Prova e Verdade: Antagonismo ou Dificuldade?

A propósito da dualidade entre prova e verdade, interessa saber se a busca da verdade, a susceptibilidade de alcançar a veracidade dos factos é possível. Deste modo, para além da repartição do ónus da prova, da valoração probatória, interessa atentar nas metodologias disponíveis. Designadamente o juízo de verosimilhança, as máximas de experiência, enquanto mecanismo ligado a juízos hipotéticos, os graus de prova ou os standards probatórios, correspondentes a níveis de probabilidade. Aliás, quanto aos standards, eles podem ser rígidos ou flexíveis e assumirem uma orientação quantitativa de probabilidades que permita um nível de convencimento probatório. Por outro lado, o mecanicismo dos métodos probabilísticos tem gerado críticas e a preferência pelo explicacionismo ou plausibilidade relativa

A atribuição de uma causa de nulidade matrimonial a um juiz único

Com a reforma matrimonial levada a cabo pelo Papa Francisco, por meio da qual se introduziu algumas novidades concernentes a atribuição de uma causa de nulidade matrimonial à um juiz único (c. 1673 § 4), algumas dioceses moçambicanas – que ao longo de muito tempo não podiam conhecer causas de nulidade matrimonial essencialmente por escassez de pessoal formado em Direito Canónico – optaram por essa fórmula. Neste artículo apresenta-se o procedimento seguido pelo Bispado da Beira, a mais recente diocese moçambicana a constituir um tribunal unipessoal à luz do c. 1673, depois de ter permanecido mais de 40 anos sem poder administrar a justiça aos fiéis de maneira efetiva. Pretende-se, a partir deste exemplo concreto, demonstrar como tal normativa pode ser aplicada numa Igreja particular e quais serão suas implicações para o futuro da atividade dos tribunais eclesiásticos

The article seeks to reflect on animal themes. On the one hand, about the civil legal status emerging from the reform of the Portuguese Civil Code and the resulting implications, in terms of a legal nature or dogmatic qualification. On the oher hand, about the review process of the Brazilian Civil Code, as well as the most appropriate strategies, with the aim of disconnecting the animal from material stuff, in addition, safeguarding the right of animals. O artigo procura reflectir acerca da temática animal. Por um lado, acerca do estatuto jurídico-civil emergente da reforma do Código Civil português e as implicações daí resultantes, em sede de natureza jurídica ou qualificação dogmática. Por outro lado, sobre o processo de revisão do Código Civil brasileiro, bem como as estratégias mais adequadas, no intuito de desligar o animal da coisa corpórea, e, além disso, acautelar os direitos dos animais

Probing the Structure of Liquids with 129Xe NMR Spectroscopy: n-Alkanes, Cycloalkanes, and Branched Alkanes

The liquid organization of linear, branched, and cyclic alkanes was studied using atomic 129Xe as a NMR probe. 129Xe chemical shifts have been experimentally determined for xenon dissolved in a total of 21 alkanes. In order to allow the comparison of the different solvents at similar thermodynamic conditions, the measurements were performed over a wide range of temperatures, from the melting point of the solvent up to 350 K. The results were rationalized in terms of the density, nature, and organization of the chemical groups within xenon’s coordination sphere. Additionally, molecular dynamics simulations were performed using established atomistic force fields to interpret and clarify the conclusions suggested by the experimental results. The analysis is able to interpret previous results in the literature for ethane and propane at very different experimental conditions

Utilização da técnica de bloqueios contínuos do sistema nervoso periférico/ central no Brasil nos últimos cinco anos

This study aimed to analyze the use of the technique of continuous blocks of the peripheral/central nervous system in Brazil over the last five years. This is a descriptive and retrospective study. The study data were extracted from DATASUS through the Hospital Information System (SIH), from 2018 to 2022. The results demonstrate that regarding the number of hospital admission authorizations (AIH) in 2019 there were more AIH in the North, Northeast, South and Central-West regions and a drop in authorizations, especially in the years 2020 and 2021, however the Southeast region presented more AIH among the years surveyed. As for the average value of hospital admission authorizations (VMAIH), the Southeast region has the highest values. Regarding days of stay (DP), the Southeast had longer hospitalization times. Regarding death and mortality rate (MT), the data showed that the year 2021 had a higher mortality rate in the Southeast Region, however, in 2019 the Central-West had a higher rate. It is concluded that the Southeast region presented higher numbers in the categories studied, a reflection of socioeconomic inequality and greater availability of beds and specialized hospitals in the region.Este estudo objetivou analisar a utilização da técnica de bloqueios contínuos do sistema nervoso periférico/ central no brasil nos últimos cinco anos. Trata-se de um estudo descritivo e retrospectivo. Os dados do estudo foram extraídos a partir do DATASUS por meio do Sistema de Informações Hospitalares (SIH), no período de 2018 a 2022. Os resultados demonstram que referente ao número de autorizações de internação hospitalar (AIH) no ano de 2019 houve mais AIH nas regiões Norte, Nordeste, Sul e Centro-Oeste e uma queda de autorizações, sobretudo, nos anos de 2020 e 2021, todavia a região Sudeste apresentou mais AIH entre os anos pesquisados. Quanto ao valor médio de autorizações de internação hospitalar (VMAIH), a região Sudeste é a que apresenta maiores valores. Referente aos dias de permanência (DP), o Sudeste teve mais tempo de internação. Já com relação ao óbito e taxa de mortalidade (TM) os dados demonstraram que o ano de 2021 teve maior taxa de mortalidade na Região Sudeste, entretanto, no ano de 2019 o Centro-Oeste apresentou com taxa ampla. Conclui-se que a região Sudeste apresentou maiores números nas categorias estudadas, reflexo da desigualdade socioeconômica e disponibilidade maior de leitos e hospitais especializados na região

