    La defensa de los bienes jurídicos por parte del Estado es una máxima en todo Estado social y democrático de Derecho, pero cuando dicha defensa no puede ser llevada a cabo por los agentes encargados de ella, se producen las situaciones que dan pie a la aparición de la legitima defensa y el estado de necesidad.Contenidas en el art. 20. CP (apartados 4.º y 5.º), ambas figuras eximen de responsabilidad criminal al sujeto activo que actúa bajo su amparo, siempre y cuando se cumplan todos los requisitos que ambas eximentes exigen; o conllevan una importante rebaja de la pena si falla alguno de los inesenciales.En la elaboración de este trabajo se ha pretendido hacer un análisis de ambas causas de justificación y, posteriormente, una comparación entre la legitima defensa y el estado de necesidad, así como de los requisitos que ambas precisan para que se pueda acudir a ellas. También se ha querido abordar, en menor medida, los excesos que pueden negar la aparición de la legitima defensa en determinados casos.Por otro lado, me parece interesante el estudio de estas dos figuras poniéndolas en relación con algunos casos recientes, y otros no tanto, que han dejado patente la dificultad de apreciar estas dos eximentes y el debate social que crean entre la población lega en derecho pena

    Influence of emotional intelligence on performance in an emotionally Laden Cognitive Task: an ERP Study.

    A higher level of emotional intelligence (EI), understood as a greater ability to perceive, use, understand, and manage emotions, is associated with an increase in performance on emotionally laden cognitive tasks. The main objective of this research was to study the neural basis underlying the execution of an emotional cognitive control task (GoNogo) as a function of ability EI. Forty-four participants were divided into two groups depending on EI level (High EI vs. Low EI). The participants’ task consisted of an emotional face GoNogo task, in which happy, fear and neutral facial expressions were the go and no go stimulus. Results showed a larger N170 and smaller N2 amplitude for the low EI group than for the high EI one. Greater levels of cognitive control were associated to participants with high EI. Our findings show the importance of studying emotion and cognition interaction to explain our behavior and performance.     Emotional intelligence and hot and cool working memory capacity

    Emotional Intelligence (EI) is the ability to perceive, use, understand and manage our emotions and the emotions of others. EI, measured through performance-based ability models, seems to favour performance on hot tasks. The aim of the present study is to analyse the relationship between EI, measured through its three main models, and performance on a hot (emotional) and cool (non-emotional) working memory task. 203 undergraduate students of psychology took part in the experiment. They completed an EI test for each of its three main models (performance-based ability model, self-report ability model and self-report mixed model) and a hot and cool working memory task. We found a better performance for higher EI participants, measured through the performance-based ability model instrument (but not with self-report instruments), in the hot working memory task. This result was obtained for the managing branch of the EI instrument. Similar evidence was not found when using the cool working memory task. Our study takes a step forward in the conceptualization of the EI construct within the domain of cognitive processes. They show that, at least when using hot stimuli, the managing branch of the performance-based ability model of EI is a better determinant measure for the working memory capacity than the self-report models.Universidad de Málaga.     The mediating role of negative affect on the relationship between emotional intelligence abilities and aggressive behavior levels

    The aim of the present research aimed to study the mechanisms underlying the relationship between aggressive behaviour and individual levels of ability emotional intelligence (EI). We particularly focused on the mediator role of negative affect explaining this relationship. Three hundred and ninety-five participants took part in the study. Participants were assessed on ability EI (by the Mayer-Salovey-Caruso Emotional Intelligence Test), aggression (Buss-Perry Aggression questionnaire), and negative affect (the Positive and Negative Affect Schedule). Path analyses were used to explore which branches of the ability EI are directly related to the four aggression dimensions (physical aggression, verbal aggression, anger and hostility) and indirectly related via negative affect. The results revealed a negative relationship between ability EI and aggression, but this relationship was a function of multiple factors such as the performance level in each of the ability EI branches, the type of aggression studied, the mediator effect of NA, and gender. The emotional managing branch showed a direct effect on aggression, specifically this branch was directly related to physical, verbal, and hostility aggression. Moreover, the emotional perception branch was indirectly related to the four aggression dimensions (physical, verbal, anger, and hostility) through negative affect acting as mediator. The direction of these relationships was always negative, that is, greater ability EI was associated with lower levels of aggression, highlighting the strength of the association with physical aggression. Finally, results also showed interesting gender differences. Women possess greater EI abilities, higher levels of negative affect, less aggressive behaviour, and a lower relationship between negative affect and aggression compared with men.     Are psychopaths emotionally intelligent?

    Psychopathy is a serious personality disorder, characterized by proneness to low anxiety, egocentricity, failure to form close emotional bonds, superficial charm and dishonesty, that has very negative consequences for society as aggression, delinquency and even crime. Therefore, its control and treatment are of great importance. Psychopathy has been related to important emotional deficits as such as a lack of impulse, low empathy and deficits in moral expressions. These findings have led to a growing interest in exploring if psychopathic traits are associated with emotional intelligence (EI) or to the ability to perceive, use, understand, and regulate emotions in one’s self and others. However, the literature exploring this association has revealed conflicting results. The aim of the present study was to provide a reliable estimate of the relationship between psychopathy traits and EI (measured as performance-based ability) through meta-analysis. A quantitative and systematic review of the literature using Scopus, Medline, Pubmed, and PsicINFO and for both Spanish and English studies that included measures of EI and psychopathy, showed a total of 13 studies meeting inclusion criteria with a combined sample of 2401 participants. The meta-analysis revealed a significant negative relationship between both constructs, showing that higher psychopathic trait scores are related to lower EI levels. We propose several future research lines to clarify possible gaps and ambiguities in the current literature and a set of interesting clinical implications for the prevention, evaluation, and treatment of psychopathy by including EI factors in traditional models of psychopathy.Universidad de Málaga.     Aplicación Práctica de Métodos para Evaluar In-Situ el Rendimiento Instantáneo de Máquinas Frigoríficas de Compresión Mecánica

