    Rational divisors in rational divisor classes

    We discuss the situation where a curve C, defined over a number field K, has a known K-rational divisor class of degree 1, and consider whether this class contains an actual K-rational divisor. When C has points everywhere locally, the local to global principle of the Brauer group gives the existence of such a divisor. In this situation, we give an alternative, more down to earth, approach, which indicates how to compute this divisor in certain situations. We also discuss examples where C does not have points everywhere locally, and where no such K-rational divisor is contained in the K-rational divisor class

    Victim Protection or Revictimization: Should College Disciplinary Boards Handle Sexual Assault Claims?

    Colleges and universities that receive federal funding are legally required to respond to all sexual assault complaints on their campuses. Numerous laws and guidance documents address the specific obligations of higher education institutions in their responses to complaints; however, many colleges and universities have failed to meet these obligations. This Note examines the requirements colleges and universities must comply with when responding to sexual assault complaints. It then highlights three high-profile mishandlings of sexual assault cases by colleges and universities and analyzes the benefits and drawbacks of allowing campus disciplinary committees to independently respond to sexual assaults. This Note then suggests that law enforcement should be integrated into the campus response procedures, specifies particular procedural changes that are necessary in campus disciplinary proceedings, and suggests alternative penalties to ensure institution compliance. Finally, this Note addresses proposed legislation aimed at improving the response of institutions to sexual assault on college and university campuses

    On September 27, 2013, the U.S. Court of Appeals for the Fifth Circuit, sitting en banc, held in favor of Kerry Woods, a heterosexual male construction worker who claimed sex discrimination based on gender stereotyping by Chuck Wolfe, his heterosexual male supervisor. In EEOC v. Boh Bros. Construction Co., the majority based its analysis on Wolfe’s subjective view of Woods’ non-conformance with gender stereotyping in holding there was discrimination. The use of a subjective test ensures that victims of severe or pervasive sex discrimination have a remedy even if they visibly conform to gender stereotypes. Additionally, the majority correctly protected all employees who experience severe or pervasive sex discrimination irrespective of their environments by concluding that the inherently vulgar context of the construction site did not automatically invalidate the claim. The dissenting judges’ emphasis on using an objective standard when analyzing claims of sex discrimination based on gender stereotyping would improperly deny victims of severe or pervasive harassment a remedy simply because they appear to comply with the judges’ opinions of gender norms

    Our biodynamic winery is located near Lake Constance in Switzerland. Since 1989, we have cultivated resistant grape varieties such as Maréchal Foch, Léon Millot, Muscat Bleu, Cabernet Jura, Chancellor and Monarch (red), and Seyval Blanc, Bianca, Solaris, Phoenix and Excelsior (white). As a rule, we avoid applying even organic pesticides, and use solely biodynamic compounds (4 applications/year). The elimination of practically all plant-protection products has enabled us to establish a highly biodiverse organic agro-ecosystem with reduced impact on the environment. In addition, over a 20-year period, this system has resulted in the application of 270 kg less copper over our 4.5-ha surface area, as well as the saving of 18 t of fuel, which can be remarked as the “non-emission” of 47 t of carbon dioxide. In Switzerland, whose vineyards have a combined surface area of 15’000 ha, the potential annual savings in pesticides and fuel, to the benefit of nature, environment and climate, can be estimated at 225’000kg (225 t) pesticides and 1.5 Mio l (1500 t) fuel respectively, equating to the “non-emission” of 3.9 Mio kg (3900 t) of carbon dioxide

    Depuis quelques années, de nombreux articles traitent de l’importance croissante des langues et des compétences linguistiques dans le monde du travail à tous les niveaux hiérarchiques et au-delà du secteur tertiaire. En conséquence, la littérature scientifique sur le plurilinguisme au travail s’est multipliée au cours des dernières années. Le présent texte se base sur une revue de littérature plus complète (disponible en allemand à l’adresse http://www.zentrum-mehrsprachigkeit.ch), qui met l’accent sur les études en sociolinguistique menées en Europe depuis la fin du XXe siècle, tout en accordant de l’attention à de nombreuses publications provenant de disciplines et de continents différents. En plus de la littérature abondante en anglais, les publications rédigées en français, en allemand et en italien ont également été prises en compte. La présente synthèse résume très brièvement les principales tendances et résultats de la recherche en la matière.The past several years have witnessed a growing number of scholarly publications that highlight the increasing importance of language and language skills at the workplace, regardless of an individual’s hierarchical position in a company and even in jobs outside the service industry. The present executive summary is based on an extensive literature review, published in German (available at www.zentrum- mehrsprachigkeit.ch), which focuses on sociolinguistic research in Europe from the end of the 20th century onward, although studies from other continents and disciplines were also considered. In addition to the high volume of literature available in English, articles in French, German, and Italian are incorporated in the review. The executive summary at hand presents an overview of the major research trends and insights.Die wachsende Bedeutung von Sprache und Sprachkompetenzen in der Arbeitswelt, auf allen Hierarchiestufen und über den Tertiärsektor hinaus, wird seit einigen Jahren in zahlreichen Artikeln zum Thema hervorgehoben. Wir stützen uns hier auf eine umfassendere, auf Deutsch publizierte Literaturübersicht (abrufbar unter www.zentrum-mehrsprachigkeit.ch/), die den Schwerpunkt auf soziolinguistische Studien aus Europa seit dem ausgehenden 20. Jahrhundert legt, wobei auch etliche Werke aus anderen Kontinenten und Disziplinen Beachtung finden. Nebst der umfangreichen Literatur in englischer Sprache wurde auch diejenige in französischer, deutscher und italienischer Sprache berücksichtigt. Die vorliegende Übersicht fasst die wichtigsten Forschungstendenzen und Erkenntnisse in aller Kürze zusammenDa qualche anno, l’importanza crescente delle lingue e delle competenze linguistiche nel mondo del lavoro, a tutti i livelli gerarchici e anche al di fuori del settore terziario, viene messa in evidenza in numerosi articoli.
