Law & Leviathan: The Best Defense?
In their recent book Law & Leviathan, Cass Sunstein and Adrian Vermeule unveil a novel and provocative approach to legitimating the modern administrative state. Their starting point is a set of procedural principles that the legal philosopher Lon Fuller described as fundamental premises of the law’s “internal morality.
Six Degrees of Cass Sunstein
Degrees of separation is a concept that is intuitive and appealing in popular culture as well as academic discourse: It tells us something about the connectedness of a particular field. It also reveals paths of influence and access. Paul Erdős was the Kevin Bacon of his field - math - coauthoring with a large number of scholars from many institutions and across subfields. Moreover, his work was highly cited and important. Mathematicians talk about their Erdős number (i.e., numbers of degrees of separation) as a sign of their connection to the hub of mathematics: An Erdős number of 2 means a scholar did not co-author with Erdős but did collaborate with someone who did (i.e., an Erdős 1). In this study, we examine collaboration networks in law, searching for the Legal Erdős. We crown Sunstein as the Legal Erdős and name a complete (as possible) list of Sunstein 1s and 2s

Book review: valuing life: humanizing the regulatory state by Cass Sunstein
In Valuing Life, Cass Sunstein surveys a wide range of practical research and real-life policymaking in his characteristically lucid style, offering a candid and humble account of his administrative tenure in Washington. He performs an invaluable service in revealing how government regulators balance pragmatic concerns of resource scarcity with principled ideals of respect and dignity, writes Mark D. White
‘Nudges’ may be effective at times, but policymakers can’t rely on them to tackle entrenched social problems.
Since the publication of 2008’s Nudge by Richard Thaler and Cass Sunstein, policy ‘nudges’ have been in fashion, with smaller interventions aimed at altering public behaviour in a subtle manner being adopted by many governments, including in the UK. Frank Mols looked at this phenomenon in a recent journal article, and argues here that while nudges undoubtedly can be effective, their limitations must be kept in mind
