    La acción de protección es la garantía mayormente utilizada en el país, su efectividad depende del conocimiento que mantengan respecto de sus elementos fácticos y requisitos de procedibilidad, tanto jueces como profesionales del derecho. El objetivo de esta investigación es diseñar una estrategia educativa que contribuya a la mejora en la utilización de la acción de protección, excluyendo en especial temas de legalidad. La metodología utilizada fue la cualitativa debido a la finalidad de este estudio que es transformar las competencias de abogados litigantes (libre ejercicio), jueces de primer y segundo nivel. Los métodos fundamentales, en el orden teórico fueron el histórico lógico y el analítico sintético y desde lo empírico, el análisis de documentos, el criterio de expertos y las Caras de Chernoff. Los resultados fundamentales fueron que el 67.92% de las acciones de protección analizadas fueron negadas, las cuales de acuerdo a los datos obtenidos incurrieron en causales de improcedencia establecidas especialmente en los numerales 1 y 4 del artículo 42 de la LOGJCC. Respecto a la actuación de las Salas de Corte Provincial de El Oro, se pudo determinar que en el año 2015 el porcentaje de las revocaciones emitidas para conceder el derecho triplicó al porcentaje de las revocaciones para negarlo. Si bien el derecho del trabajo es el que más invocan los ciudadanos, es el que en menor porcentaje 9 fundamenta las acciones de protección concedidas, en las que mayormente se destacan el derecho al debido proceso y los de grupos de atención prioritaria. Se puede concluir que debe contarse en la Provincia de El Oro con una estrategia educativa que contribuya a la mejora en la utilización de la acción de protección para que sea cumpla con eficacia las disposiciones consagradas en la Constitución de la República y Ley Orgánica de Garantías Jurisdiccionales y Control Constitucional

    Robot-assisted surgery in horseshoe kidneys: A safety and feasibility multi-centre case series

    OBJECTIVE: We assessed the safety and feasibility of minimally invasive robot-assisted surgery for horseshoe kidney (HSK). METHOD: A prospectively maintained data set for consecutive patients undergoing robotic kidney surgery was reviewed for patients with HSK. Cases were performed by experienced robotic surgeons, across two high-volume centres between 2016 and 2020. RESULTS: A prospectively maintained data set for consecutive patients undergoing robotic kidney surgery was reviewed for patients with HSK. Cases were performed by experienced robotic surgeons, across two high-volume centres between 2016 and 2020. CONCLUSION: We report one the largest series of robot-assisted surgery on HSK. Robotic surgery is safe and feasible for HSK in centralised high-volume centres with acceptable perioperative outcomes. Established benefits of minimally invasive surgery, such as reduced LOS and low complication rates, were demonstrated. LEVEL OF EVIDENCE: 4

    Justiciabilidad directa de los Derechos Humanos y exigencia de ratificación de Instrumentos Internacionales en el Ecuador

    The general objective of the study was to assess the direct justiciability of Human Rights and the requirement of ratification of International Inst ruments in Ecuador. The relevance is focused on recognizing the criteria of internal validity of these instruments and the duty of the constitutional State to ratify its content. A study with a qualitative approach of documentary type with bibliographic de sign was carried out. The results allowed us to discuss the scope of the direct justiciability of Human Rights, which provides that a lack of legal norms cannot be alleged to justify the violation or ignorance, nor to dismiss the action for those facts. It is concluded that the direct justiciability of Human Rights is an imperative mandate for public servants, and especially for judges, which in any case exempts the process of ratification of International Instruments to prove their validity, based on the p rinciple of prevalence in case of favorability, but also in the absence of a norm that contains it and even when there is an antinomy between the provisions of the fundamental norm and the international norm. This mandate is estimated as a characterizing element of the essence of the model of the Constitutional State accepted.El objetivo general del estudio fue valorar la justiciabilidad directa de los Derechos Humanos y la exigencia de ratificación de los Instrumentos Internacionales en el Ecuador. La relevancia se centra en reconocer los criterios de validez interna de estos instrumentos y el deber del Estado constitucional de ratificar su contenido. Se realizó un estudio con enfoque cualitativo de tipo documental con diseño bibliográfico. Los resultados permitieron discutir el alcance de la justiciabilidad directa de los Derechos Humanos que dispone que no podrá alegarse falta de norma jurídica para justificar la violación o desconocimiento y tampoco para desechar la acción por esos hechos. Se concluye que, la justiciabilidad directa de los Derechos Humanos es un mandato imperativo para los servidores públicos, y en especial para los jueces, que en todo caso exime el proceso de ratificación de los Instrumentos Internacionales para acreditar su validez, con base en el principio de prevalencia en caso de favorabilidad, pero también en ausencia de norma que lo contenga e incluso cuando exista una antinomia entre lo dispuesto en la norma fundamental y la norma internacional. Este mandato se estima como elemento caracterizador de la esencia del modelo de Estado Constitucional acogido

    Utilisation of government-subsidised chronic disease management plans and cardiovascular care in Australian general practices

    BACKGROUND: Government-subsidised general practice management plans (GPMPs) facilitate chronic disease management; however, impact on cardiovascular disease (CVD) is unknown. We aimed to determine utilisation and impact of GPMPs for people with or at elevated risk of CVD. METHODS: Secondary analysis of baseline data from the CONNECT randomised controlled trial linked to Medicare Benefits Schedule (MBS) and Pharmaceutical Benefits Scheme (PBS) claims. Multivariate regression examining the association of GPMP receipt and review with: (1) ≥ 1 MBS-subsidised allied health visit in the previous 24 months; (2) adherence to dual cardioprotective medication (≥ 80% of days covered with a dispensed PBS prescription); and (3) meeting recommended LDL-cholesterol and blood pressure (BP) targets concurrently. RESULTS: Overall, 905 trial participants from 24 primary health care services consented to data linkage. Participants with a GPMP (46.6%, 422/905) were older (69.4 vs 66.0 years), had lower education (32.3% vs 24.7% high school or lower), lower household income (27.5% vs 17.0% in lowest bracket), and more comorbidities, particularly diabetes (42.2% vs 17.6%) compared to those without a GPMP. After adjustment, a GPMP was strongly associated with allied health visits (odds ratio (OR) 14.80, 95% CI: 9.08–24.11) but not higher medication adherence rates (OR 0.82, 95% CI: 0.52–1.29) nor meeting combined LDL and BP targets (OR 1.31, 95% CI: 0.72–2.38). Minor differences in significant covariates were noted in models using GPMP review versus GPMP initiation. CONCLUSIONS: In people with or at elevated risk of CVD, GPMPs are under-utilised overall. They are targeting high-needs populations and facilitate allied health access, but are not associated with improved CVD risk management, which represents an opportunity for enhancing their value in supporting guideline-recommended care.
