PEER HARASSMENT UNDER TITLE IX OF THE EDUCATION AMENDMENTS OF 1972: WHERE\u27S THE INTENT
This Note argues that in peer harassment cases, school districts should face liability under a âknown or should have knownâ standard where the schoolâs intent to discriminate may be determined by the circumstances of the case. Part I provides a brief historical overview of Title IX and the traditional forms of hostile environment harassment that it has been used to combat, demonstrating that courts use the statute to punish harassment where the school has reason to know of the harassment and fails to take appropriate action. Part II explores a subset of hostile environment cases where U.S. circuit courts are divided â peer sexual harassment cases, and analyzes the rationale supporting each position. Part III provides guidelines for when courts should extend Title IX protection to peer sexual harassment claims and articulates standards for school liability

Working Paper 09-09 - Alternative assessment of Belgian competitiveness
This paper investigates graphically and econometrically the relationship between the relative positions, in terms of value added and relative prices, of Belgian manufacturing and market services in the European Union over 1970-2005. Relative prices are then decomposed into relative unit costs of factors of production. The analysis goes further by replacing relative unit labour cost with relative hourly wages and relative productivity. Finally, relative produc-tivity is replaced with relative capital deepening, relative labour composition effect and relative total factor productivity. NAFTA and the Mobility of Highly Skilled Workers: The Case of Canadian Nurses
This article examines the impact of trade treaties on health professionals' international mobility. It presents a case study of the impact of labour mobility clauses in trade agreements on the Canadian nursing labour market. It provides statistical evidence on the impact of NAFTA's Chapter 16 on the cross-border movement of Canadian nurses in the 1990s. We observed that an increasingly large number of Canadian nurses went to work in the United States using the NAFTA facilitation mechanism but that this growth could not be attributed to the trade agreement alone; domestic labour market conditions are key to understanding this cross-border movement. The article concludes that trade treaties and international migration of health personnel do not offer simple solutions to health personnel shortages, but can pose a danger to precarious health systems in developing countries.labour mobility, NAFTA, nurses, International Relations/Trade, Labor and Human Capital,

Cognate facilitation effects in bilingual children of varying language dominance
A widely accepted theory is that bilinguals activate both of their languages regardless of which is in use. Though there is abundant research on this phenomenon in bilingual adults, less research has focused on bilingual children. Cognates (i.e., words that share meaning and sound across languages) have frequently been used to explore language co-activation. The present study investigates cognate facilitation effects in child bilinguals of varying language dominance. Spanish-English bilingual children between 6 and 10 years old performed a picture-naming task that included pictures of cognates and non-cognates. Children who were more English-dominant experienced larger cognate facilitation effects when producing words in their non-dominant language but not in their dominant language. In contrast, children with more balanced dominance did not experience cognate facilitation effects in either language. The findings from this study may have implications for the development of the bilingual lexicon.Psycholog

Probing vacuum birefringence using x-ray free electron and optical high-intensity lasers
Vacuum birefringence is one of the most striking predictions of strong field
quantum electrodynamics: Probe photons traversing a strong field region can
indirectly sense the applied "pump" electromagnetic field via quantum
fluctuations of virtual charged particles which couple to both pump and probe
fields. This coupling is sensitive to the field alignment and can effectively
result in two different indices of refraction for the probe photon polarization
modes giving rise to a birefringence phenomenon. In this article we perform a
dedicated theoretical analysis of the proposed discovery experiment of vacuum
birefringence at a x-ray free electron laser/optical high-intensity laser
facility. Describing both pump and probe laser pulses realistically in terms of
their macroscopic electromagnetic fields, we go beyond previous analyses by
accounting for various effects not considered before in this context. Our study
facilitates stringent quantitative predictions and optimizations of the signal

A Review of Recent Developments in the World Sea Cucumber Fisheries
Sea cucumbers (Holothuridae and Stichopodidae) have been harvested commercially for at least 1,000 years. The world fisheries for sea cucumbers, however, are not well documented and in general are poorly managed. Depending upon the species exploited, there are two processing procedures for the sea cucumber product. Some species are eaten raw, while most commercial species are processed into a dry product called beche-de-mer or trepang. This dry product is exported to a central market such as Hong Kong and then re-exported to the consumers. In this review, recent statistics on the world sea cucumber fisheries, collected from different services, are detailed for each major fishing area. Case studies for each fishing area are also presented. Recent major changes in the Indo-Pacific fishery include the participation of new producer countries, the shift in the species being exploited, and an increase in the Chinese market. The expansion of the largely monospecific temperate North Pacific fisheries is also described. Statistics from Hong Kong, Singapore, Taiwan, and the Food and Agriculture Organization provide valuable information on the producer and importer countries. Particular attention is paid to the reciprocal trade of beche-de-mer between Hong Kong and Singapore. An evaluation of the world sea cucumber landings and beche-de-mer production is presented. Recent developments include an expansion of the Hong Kong market due to increased demand by China, the importance of Indonesia as a major world producer, and an increase in the fisheries of Tropical Pacific nations. This increase is best documented for New Caledonia and Fiji. Ways to improve the access and the reliability of the statistics for the sea cucumber fishery are discussed, as is the potential for management of artisanal fisheries
