Anthropology and law: dialogue for otherness
To become self-reflexive, Jurisprudence must to establish a dialogue: the human sciences should lose their exotic character in the eyes of Legal Science. It is in the middle between the "order" and the thinking about it, where the "naked experience" happens, that culture and therefore Law builds itself e it is constructed. This paper demonstrates the need to use other human sciences, with emphasis on anthropology, as "methodological strategies" for Jurisprudence self-reflection to become more faithful to the reality of the researched object. Anthropology has the power to show what is "anti-modern". It questions the intellectual space of modernity where the hard definition of antagonisms detached from reality occurs - West/East, “I”/other, civilized/barbarian. Jurisprudence consolidates antagonisms: the diversity and plurality of human societies are rarely seen as a fact but as an aberration, always demanding a justification. It is necessary to create a methodology using what is most extraordinary and human in the analysis of fact: "Anthopological Blues". Anthropology is capable of breaking with the classical conception of scientific methodology that is based on stiffness to produce absolute truths and also support the fulfillment of legal concepts with content and meaning, providing a reinterpretation of science as a human instrument of intervention on reality
Azores tourism product perceptions : the Influence of the country of origin
This study focused on the Autonomous Region of the Azores (ARA), which has some features that are considered favorable to the development of tourism and to the interest in the tourism product. However, the region’s geographical dispersion, its high dependence on transportation and the seasonality of the industry constrain its development.
The present research aimed to assess tourists’ perception of certain costs (living, accommodation, plane ticket, and transportation to/from the airport), and whether these differ between tourists of different nationalities.
The findings show that tourists, both residents and non-residents, have the perception that the cost of living and of the plane ticket are high, while the cost of accommodation and of transportation to the airport is considered normal by most respondents.
We concluded that the models differ when applied to residents and non-residents. For non-residents, living in certain countries induces them to express differences in the perception of the costs studied, when compared to individuals that live in other countries.N/
Sudden Trust Collapse in Networked Societies
Trust is a collective, self-fulfilling phenomenon that suggests analogies
with phase transitions. We introduce a stylized model for the build-up and
collapse of trust in networks, which generically displays a first order
transition. The basic assumption of our model is that whereas trust begets
trust, panic also begets panic, in the sense that a small decrease in trust may
be amplified and ultimately lead to a sudden and catastrophic drop of trust. We
show, using both numerical simulations and mean-field analytic arguments, that
there are extended regions of the parameter space where two equilibrium states
coexist: a well-connected network where confidence is high, and a poorly
connected network where confidence is low. In these coexistence regions,
spontaneous jumps from the well-connected state to the poorly connected state
can occur, corresponding to a sudden collapse of trust that is not caused by
any major external catastrophe. In large systems, spontaneous crises are
replaced by history dependence: whether the system is found in one state or in
the other essentially depends on initial conditions. Finally, we document a new
phase, in which agents are connected yet distrustful.Comment: 15 pages, 10 figure
Refuncionalização de patrimônio cultural e a nova racionalidade da organização sócioespacial em núcleos urbanos tombados
Este artigo baseia-se na análise da refuncionalização do patrimônio cultural, no Brasil, à guisa da nova racionalidade do capital hegemônico global que se instala nos núcleos urbanos tombados através de estratégias de intervenção e produção do espaço urbano. Para tanto, resgatamos um referencial teórico a respeito do espaço geográfico, do turismo e do patrimônio cultural, de forma relacionada. Na transformação de seu valor cultural em valor de troca, ou seja, tornando o patrimônio um atrativo para a mercantilização do lugar, verifica-se que a organização sócio-espacial destes núcleos acaba por evidenciar a perversidade da globalização econômica, onde se intensificam o processo de segregação sócio-espacial e a banalização pela cenarização destes núcleos, a tônica crítica deste trabalho
A dialética da construção destrutiva na consagração do patrimônio mundial
