    Biocultural Community Protocols: Dialogues on the Space Within

    This paper starts by explaining "the space within" -- the ethical grammar and code by which indigenous peoples use and steward nature. It then explains the inextricable links with nature demonstrated by a number of communities with which we have worked, and their experiences in the ABS context. It discusses the importance of processes of prior informed consent, before then discussing the possibility of "tools of conviviality" that may act as bridges between the fundamental ecological principals of indigenous peoples, and the researchers and companies that seek to utilize biodiversity and knowledge within community control.In the final sections, we explore the use of both community protocols and Ethical BioTrade, with some examples, and their potential role as tools of conviviality -- opening up dialogues between actors from vastly different worldviews. While we do not see community protocols as a panacea for the rights of indigenous peoples and local communities, we have seen them act as an important step towards the protection of indigenous knowledge and the recognition of legal pluralism

    Stewarding the earth : rethinking property and the emergence of biocultural rights.

    Includes abstract.Includes bibliographical references.The thesis analyses the emergence of biocultural rights as a sub‐set of third generation, group rights in environmental law. It submits that these rights, which advocate a people's duty of stewardship over Nature, have arisen as a response to the world's ecological crisis. Indeed, the growing discourse about biocultural rights has begun a radical reconfiguration of the dominant notions property and the juridical subject. The thesis uses a multipronged approach, relying upon economic, anthropological, political and legal theories, to deconstruct the current concepts of private property from the perspective of indigenous peoples and traditional communities. It further presents evidence that this discursive shift is gaining formal legal recognition by referring to negotiations of multilateral environmental agreements, judicial decisions of regional and domestic courts and community initiatives. The thesis concludes with a description of the new biocultural jurisprudence including its application through innovative, community‐developed instruments such as biocultural community protocols

    A critical perspective on the concept of biocultural diversity and its emerging role in nature and heritage conservation

    The continuing losses of biodiversity around the world remain problematic for nature conservation. A fundamental issue that has triggered debates in nature conservation is the relationship between human culture, heritage and history, and nature expressed as ecology or biodiversity. Traditionally, nature conservation has been pursued separately from aspects of cultural heritage; a situation which seems perplexing when we consider the importance of traditional management in the maintenance of biodiversity in many areas now “protected” for nature. To address these broad issues, fundamental to future landscape sustainability, we need to have clear definitions of concepts and terms. This paper considers the historical development of the key concepts that frame biocultural diversity and the paradigms relating to biocultural assets or eco-cultural landscapes. This is pertinent to both researchers and to practitioners or policymakers, and we suggest ways biocultural diversity can improve global conservation efforts

    Evolving trends in the management of acute appendicitis during COVID-19 waves. The ACIE appy II study

    Background: In 2020, ACIE Appy study showed that COVID-19 pandemic heavily affected the management of patients with acute appendicitis (AA) worldwide, with an increased rate of non-operative management (NOM) strategies and a trend toward open surgery due to concern of virus transmission by laparoscopy and controversial recommendations on this issue. The aim of this study was to survey again the same group of surgeons to assess if any difference in management attitudes of AA had occurred in the later stages of the outbreak. Methods: From August 15 to September 30, 2021, an online questionnaire was sent to all 709 participants of the ACIE Appy study. The questionnaire included questions on personal protective equipment (PPE), local policies and screening for SARS-CoV-2 infection, NOM, surgical approach and disease presentations in 2021. The results were compared with the results from the previous study. Results: A total of 476 answers were collected (response rate 67.1%). Screening policies were significatively improved with most patients screened regardless of symptoms (89.5% vs. 37.4%) with PCR and antigenic test as the preferred test (74.1% vs. 26.3%). More patients tested positive before surgery and commercial systems were the preferred ones to filter smoke plumes during laparoscopy. Laparoscopic appendicectomy was the first option in the treatment of AA, with a declined use of NOM. Conclusion: Management of AA has improved in the last waves of pandemic. Increased evidence regarding SARS-COV-2 infection along with a timely healthcare systems response has been translated into tailored attitudes and a better care for patients with AA worldwide

    The article makes a case for understanding religion as a communitarian discourse and a terrain for social criticism. It challenges the liberal defense of a universal rights discourse as socially alienating, ahistorical and strategically limiting. The argument relies on communitarian critiques of Rawlsian liberalism by foregrounding Michael Walzer’s views on socialcritique. Building on the Rawls/Walzer debate the article develops a new communitarian lens to view the Prophet Mohammed as an engaged social critic and prophecy as essentially a communitarian method of social change
