    Infinite Regress: Virginia School Neoliberalism and the Tax Revolt

    This article examines the fortunes of American government in light of the work of James M. Buchanan, the Virginia school political economist whose thinking on constitutional revolution played a formative, if largely unrecognized, role in shaping the tax revolt. By looking backwards, to an earlier wave of constitutional tax and spending limits enacted in the American South during the Redemption era, and forwards, to the increasingly regressive nature of local government revenue generation in the wake of the tax revolt, this article shows that Virginia school neoliberalism is less an argument against taxation than an argument in favor of regressive forms of taxation that are rarely acknowledged as such—user fees, fines, and flat-rate levies. The city of Ferguson, Missouri, which has become infamous for its exorbitant use of municipal ordinance violations and court fees to fund local services, is examined as a real-world experiment in Virginia school public finance

    ‘This long and shining finger of the sea itself’: Sydney Harbour and regional cosmopolitanism in Eleanor Dark’s Waterway

    This essay examines the complex negotiation of nationalism and internationalism in Eleanor Dark’s novel Waterway (1938). It suggests that Dark’s position, which involves both an interest in the broader world and a commitment to regional space, is best understood as a form of ‘regional cosmopolitanism’. Dark brings the conflicting impulses of interwar Sydney to bear upon the contested site of Sydney Harbour, registering the allure of international modernity, interrogating aspects of cultural nationalism, and pointing to the discriminatory power relations that constitute colonial modernity. The located position of Dark’s writing from within regional space makes her work particularly attuned to the uneven structures of modernity; however, her writing is also shaped by these structures, particularly in the way it contributes to settler-colonial projects. This essay raises questions as to the best framework by which to interpret Dark’s negotiation of the local, national and international, and illuminates one of the ways in which an Australian writer negotiated the contradictory impulses of the interwar period

    Self-Help: Extrajudicial Rights, Privileges and Remedies in Contemporary American Society

    This Special Project examines the myriad forms of self-help currently available to persons in American society. It groups and discusses notable self-help rights, privileges, and remedies under topical classifications that parallel traditional jurisprudential categories. Parts H through VI of the Special Project sketch the legally fashioned contours and explore the legal, social, and political consequences of self-help methods in tort law, criminal law and law enforcement, commercial transactions, landlord-tenant relations,and family law matters. Part VII explores the attorney\u27s role in the development and implementation of curative self-help procedures such as mediation. Special Project concludes by examining the function, mechanisms, and merits of two increasingly popular alternative dispute resolution processes--rent-a-judge programs and the ombudsman--that offer hope for continued peaceable dispute resolution

    Legal Rights and Issues Surrounding Conception, Pregnancy, and Birth

    Advances in medicine are reported almost daily in the media. Medical researchers have developed and are continuing to develop new methods of creating, saving, and prolonging life. This Special Project examines the impact that rapidly advancing medical technology has on the law governing conception, pregnancy, and birth. Although medical techniques have advanced rapidly during the past decades, state and federal legislatures have responded in-adequately to the legal consequences of these new birth technologies. The resulting lag between technology and the law has forced courts to confront new situations that do not fit neatly into the statutory framework created to deal with past fact situations. For example, courts have applied statutes prohibiting child bartering to surrogate parenting cases and statutes prohibiting fetal experimentation to artificial insemination cases although it is clear that the legislators never considered such fact patterns when passing the statutes. A lag is inevitable because the law can only respond to, rather than predict, emerging medical developments. Nonetheless, legislators must respond promptly by confronting the new legal issues that result from new medical technologies. One impediment to prompt legislative response to the lag between medical technology and the law is the controversial nature of the legal problems posed. Abortion continues to be an extremely controversial issue thirteen years after the Supreme Court legalized it in the landmark decision Roe v. Wade. The Baby Doe issue of whether to force hospitals and parents of severely deformed newborns to provide medical care is another extremely controversial issue. Baby Doe has become highly politicized as the Reagan administration, Congress, right-to-life groups, disability groups, medical professionals, and other groups have taken stances. Surrogate parenting also has produced controversial situations. In one incident, a New York couple contracted with a California surrogate mother. When the surrogate mother breached the agreement, the couple brought suit. The court discovered that the couple consisted of a man and a transsexual, thus raising the issue of whether transsexuals or homosexuals should be allowed to adopt children by contracting with surrogate mothers

    Ramipril inhibits AGE-RAGE-induced matrix metalloproteinase-2 activation in experimental diabetic nephropathy

