    Whose Rights? Why States Should Set the Parameters for Federal Honest Services Mail and Wire Fraud Prosecutions

    The citizens and governments of states and localities have a federal statutory right to the honest services of their public officials. The federal statutes that criminalize conduct impinging on this right, however, do not clearly define the parameters of the term honest services, and, as a result, the U.S. Courts of Appeals have differed in their interpretation of what conduct comprises a violation of the statute. The U.S. Courts of Appeals for the Third and Fifth Circuits have held that, in order for there to be a federal crime, the honest services must be owed under state or local law. Meanwhile, the First Circuit has held that such a state or local law violation is not a necessary prerequisite to the federal crime. This Note argues that, due to federalism and the nature of public corruption, the former approach strikes the appropriate balance between state sovereignty and the federal interest in good government

    Epigenome-wide association study of physical activity and physiological parameters in discordant monozygotic twins

    An epigenome-wide association study (EWAS) was performed on buccal cells from monozygotic-twins (MZ) reared together as children, but who live apart as adults. Cohorts of twin pairs were used to investigate associations between neighborhood walkability and objectively measured physical activity (PA) levels. Due to dramatic cellular epigenetic sex differences, male and female MZ twin pairs were analyzed separately to identify differential DNA methylation regions (DMRs). A priori comparisons were made on MZ twin pairs discordant on body mass index (BMI), PA levels, and neighborhood walkability. In addition to direct comparative analysis to identify specific DMRs, a weighted genome coexpression network analysis (WGCNA) was performed to identify DNA methylation sites associated with the physiological traits of interest. The pairs discordant in PA levels had epigenetic alterations that correlated with reduced metabolic parameters (i.e., BMI and waist circumference). The DNA methylation sites are associated with over fifty genes previously found to be specific to vigorous PA, metabolic risk factors, and sex. Combined observations demonstrate that behavioral factors, such as physical activity, appear to promote systemic epigenetic alterations that impact metabolic risk factors. The epigenetic DNA methylation sites and associated genes identified provide insight into PA impacts on metabolic parameters and the etiology of obesity

    Feral swine damage to globally imperiled wetland plant communities in a significant biodiversity hotspot in Florida

    We studied rooting damage during five-years of feral swine control at Avon Park Air Force Range, a significant botanical biodiversity hotspot in peninsular Florida with many globally imperiled plant species and communities. While control reduced swine abundance, remaining animals consistently rooted the 49 studied sites in both middle-dry season (MDS) and late-dry season (LDS) each year. At each study site, we measured rooting with sub-meter accuracy. Neither total nor proportional area rooted differed in either season, across study years, or among plant community types: herbaceous seepage slopes, wet pine savannas, wet grasslands. The proportion of sites with damage during MDS was at least 25 % less than pre-control baseline. During LDS, the proportion of sites with damage increased over years but remained below the initial 2 years’ MDS results. Fresh rooting frequency (rooting \u3c1 \u3eweek-old) across sites dropped precipitously from baseline and remained low for MDS. Fresh rooting frequency among sites during LDS was lower than MDS for all but year two of the study. Canopied habitatwetlands, integrating swine control into other compatible land use practices, and improving swine control efficacy. While we measured damage amounts at each site very accurately, our approach of also considering frequency of rooting and frequency of fresh rooting across sites offers low-labor means to broadly assess swine damage and control efficacy at large geographic scales because in-field measurements of damage amounts are not needed

    Refinement of Biomarker Pentosidine Methodology for use on Aging Birds

    There is no reliable method for determining age for most species of long-lived birds. Recent success using the skin chemical pentosidine as a biomarker has shown promise as an aging tool for birds. Pentosidine levels have been determined only from the breast tissue of carcasses, and we sought to refine the procedure with respect to biopsy size and location for safe and effective use on living birds. We compared pentosidine concentrations in 4 skin-size samples (4, 6, 8, and 20-mm diameter biopsies) from the breast of black vulture (Coragyps atratus) carcasses. We also compared pentosidine levels from breast and patagial tissue to document potential differences among collection sites of deceased vultures (with unknown ages) and monk parakeets (Myiopsitta monachus; with actual, minimal, and unknown ages). Pentosidine concentrations (pmol pentosidine/mg collagen) were similar among the 4 sizes of vulture breast skin (P = 0.82). Pentosidine concentrations for the breast (x̄ = 8.9, SE = 0.55, n = 28) and patagium (x̄ = 8.9, SE = 0.51, n = 28) of vultures were similar, but in parakeets, pentosidine was higher in the breast (x̄ = 15.9, SE = 1.30, n = 105) than the patagium (x̄ = 11.5, SE = 1.10, n = 105). We made pentosidine-based age estimates for vultures and parakeets using a general age curve for wild birds. We also made vulture age estimates using plumage characteristics and a cormorant (Phalacrocorax auritus) age curve. Vulture pentosidine-based age estimates appear to correspond to plumage-based age estimates. Pentosidine-based age estimates for 88% of the known-aged parakeets (n = 17) were within 6 months of actual ages. Even though known ages were not available for all birds, we found a positive trend in pentosidine versus age for both species. We suggest that 6-mm diameter skin samples from the patagium of living vultures and other similar-sized birds will provide sufficient tissue for reliable age estimation and will not impair flight ability

