Novel anatomic description of the course of the perioral artery for minimally invasive treatments

치과대학/박사The facial artery (FA) arises from the external carotid artery, and passes onto the face as it crosses the mandible. And FA mainly supplies the perioral region, which is bounded by the nasolabial fold, the labiomental crease and the nasal base. Thus, in this study, the perioral artery (PA) was determined as distributing to the perioral region including the trunk of FA (from the mandible margin to the ala of nose, PA trunk), the superior labial artery (SLA), the horizontal labiomental artery (HLA) and the inferior labial artery (ILA). Dermal filler injection is a rapid way of eliminating wrinkles, smoothing acne scars, and enhancing volume. However, careless manipulation leading to PA damage during dermal filler injection could result in vascular complications such as lip and alar rim necrosis. The facial reconstruction helps a normal life for patients who have defects from cleft lip, oral cancer, and trauma. For facial reconstruction, various perioral flaps, such as the nasolabial flap, FAmusculomucosal (FAMM) flap and Abbé flaps have been performed. The success of these flap surgeries depends mainly upon the presence of an appropriate blood supply so the PA should be well grafted in the pedicle. However, most reported data about the PA does not provide delicate topographic information for minimal invasive procedure. Thus author performed the study with the following as its objects. The first aims of this study was to elucidate the distribution pattern of PA trunk and reproduce the whole course of PA trunk as a polynomial curve analysed by image processing, and suggest accurate references for various minimally invasive clinical procedures and facial reconstruction. The second aim of this study was to describe the various distribution patterns of the vascularization on the upper and lower lip area. The final aim of the study was to clarify the definition of the ILA and HLA, and to elucidate the significance of the HLA in the vascularization of the lower lip. For the study of reproducing the whole course of PA trunk, 59 adult hemifaces (21 bilateral and 17 unilateral; 26 males, 13 females; 46-95 years; mean age, 73 years) from 19 Korean and 20 Thai cadavers were used. For the study of the vascularization on the upper lip area, 60 hemifaces (24 bilateral and 12 unilateral; 24 males, 12 females; 46-95 years; mean age, 73 years) from 18 Korean and 18 Thai cadavers were used. For the study of the vascularization on the lower lip area, 63 hemifaces (26 bilateral and 11 unilateral; 24 males, 13 females; 46-95 years; mean age, 73 years) from 18 Korean and 19 Thai cadavers were used. The running course of the PA trunk along the PO line (a line connecting the mandible margin to the ala of nose) exhibited two patterns: oblique (78.0%, 46/59) or vertical (22.0%, 13/59). In the oblique pattern, the PA trunk proceeded along the PO line with two or three inflections, while in the vertical pattern it ran along the PO line but then turned medially near the mouth corner, giving off an alar branch parallel to the facial sagittal midline. The course of the PA trunk on the face can be predicted based on the following references: the PO line, the Rh point (the ramification point of the HLA, 5～10 mm medial to the PO line at the level of the middle of the lower lip portion), the Ra point (the ramification point of the alar branch (Ra point), 5～10 mm medial to the PO line at the level of lower one-third of the upper lip portion). While the PA trunk generally ran along the PO line, the PA trunk reflected medially at the Ra and Rh points. The branching point of SLA from FA, the S point, was located within a 1.5 cm sided square superolateral to the mouth corner. The S point may be estimated by placing a thumbnail beside the mouth corner. After the SLA branched from FA, it ran superior to the vermilion border under the orbicularis oris muscle, with a minimum depth of 3 mm. At the sagittal midline, the nasal septal branch ramified from the SLA and ran upward to the nasal septum along the sagittal midline. The HLA can be presented in the middle of the lower lip area inferior to the mouth corner, and be inclined gradually to the lower lip border near the facial midline (46.0%). ILA diverged from the FA or SLA at the level of the mouth corner. The HLA rather than ILA could be considered as the main artery supplying the lower lip mucosa.ope