    Background: Advanced glycation end products (AGE)-receptor for AGE (RAGE) axis and renin-angiotensin system (RAS) play a role in diabetic nephropathy (DN). Matrix metalloproteinase-2 (MMP-2) activation also contributes to DN. However, the pathological interaction among AGE-RAGE, RAS and MMP-2 in DN remains unknown. We examined here the involvement of AGE and RAS in MMP-2 activation in streptozotocin (STZ)-induced diabetic rats and in AGE-exposed rat renal proximal tubular cells (RPTCs).Methods. Experimental diabetes was induced in 6-week-old male Sprague-Dawley (SD) rats by intravenous injection of STZ. Diabetic rats received ramipril (3 mg/kg body weight/day) or vehicle for 32 weeks. AGE-modified rat serum albumin (AGE-RSA) or RSA was intraperitoneally administrated to 6-week-old male SD rats for 16 weeks. RPTCs were stimulated with 100 μg/ml AGE-modified bovine serum albumin (AGE-BSA) or BSA in the presence or absence of 10 M ramiprilat, an inhibitor of angiotensin-converting enzyme or 100 nM BAY11-7082, an IκB- phosphorylation inhibitor.Results: AGE and RAGE expression levels and MMP-2 activity in the tubules of diabetic rats was significantly increased in association with increased albuminuria, all of which were blocked by ramipril. AGE infusion induced tubular MMP-2 activation and RAGE gene expression in SD rats. Ramiprilat or BAY11-7082 inhibited the AGE-induced MMP-2 activation or reactive oxygen species generation in RPTCs. Angiotensin II increased MMP-2 gene expression in RPTCs, which was blocked by BAY11-7082.Conclusions: Our present study suggests the involvement of AGE-RAGE-induced, RAS-mediated MMP-2 activation in experimental DN. Blockade of AGE-RAGE axis by ramipril may protect against DN partly via suppression of MMP-2

    IFN-γ receptor and STAT1 signaling in B cells are central to spontaneous germinal center formation and autoimmunity.

    Spontaneously developed germinal centers (GCs [Spt-GCs]) harbor autoreactive B cells that generate somatically mutated and class-switched pathogenic autoantibodies (auto-Abs) to promote autoimmunity. However, the mechanisms that regulate Spt-GC development are not clear. In this study, we report that B cell-intrinsic IFN-γ receptor (IFN-γR) and STAT1 signaling are required for Spt-GC and follicular T helper cell (Tfh cell) development. We further demonstrate that IFN-γR and STAT1 signaling control Spt-GC and Tfh cell formation by driving T-bet expression and IFN-γ production by B cells. Global or B cell-specific IFN-γR deficiency in autoimmune B6.Sle1b mice leads to significantly reduced Spt-GC and Tfh cell responses, resulting in diminished antinuclear Ab reactivity and IgG2c and IgG2b auto-Ab titers compared with B6.Sle1b mice. Additionally, we observed that the proliferation and differentiation of DNA-reactive B cells into a GC B cell phenotype require B cell-intrinsic IFN-γR signaling, suggesting that IFN-γR signaling regulates GC B cell tolerance to nuclear self-antigens. The IFN-γR deficiency, however, does not affect GC, Tfh cell, or Ab responses against T cell-dependent foreign antigens, indicating that IFN-γR signaling regulates autoimmune, but not the foreign antigen-driven, GC and Tfh cell responses. Together, our data define a novel B cell-intrinsic IFN-γR signaling pathway specific to Spt-GC development and autoimmunity. This novel pathway can be targeted for future pharmacological intervention to treat systemic lupus erythematosus

    miR-200a Prevents Renal Fibrogenesis Through Repression of TGF-β2 Expression

    OBJECTIVE: Progressive fibrosis in the diabetic kidney is driven and sustained by a diverse range of profibrotic factors. This study examines the critical role of microRNAs (miRNAs) in the regulation of the key fibrotic mediators, TGF-β1 and TGF-β2. RESEARCH DESIGN AND METHODS: Rat proximal-tubular epithelial cells (NRK52E) were treated with TGF-β1 and TGF-β2 for 3 days, and expression of markers of epithelial-to-mesenchymal transition (EMT) and fibrogenesis were assessed by RT-PCR and Western blotting. The expression of miR-141 and miR-200a was also assessed, as was their role as translational repressors of TGF-β signaling. Finally, these pathways were explored in two different mouse models, representing early and advanced diabetic nephropathy. RESULTS: Both TGF-β1 and TGF-β2 induced EMT and fibrogenesis in NRK52E cells. TGF-β1 and TGF-β2 also downregulated expression of miR-200a. The importance of these changes was demonstrated by the finding that ectopic expression miR-200a downregulated smad-3 activity and the expression of matrix proteins and prevented TGF-β-dependent EMT. miR-200a also downregulated the expression of TGF-β2, via direct interaction with the 3' untranslated region of TGF-β2. The renal expression of miR-141 and miR-200a was also reduced in mouse models representing early and advanced kidney disease. CONCLUSIONS: miR-200a and miR-141 significantly impact on the development and progression of TGF-β-dependent EMT and fibrosis in vitro and in vivo. These miRNAs appear to be intricately involved in fibrogenesis, both as downstream mediators of TGF-β signaling and as components of feedback regulation, and as such represent important new targets for the prevention of progressive kidney disease in the context of diabetes