    An Empirical Calibration of the Completeness of the SDSS Quasar Survey

    Spectra of nearly 20000 point-like objects to a Galactic reddening corrected magnitude of i=19.1 have been obtained to test the completeness of the SDSS quasar survey. The spatially-unresolved objects were selected from all regions of color space, sparsely sampled from within a 278 sq. deg. area of sky covered by this study. Only ten quasars were identified that were not targeted as candidates by the SDSS quasar survey (including both color and radio source selection). The inferred density of unresolved quasars on the sky that are missed by the SDSS algorithm is 0.44 per sq. deg, compared to 8.28 per sq. deg. for the selected quasar density, giving a completeness of 94.9(+2.6,-3.8) to the limiting magnitude. Omitting radio selection reduces the color-only selection completeness by about 1%. Of the ten newly identified quasars, three have detected broad absorption line systems, six are significantly redder than other quasars at the same redshift, and four have redshifts between 2.7 and 3.0 (the redshift range where the SDSS colors of quasars intersect the stellar locus). The fraction of quasars missed due to image defects and blends is approximately 4%, but this number varies by a few percent with magnitude. Quasars with extended images comprise about 6% of the SDSS sample, and the completeness of the selection algorithm for extended quasars is approximately 81%, based on the SDSS galaxy survey. The combined end-to-end completeness for the SDSS quasar survey is approximately 89%. The total corrected density of quasars on the sky to i=19.1 is estimated to be 10.2 per sq. deg.Comment: 37 pages, 10 figures, accepted for publication in A

    Fragmentation production of doubly heavy baryons

    Baryons with a single heavy quark are being studied experimentally at present. Baryons with two units of heavy flavor will be abundantly produced not only at future colliders, but also at existing facilities. In this paper we study the production via heavy quark fragmentation of baryons containing two heavy quarks at the Tevatron, the LHC, HERA, and the NLC. The production rate is woefully small at HERA and at the NLC, but significant at pppp and ppˉp\bar{p} machines.     The Sloan Digital Sky Survey: The Cosmic Spectrum and Star-Formation History

    We present a determination of the `Cosmic Optical Spectrum' of the Universe, i.e. the ensemble emission from galaxies, as determined from the red-selected Sloan Digital Sky Survey main galaxy sample and compare with previous results of the blue-selected 2dF Galaxy Redshift Survey. Broadly we find good agreement in both the spectrum and the derived star-formation histories. If we use a power-law star-formation history model where star-formation rate (1+z)β\propto (1+z)^\beta out to z=1, then we find that β\beta of 2 to 3 is still the most likely model and there is no evidence for current surveys missing large amounts of star formation at high redshift. In particular `Fossil Cosmology' of the local universe gives measures of star-formation history which are consistent with direct observations at high redshift. Using the photometry of SDSS we are able to derive the cosmic spectrum in absolute units (i.e.WA˚ W \AA^{-1}Mpc Mpc^{-3})at25A˚resolutionandfindgoodagreementwithpublishedbroadbandluminositydensities.ForaSalpeterIMFthebestfitstellarmass/lightratiois3.77.5) at 2--5\AA resolution and find good agreement with published broad-band luminosity densities. For a Salpeter IMF the best fit stellar mass/light ratio is 3.7--7.5 \Msun/\Lsunintherband(correspondingto in the r-band (corresponding to \omstars h = 0.00250.0055)andfromboththestellaremissionhistoryandtheH--0.0055) and from both the stellar emission history and the H\alphaluminositydensityindependentlywefindacosmologicalstarformationrateof0.030.04h luminosity density independently we find a cosmological star-formation rate of 0.03--0.04 h \Msunyr yr^{-1}Mpc Mpc^{-3}$ today.Comment: 17 pages, 11 figures, ApJ in press (April 10th 2003

    Revisiting a Cutting-Plane Method for Perfect Matchings

    In 2016, Chandrasekaran, V\'egh, and Vempala published a method to solve the minimum-cost perfect matching problem on an arbitrary graph by solving a strictly polynomial number of linear programs. However, their method requires a strong uniqueness condition, which they imposed by using perturbations of the form c(i)=c0(i)+2ic(i)=c_0(i)+2^{-i}. On large graphs (roughly m>100m>100), these perturbations lead to cost values that exceed the precision of floating-point formats used by typical linear programming solvers for numerical calculations. We demonstrate, by a sequence of counterexamples, that perturbations are required for the algorithm to work, motivating our formulation of a general method that arrives at the same solution to the problem as Chandrasekaran et al. but overcomes the limitations described above by solving multiple linear programs without using perturbations. We then give an explicit algorithm that exploits are method, and show that this new algorithm still runs in strongly polynomial time.Comment: 19 page