업무상 창작에 대한 지적재산권의 귀속에 관한 연구 : 업무상저작물과 직무발명 제도 간 비교를 중심으로

학위논문 (박사)-- 서울대학교 대학원 법과대학 법학과, 2017. 8. 박준석.이 글에서의 업무상 창작이라 함은 저작권법상 업무상저작물 또는 특허법과 발명진흥법의 직무발명과 같이, 고용관계 등에 의하여 사용자의 업무에 종사하는 종업원이 그 직무상 실질적인 창작 행위를 하고, 사용자는 이러한 창작 과정에 필요한 설비와 원재료 또는 창작 활동에 협력할 전문 인력이나 기술 등을 지원하는 것과 같은 물질적,인적,기술적 자원 등을 투입하는 비창작적 기여를 한 경우를 말한다. 이처럼 과학기술의 발전과 문화 산업의 활성화로, 발명과 저작물 중에서 직무발명과 업무상저작물이 차지하는 비중이 상당히 높으며 앞으로도 계속 증가하게 될 상황에서, 업무상 창작에 대한 규율을 어떻게 할 것인가라는 논의의 중요성이 점점 커지고 있다. 업무상저작물에 관한 현행 저작권법에 따르면, 사용자의 업무에 종사하는 자가 업무상 창작한 저작물 중 사용자의 기획과 사용자 명의의 공표가 있는 경우, 당사자 간에 별도의 계약이 없는 한 사용자를 저작자로 보아 사용자에게 저작재산권과 저작인격권이 모두 원시적으로 귀속된다. 반면 종업원은 저작재산권, 저작인격권, 보상청구권 등 아무런 권리도 가지지 못한다. 그에 반해 직무발명에 대해 규율하고 있는 특허법 및 발명진흥법에 따르면, 종업원이 그 직무상 창작한 발명에 대한 특허받을권리는 종업원에게 원시적으로 귀속되도록 하고, 사용자에의 승계가 확정된 경우 종업원은 보상청구권을 가진다. 이렇듯 업무상 창작에 대한 지적재산권의 원시적 귀속에 대해, 종업원주의를 취하는 직무발명과는 상반되게 업무상저작물에 대해서는 사용자주의를 취하고 있고, 그 밖에 보상청구권이나 통상실시권 인정 여부 등 이해관계 조정 장치 등에서도 상이하게 규정하고 있다. 이로 인해 동일한 대상에 대한 법적 규율이 달라져 지적재산권간 충돌을 발생시키고 형평에 반하는 결과가 일어날 수 있다는 문제점이 제기된다. 예를 들어 발명과 저작물로서의 성질을 동시에 가지는 컴퓨터프로그램을, 발명진흥법의 적용을 받는 직무발명으로 보는 경우 종업원이 그 특허받을권리를 원시적으로 취득하게 되며, 이를 사용자에 승계하는 경우 종업원은 정당한 보상을 받을 수 있다. 반면 저작권법의 업무상저작물로 보는 경우에는 사용자가 저작재산권 및 저작인격권 일체를 원시적으로 취득하면서 종업원에게는 보상을 할 의무도 없어, 종업원은 아무런 권리도 가지지 못한다. 업무상저작물 규정은 1946년 제정 특허법에 직무발명에 관한 규정이 입법되고 난 후인 1986년 저작권법 개정으로 명문화되었음에도, 의도적으로 법의 형평을 취하지 않았던 이유를 유추해 보았다. 그 결과 저작권은 등록을 요하지 않고 창작과 동시에 권리가 발생하기에, 외부의 이용자가 볼 때 누가 창작자인지를 판단하기 용이한 제도가 바람직하다는 점, 또한 저작권법에는 특허법에 비해 훨씬 강력한 저작인격권이 존재한다는 점 등을 짐작해볼 수 있었다. 그러나 이러한 차이점들만으로는 업무상저작물과 직무발명에 대한 규율에 있어, 권리의 원시적 귀속 주체 등 사용자와 종업원 간 구체적인 이해관계 조정 수단에 관하여, 현행과 같은 정도의 상당한 차이를 둘 문제는 아니라고 본다. 오히려 다르게 규정함으로 인하여 또 다른 문제점을 야기하고 혼란만 가중시킬 뿐이다. 이에 권리의 원시적 귀속 주체 등 업무상 창작 제도의 전체적인 큰 틀에 대해서는 일원적으로 구성하되, 각 지적재산권의 특징을 반영할 필요가 있는 부분에 대해서는 관련 규정을 보완하거나 일부 수정하는 방향으로 제도를 구성하는 것이 필요하다. 