On the Behavior of Solutions of Xenon in Liquid n-Alkanes: Solubility of Xenon in n-Pentane and n-Hexane

The solubility of xenon in liquid n-pentane and n-hexane has been studied experimentally, theoretically, and by computer simulation. Measurements of the solubility are reported for xenon + n-pentane as a function of temperature from 254 to 305 K. The uncertainty in the experimental data is less than 0.15%. The thermodynamic functions of solvation such as the standard Gibbs energy, enthalpy, and entropy of solvation have been calculated from Henry’s law coefficients for xenon + n-pentane solutions and also for xenon + n-hexane, which were reported in previous work. The results provide a further example of the similarity between the xenon + n-alkane interaction and the n-alkane + n-alkane interactions. Using the SAFT-VR approach we were able to quantitatively predict the experimental solubility for xenon in n-pentane and semiquantitatively that of xenon in n-hexane using simple Lorentz−Berthelot combining rules to describe the unlikely interaction. Henry’s constants at infinite dilution for xenon + n-pentane and xenon + n-hexane were also calculated by Monte Carlo simulation using a united atom force field to describe the n-alkane and the Widom test particle insertion method

EJA EM OURO PRETO: A RELAÇÃO ESTADO E CURRÍCULO NA EDUCAÇÃO DE JOVENS E ADULTOS - ENSINO MÉDIO

O presente trabalho é parte da dissertação de mestrado Educação de Jovens e Adultos em Ouro Preto: O currículo nas práticas educacionais do Ensino Médio na EJA. Ilustra o tema currículo da EJA no Ensino Médio e como os professores da rede estadual de ensino concebem o currículo proposto pelo Estado, bem como os mesmos desenvolvem sua prática com base nessas propostas. Tem como referencial teórico principal Apple (2006), Arroyo (2011), Oliveira (2012) entre outros. Fazendo uso de entrevistas semiestruturadas evidenciamos que esses professores não concebem o currículo proposto como um aliado para o trabalho com a EJA e todos concordam que as proposições curriculares para a Educação de Jovens e Adultos feitas pelo Estado estão distantes da realidade dos alunos dessa modalidade de ensino.

On the Behaviour of Solutions of Xenon in Liquid Cycloalkanes: Solubility of Xenon in Cyclopentane

The solubility of xenon in liquid cyclopentane has been studied experimentally and theoretically. Measurements of the solubility of xenon in liquid cyclopentane are reported as a function of temperature from 254.60Kto 313.66 K. The imprecision of the experimental data is less than 0.3%. The thermodynamic functions of solvation of xenon in cyclopentane, such as the standard Gibbs energy, enthalpy, entropy and heat capacity of solvation, have been calculated from the temperature dependence of Henry’s law coefficients. The results provide further information about the differences between the xenon + cycloalkanes and the xenon + n-alkane interactions. In particular, interaction enthalpies between xenon and CH2 groups in nalkanes and cycloalkanes have been estimated and compared. Using a version of the soft-SAFT approach developed to model cyclic molecules, we were able to reproduce the experimental solubility for xenon in cyclopentane using simple Lorentz-Berthelot rules to describe the unlike interaction

Nematode-Mycobiota interactions in Pine Wilt Disease

Pine wilt disease is one of the most important diseases for conifer forests worldwide. This complex disease involves the interaction between three primary biological elements - the plant parasitic nematode Bursaphelenchus xylophilus; the insect-vector Monochamus sp., and the host tree Pinus spp. – and other secondary elements such as endophytic bacteria and fungi. The development of B. xylophilus is strongly associated with fungi that colonize the declining trees, with special impact in their reproduction and number of individuals carried by the vector. In light of previous knowledge, we are focused in obtaining a detailed characterization of the structure and dynamics of the nematode-fungi interactions through culturable and non-culturable approaches with particular emphasis in metagenomics analysis. Our aim is to understand if nematode-associated mycobiota plays a key-role in the development of the disease, in interaction with nematode and insect-vector, and into which extend it can be used to disrupt the disease cycle
