of local, regional, state, and federal policies under the rubrics of active living, smart growth, and sustainable development share the underlying assumption that they can help people make healthier choices. From a transportation planning perspective, the benefits of pedestrian and bicycle plans resulting from the building of infrastructure to support pedestrian and bicycle travel include improved health (for example, through increased levels of physical activity and reduced obesity), a better environment (for example, through lower carbon emissions), and a stronger economy (for example, through lower fuel bills).
