Perelman's universal audience illustrated by an excerpt from Gide's "Counterfeiters"

Pojęcie uniwersalnego audytorium było często kwestionowane, łącznie z tym, że mówiono o nim jako o wewnętrznie sprzecznym (contradiction dans les termes). Proponujemy zilustrowanie niektórych cech szczególnych tego pojęcia za pomocą ustępu z Fałszerzy (1925). Chodzi o fragment, w którym Bernard i Olivier komentują temat rozprawki. Refleksja odbywać się będzie w trzech etapach : 1) powrócimy do szczególnych cech (specyfiki) pojęcia uniwersalnego uniwersalnego ; 2) wychodząc od tych refleksji, a także od komentarzy Perelmana i Olbrechts-Tyteci (1958) na temat fragmentu z Tristrama Shandy’ego, przebadamy osadzenie rozmaitych typów audytorium w wybranym fragmencie; 3) audytorium będziemy postrzegać jako jedno z pojęć regulatywnych systemu perelmanowskiego. Naszym zdaniem to właśnie te pojęcia regulatywne pozwalają Nouvelle Rhétorique na skuteczne omówienie ćwiczenia, jakim jest rozprawka, podczas gdy ona sama wpisuje się właśnie w ten model dwudziestowiecznego Honnête Homme, przeciw któremu staje system perelmanowski.The notion of universal audience raised many queries to the point that it even appeared as a "contradiction in terms" ("contradiction dans les termes") (Meyer, 1999: 266). We propose to illustrate some of its special features with a passage from the Counterfeiters (1925). This is the fragment in which Bernard and Olivier comment upon the theme of essay. The reflection will include three stages: 1) we will go back to the special characteristics of the notion of universal auditorium; 2) starting with these reflections and commentaries by Perelman and Olbrechts-Tyteca (1958) on a fragment from Tristaam Shandy, we will study the embedding of the various auditorium types in the fragment of choice; 3) we will perceive the auditorium as one of the regulatory concepts (Cassin, 1999: 33) of Perelman’s system. In our view, it is these regulatory concepts that enable the Nouvelle Rhétorique to effectively discuss the exercise in the form of an essay which, in itself, fits within the precise model of the twentieth century’s Honnête Homme opposed by Pereleman’s system.La notion d’auditoire universel a suscité bien des interrogations au point d’apparaître comme une contradiction dans les termes. On se propose d’illustrer certaines particularités de ce concept à travers un extrait des Faux-Monnayeurs (1925). Il s’agit du passage où Bernard et Olivier commentent un sujet de dissertation. La réflexion suivra trois étapes : 1) on reviendra sur les particularités de la notion d’auditoire universel ; 2) à partir de ces réflexions et du commentaire que font Perelman et Olbrechts-Tyteca (1958) d’un passage de Tristam Shandy, on étudiera l’imbrication de différents types d’auditoires dans l’extrait choisi ; 3) l’auditoire sera envisagé comme un des concepts régulateurs du système perelmanien. C’est, d’après nous, ces concepts régulateurs qui permettent à la Nouvelle Rhétorique de traiter efficacement un exercice comme la dissertation alors même qu’elle participe de ce modèle de l’Honnête Homme du XXe siècle contre lequel le système perelmanien s’édifie

Gambling on Court Interpretations of Care: Approving Leave for Travel Under the FMLA

The Family and Medical Leave Act (FMLA) is a federal law passed in 1993 to account for changing demographics in the United States. Its intent is to improve work-life balance for employees while improving the overall productivity of employers. Under 29 U.S.C. § 2612, eligible employees are protected should they decide to request unpaid leave from work for the birth of a child, for adoption or fostering a child, because the employee is seriously ill, or “to care for” an employee’s family member with a serious health condition. Litigation arises in determining what the legislature intended by the phrase “to care for” when an employee requests leave “to care for” a family member. The Department of Labor provides broad regulations relating to the word “care.” Because the regulations are broad in scope, and only provide a few examples of what “care” is, courts have interpreted “care” differently, especially when an employee accompanies a seriously ill family member on a trip unrelated to the family member’s medical care. The Seventh Circuit determined in Ballard v. Chicago Park District that an employee is protected by the FMLA when accompanying a family member on a trip to Las Vegas. Other circuits have decided the issue differently. Given this circuit split, a bright-line rule is necessary. A rule taking into account the factual circumstances and opinions in each circuit would provide guidelines for not only courts, but also for employees and employers to determine whether accompanying a family member on a trip is protected under the FMLA. Consequently, this would decrease employee abuse and reduce litigation. It would also diminish the current inconsistency between FMLA interpretation today and its original intent—not only to improve work-life balance for employees but also to support businesses’ productivity

Evaluation of factors influencing water erosion in West Africa using rainfall simulation

Des travaux de terrain ont été menés dans trois pays (Côte d'Ivoire, Haute Volta, Niger) afin de fournir davantage de donnéees concernant les différents facteurs qui inter viennent sur l'érosion hydrique en Afrique de l'Ouest. Deux types de simulateurs de pluies ont été utilisés. Une grande attention a été portée aux courbes intensité-durée, à l'énergie cinétique des pluies, et à la gamme d'humidités avant les averses. Les traitements ont été choisis en fonction des systèmes culturaux qui prédominent dans les diverses régions d'études. Les résultats sont conformes à ceux obtenus sous pluies naturelles. Ils expriment l'importance des éléments grossiers superficiels quant à la conserrvation des sols. En milieu tropical humide une protection naturelle est assurée par le couvert végétal qui compense ainsi les effets néfastes des pluies très violentes. L'influence des teechniques traditionnelles de lutte antiérosive est liée aux quantités d'eau infiltrée:à partir d'un cer tain seuil, les billons s'écroulent et l'érosion subit alors une vive augmentation. De même l'effet de l'utilisation de résidus de culture comme paillage dépend de la texture du matériel pédologique superficiel. Ainsi, l'utilisation, sans discernement, de l'équation universelle des pertes en terres dont les facteurs sont supposés indépendants peut être très hasardeuse. (RESUME D'AUTEUR

The final chapters of 2 Kings offer various theological interpretations of how and why the exile had to occur. Narratively, the study approaches the pericope and seeks to identify these interpretive models.Das babylonische Exil gilt als eine der schlimmsten Traumaerfahrungen im Kontext von HB/AT, mit der eine Vielzahl von biblischen Texten befasst ist. Der Schluss von 2 Könige bietet verschiedene theologische Deutungen an, wie und warum es zum Exil kommen musste. Erzähltechnisch nähert sich die Studie der Erzählung an und sucht diese Deutungsmodelle zu identifizieren

On November 25, 2022, the Canadian Association for Security and Intelligence Studies (CASIS) Vancouver hosted the fifth panel, Cyber Resilience and International Perspective, of the annual CASIS West Coast Security Conference.