Es frecuente que, en la práctica, estos equipos no estén operando con la eficiencia que debieran. De ahí la importancia de realizar inspecciones periódicas, que incluyan mediciones de los diferentes parámetros de operación de los equipos, destacando por su importancia la medición de su rendimiento (EER/COP). La medición precisa in-situ del EER/COP sobre una instalación frigorífica de compresión mecánica, fuera de un banco de ensayo de laboratorio, ha sido desde siempre una cuestión muy complicada, con muchas dificultades prácticas. Un punto crítico es la medición del caudal de fluido refrigerante. Si no se dispone de un caudalímetro instalado, que es la situación más habitual, hay que recurrir a mediciones indirectas. Hay varios métodos indirectos para estimar el caudal de refrigerante, que se pueden clasificar en los que se basan en: a) el rendimiento volumétrico del compresor, b) el rendimiento global del compresor, c) un balance de energía sobre el condensador y d) un balance de energía sobre el compresor. En este trabajo se ponen en práctica y analizan estos cuatro métodos sobre instalaciones frigoríficas existentes en el laboratorio docente del Departamento de Máquinas y Motores Térmicos de la Universidad de Málaga [1]. Para ello se utiliza un sistema de medición de bajo coste, basado en sensores ONSET [2]. El procesado y análisis de los datos se hace mediante el software Engineering Equation Solver [3]. Se discuten los resultados y dificultades encontradas en la aplicación de los diferentes métodos y se ofrecen recomendaciones a tener en cuenta para abordar instalaciones más complejas.Universidad de Málaga.     Influence of the Surface Viscosity on the Breakup of a Surfactant-Laden Drop

    We examine both theoretically and experimentally the breakup of a pendant drop loaded with an insoluble surfactant. The experiments show that a significant amount of surfactant is trapped in the resulting satellite droplet. This result contradicts previous theoretical predictions, where the effects of surface tension variation were limited to solutocapillarity and Marangoni stresses.We solve numerically the hydrodynamic equations, including not only those effects but also those of surface shear and dilatational viscosities.     A novel analytical solution for the brazilian test with loading arcs

    This research study presents a new theoretical model to calculate the indirect tensile strength for the Brazilian disk with loading arcs, based on numerical simulations, two-dimensional elasticity theory, and Griffith failure criterion. The new expression incorporates a no uniform contact pressure distribution determined by the results of the simulations with the finite element method. A computational experiment design has been developed to test the accuracy of the predictions made with the proposed model. This study demonstrates that the stresses predicted with the new model are closer to those determined by the finite element models than other theoretical solutions available in the literature.     32-week premature rupture of membranes caused by oropharyngeal microbiota

    Introduction. Preterm premature rupture of membranes (PPROM) usually has a multifactorial etiology that is often unknown, although the most frequently reported cause is infection by group B Streptococcus. Therefore, the etiology of PPROM, although probably infectious, remains unknown in most cases. This case describes a PPROM caused by infection from oropharyngeal microbiota. Case presentation. We report the case of a 26-yr-old pregnant woman. The gestational age was 32 weeks+5 days. Examinations in the emergency department revealed the release of clear amniotic fluid and a closed multiparous cervix with a length of 22 mm. Endocervical culture evidenced the growth of Staphylococcus aureus, serogroup B Neisseria meningitidis and Haemophilus influenzae. Conclusion. Preventive antibiotic therapy should consider: opportunistic infections by normal genital microbiota, infections due to sexual activity, opportunist microorganisms derived from oral sex, and the hematogenous spread of oral bacteria.S

    CO2 footprint reduction and efficiency increase using the dynamic rate in overhead power lines connected to wind farms

    Since the first wind farms began operating in the early 1980s, several important factors have changed in the overall picture of energy politics worldwide. The total renewable wind energy capacity of Spain currently accounts for more than 20% of the total installed capacity, which makes integration into the grid challenging for wind farm owners as well as electricity transportation and distribution companies. The smart-grid concept, which focuses on real-time monitoring and dynamic rating operation of power lines, is an important component in the solution to these new challenges. This paper explains how a more efficient operation of energy-generating activities via dynamic rating of the electric grid due to a better knowledge of the main parameters contributes to more clean, renewable energy and decreases the CO2 footprint. The dynamic rating operation of a Spanish overhead power line is analysed, and different scenarios are studied. The dynamic rate achieved in 2015 has saved more than 1100 tonnes of CO2 and has generated over 240,000 € of extra income. This dynamic rating operation also increased the actual annual energy generated from 231.5 GW h to 834.7 GW h with only a 2% greater loss along the line due to Joule and magnetic effects.This work was supported by the Spanish Government under the R+D initiative INNPACTO with reference IPT-2011-1447-920000, the Spanish R+D initiative with reference ENE-2013-42720-R and RETOS RTC-2015-3795-3.