그 밖에도 현행 업무상저작물 제도에 대해서는 사용자의 기획 및 사용자 명의의 공표 요건의 불합리성 문제, 저작인격권까지 사용자에게 귀속되는 문제, 창작자의 보상청구권이 인정되지 않는 문제 등이 있고, 직무발명 제도에 대해서는 특허받을권리의 이중양도로 인한 사용자에의 승계 귀속이 불안정하다는 문제 등이 대표적으로 제기된다. 업무상저작물과 직무발명에 대해 제기되는 각각의 문제점을 보완하고 장점은 살릴 수 있는 업무상 창작 제도에 대한 기본적인 구조를 일원적으로 살펴보자면, 우선 업무상 창작의 정의와 성립 요건을 사용자의 업무에 종사하는 자가 그 업무상 창작하는 지적 산물로 단순화하고, 종업원에게 창작물에 대한 창작자 지위를 인정하면서 지적재산권을 종업원에게 원시적으로 귀속시키도록 해야 한다. 이와 함께 사전양도계약의 유효성을 명문화함과 동시에, 사용자가 지적재산권을 보다 간편하고 안정적으로 승계 받을 수 있도록 사용자의 승계 통지 등 별도의 승계 절차를 요구하지 않고, 업무상 창작에 대한 지적재산권이 발생할 때 자동적으로 그 권리가 사용자에게 승계 귀속되도록 해야 한다. 한편 일정 기간 내에 사용자가 지적재산권의 포기의사를 알린 때에는 그 승계는 무효로 한다. 그런데 승계시점을 앞당기는 것만으로는 업무상 창작에 대한 지적재산권의 이중양도 문제를 완전히 해소하여 사용자에의 권리의 승계 귀속의 안정성을 기하기는 어렵다. 이에 독일의 종업원발명법 제7조 제2항의 상대적 처분금지 조항을 참고하여, 사전양도계약의 구속을 받는 종업원이, 사용자가 지적재산권의 포기의사를 알리기 전에, 당해 업무상 창작에 대한 지적재산권을 임의로 처분하는 경우, 사용자에 대해서는 그 처분을 무효로 하는 규정을 신설하는 것이 필요하다. 예를 들어 직무발명의 경우 설사 선의의 제3자가 사용자보다 먼저 출원했다고 하더라도, 사용자가 온당히 그 특허권을 되찾을 수 있도록 하고자 함이다. 또한 사용자가 업무상 창작에 대한 지적재산권을 승계하지 않겠다는 포기의사를 통지하는 등의 이유로 종업원 또는 제3자가 업무상 창작에 대한 지적재산권을 취득하기로 확정된 경우, 사전양도계약의 체결 여부를 불문하고, 사용자에게 업무상저작물의 경우에는 비배타적이용권을, 직무발명의 경우에는 통상실시권을 무상으로 인정할 필요가 있다. 그리고 사용자에의 지적재산권 승계 귀속이 확정되고, 그 창작물을 활용한 수익 사업을 통하여 투자비용과 임금 등을 상회하는 현저한 이익이 발생하는 경우, 종업원의 보상청구권을 인정하는 것이 타당하다. 한편 업무상저작물의 경우에는 종업원의 저작인격권 행사를 일부 제한할 수 있음을 명문화하거나 그에 대한 특약의 유효성을 인정하여, 사용자가 저작물을 이용한 사업을 안정적으로 영위할 수 있도록 하여야 한다. 이렇게 업무상 창작에 공통되는 기본적인 구조를 토대로 업무상저작물과 직무발명에 대해 각각에 제시된 구체적인 개정안들은 현행 제도의 문제점을 해결하는 한편, 현행 제도에 비하여 종업원과 사용자는 물론 이용자 그리고 법리적인 측면까지 모두에 이익이 될 수 있을 것이다. 이러한 개선방안을 통하여 종업원의 창작 동기를 저해하지 않음과 동시에, 지적 창작물의 특성상 종업원이 창작을 완성했는지 여부에 대한 정보를 얻기 힘든 사용자도 보호하여, 업무상 창작에 대한 사용자의 적극적인 투자를 유도할 수 있을 것이며, 아울러 국가의 Basal Cell Carcinoma of the Scalp with Lung, Bone and Lymph Node Metastasis in a Korean Woman