Este artigo tem por principal objetivo discutir o que denominamos a “dialética da construção destrutiva” que envolve as cidades históricas consagradas como Patrimônio Mundial ou Patrimônio Cultural da Humanidade, no Brasil. Esta dialética se dá no próprio percurso de consagração do Patrimônio Cultural da Humanidade, quando temos, por um lado, a UNESCO, através da Convenção do Patrimônio Mundial, do Comitê do Patrimônio Mundial e da Lista do Patrimônio Mundial, como um organismo internacional de proteção que luta pela preservação inconteste dos bens culturais e naturais do mundo, e por outro lado, em contraposição, a tendência contemporânea de mercantilização, banalização e destruição dos espaços da história, da memória, da cultura, da natureza e da vida, ou seja, são dois processos que se estabelecem, dialeticamente, no percurso de consagração do patrimônio cultural da humanidade. Nossa crítica se deve ao caráter meramente estético e classista da apropriação dos bens culturais via turismo implantado, descompromissadamente, em algumas cidades históricas vivas brasileiras; na fetichização e cenarização progressiva evidenciadas nos espaços do patrimônio. A cidade histórica, ao ser tomada pela “indústria cultural” por via do turismo, é destituída de sua particularidade no fortalecimento do sentimento de pertencimento ao lugar e na edificação da cidadania. Ante ao frenesi pela Lista do Patrimônio Mundial, urge a implementação da gestão participativa dos bens culturais da humanidade. ________________________________________________________________________________________________ ABSTRACTThis article has as its main objective to discuss that which is called “the dialectics of the destructive construction”, that involves cities consecrated as world heritage or as Humanity’s cultural heritage, in Brazil. These dialectics occur in the process of consecration of the Humanity’s Cultural Heritage itself, as we have, on one hand, the UNESCO, through the World Heritage Convention, the World Heritage Committee and the World Heritage Index, as and international organ of protection that fights for the undisputed preservation of world-wide cultural and natural assets, and on the other hand, the contemporary tendency of mercantilizing, banalizing and destroying historical, memorial, cultural and natural spaces, ergo, two processes that establish themselves, dialectally, in the course of consecration of humanity’s cultural heritage. Our critic is owed to the merely esthetical and classist character of appropriation of the cultural assets, through the uncommitted tourism implemented in several living brazilian historical cities; in the progressive fetishism and scenarism displayed on the heritage’s space. The historical city, by being overtaken by the “cultural industry” through tourism, is depleted of it’s particularity in the strengthening of the feeling of belonging to a place and in the edification of citizenship. Before the frénésie by the World Heritage Index, rises the need of implementing a participative management of humanity’s cultural assets
Geografia urbana aplicada : possibilidades, utopias e metodologia
O discurso geográfico do início do século XXI reafirma o papel da disciplina em desvendar os processos históricos da produção de nossas cidades em seus nexos econômicos, políticos e simbólicos, pois a existência material e imaginária de nossa sociedade está diretamente vinculada às práticas espaciais. Assim, este ensaio aborda possibilidades e utopias do planejamento urbano; discute o papel de uma geografia aplicada ao planejamento para além das formas ou das funções citadinas, mas envolvida com a concretude dos processos que ressignificam as cidades (ou seus setores); apresenta uma metodologia para a leitura do movimento contraditório da reprodução do urbano e dos interstícios do território
Operation in urban centers in period of globalization
Difunde-se, globalmente, que a denominada requalificação urbana deve agregar projetos que devolvam ou proponham qualidade ao ambiente físico e social dos espaços construídos, baseados na compreensão da relação entre processos de produção social do território e sua realidade como lugar da vida e de memória. Diante desse enunciado, o presente ensaio problematiza a relação causal entre os processos de intervenção em áreas especiais de cidades e os produtos dessas operações, em uma perspectiva teórica atrelada a um enfoque objetivo de casos internacionais e nacionais. Os temas da estetização urbana e do planejamento de cidades dirigem-nos para o que tratamos como dialética da memória, entendida como o produto da intervenção parcial em áreas especiais de cidades, no período mais avançado da globalização. _______________________________________________________________________________________ ABSTRACTThere is a globally widespread awareness that the so-called urban re-qualification
must aggregate projects that develop or propose quality to the physical and social
environment of the built spaces, based on the understanding of the relation between social production processes of the territory and its reality as a place of life
and memory. Considering this statement, this article reflects on the causal relation
between the intervention processes in special areas of cities and the products of
those operations, from a theoretical perspective, associated to an objective focus of
international and national cases. The themes of urban esthetics and city planning
direct us to what we will treat as memory dialectics, understood as the product of
partial intervention in cities special areas, in the most advanced period of
globalization