Metastatic basal cell carcinoma (MBCC) is very rare with incidences estimated to range from 0.0028% to 0.5% in the Caucasian population. The incidence of basal cell carcinoma is known to be much lower in Asian populations including Koreans. We present a rare case of metastatic BCC in a Korean woman who showed lymph node, lung and bone metastasis, with a review of the MBCC cases reported in the Korean literature.ope

Transabdominal embryofetoscopy in 6 cases of first trimester prenatal diagnosis for congenital anomalies

Objective: To demonstrate the efficacy of first trimester embryofetoscopy for prenatal diagnosis of congenital anomalies in continuing pregnancies. Methods: Under ultrasound guidance, six patients at 12+6-14+6 weeks of gestation underwent endoscopic procedures. Indications included history of 2 recurrent major genetic syndromes, history of cleft lip/palate in 2 cases, each one of the patient itself and the previous fetus and each family history of syndactyly and polydactyly. A 1 mm semirigid fiberoptic endoscope with a 18 gauge examination sheath and a single-chip digital camera were used for transabdominal embryofetoscopy. Results: Excellent visualization of the external fetal anatomy was obtained in 83% of cases (5/6) with the duration of procedures ranging 15 to 40 minutes. A diagnosis of Meckel-Gruber syndrome was made at 13+1 weeks of gestation by visualizing postaxial polydactyly and an occipital encephalocele. Subsequently the pregnancy was terminated. Three full-term infants were delivered with no gross limb or facial abnormalities. Amniotic fluid leakage after the procedure occurred in 2 cases resulting in termination of pregnancy. Conclusion: Our experiences confirm the efficacy of embryofetoscopy for early diagnosis in the first trimester of pregnancy. Procedure-related risks are to be established by multicenter studies.ope

PTEN Methylation Dependent Sinonasal Mucosal Melanoma

Sinonasal mucosal melanoma (SMM) is an aggressive and rare type of melanoma. Although the classic RAS-RAF-MEK pathway is thought to be the main pathway involved in melanoma pathogenesis, genetic alterations in the phosphatidylinositol 3-kinase-AKT pathway, including PTEN-regulated signaling, are also thought to contribute. So far, data regarding altered PTEN expression and epigenetic mechanism of PTEN silencing in development of SMM is extremely limited. Herein we report on a case of SMM with liver and bone metastases with an epigenetic alteration of PTEN. Results of mutation analysis for BRAF, NRAS, HRAS, KRAS, PIK3CA, c-Kit, and PTEN were negative; however, methylation of PTEN CpG islands was observed. Our case not only supports PTEN as a major tumor suppressor involved in melanoma tumorigenesis, but also a potential epigenetic mechanism of PTEN silencing in development of SMM.ope

Ultrasound-Guided Injection of the Adductor Longus and Pectineus in a Cadaver Model

BACKGROUND: The close anatomic and functional relationship between the proximal parts of the adductor longus and pectineus muscles produce considerable overlap in symptoms and signs in the inguinal region. To our knowledge, there have been no publications of ultrasound (US)-guided injection techniques into the 2 muscles. OBJECTIVE: This study sought to describe US-guided injection techniques in the proximal part of the adductor longus and pectineus muscles and to validate whether these techniques deliver injections appropriately to their target muscles in unembalmed cadavers. STUDY DESIGN: Cadaveric study. METHODS: A preliminary trial with 2 unembalmed cadavers provided information on the target sonographic structures of proximal adductor longus and pectineus muscles. Bilateral US-guided intramuscular injections in the proximal adductor longus and pectineus were performed using the remaining 5 unembalmed male cadavers. To avoid confusion of dye location, we did not inject into both the adductor longus and pectineus muscle in the same side. After injections, each specimen was dissected to evaluate the accuracy of injection. RESULTS: Ten injections (5 for the adductor longus muscle and 5 for the pectineus muscle) were performed targeting the proximal parts of muscles in 5 cadaveric specimens. All injections were successful and blue dye was injected accurately at the target area within the adductor longus and the pectineus muscles. No other muscles were injected unintentionally. There were no accidental penetrations and/or injuries at adjacent neurovascular structures as well. LIMITATION: Despite successful injection of the proximal parts of adductor longus and pectineus, this study did not verify the usefulness of this technique in clinical practice. CONCLUSIONS: The results of this study may play a role in the diagnosis and management of patients presenting with chronic pelvic pain syndrome and sports hernia.ope
