    Reason Against the Machine: Future Directions for Mass Online Deliberation

    Designers of online deliberative platforms aim to counter the degrading quality of online debates. Support technologies such as machine learning and natural language processing open avenues for widening the circle of people involved in deliberation, moving from small groups to "crowd" scale. Numerous design features of large-scale online discussion systems allow larger numbers of people to discuss shared problems, enhance critical thinking, and formulate solutions. We review the transdisciplinary literature on the design of digital mass deliberation platforms and examine the commonly featured design aspects (e.g., argumentation support, automated facilitation, and gamification) that attempt to facilitate scaling up. We find that the literature is largely focused on developing technical fixes for scaling up deliberation, but may neglect the more nuanced requirements of high quality deliberation. Current design research is carried out with a small, atypical segment of the world's population, and much research is still needed on how to facilitate and accommodate different genders or cultures in deliberation, how to deal with the implications of pre-existing social inequalities, how to build motivation and self-efficacy in certain groups, and how to deal with differences in cognitive abilities and cultural or linguistic differences. Few studies bridge disciplines between deliberative theory, design and engineering. As a result, scaling up deliberation will likely advance in separate systemic siloes.     A co-original approach towards law-making in the internet age

    There is an increasing interest in incorporating significant citizen participation into the law-making process by developing the use of the internet in the public sphere. However, no well-accepted e-participation model has prevailed. This article points out that, to be successful, we need critical reflection of legal theory and we also need further institutional construction based on the theoretical reflection. Contemporary dominant legal theories demonstrate too strong an internal legal point of view to empower the informal, social normative development on the internet. Regardless of whether we see the law as a body of rules or principles, the social aspect is always part of people’s background and attracts little attention. In this article, it is advocated that the procedural legal paradigm advanced by JĂŒrgen Habermas represents an important breakthrough in this regard. Further, Habermas’s co-originality thesis reveals a neglected internal relationship between public autonomy and private autonomy. I believe the co-originality theory provides the essential basis on which a connecting infrastructure between the legal and the social could be developed. In terms of the development of the internet to include the public sphere, co-originality can also help us direct the emphasis on the formation of public opinion away from the national legislative level towards the local level; that is, the network of governance.1 This article is divided into two sections. The focus of Part One is to reconstruct the co-originality thesis (section 2, 3). This paper uses the application of discourse in the adjudication theory of Habermas as an example. It argues that Habermas would be more coherent, in terms of his insistence on real communication in his discourse theory, if he allowed his judges to initiate improved interaction with the society. This change is essential if the internal connection between public autonomy and private autonomy in the sense of court adjudication is to be truly enabled. In order to demonstrate such improved co-original relationships, the empowering character of the state-made law is instrumental in initiating the mobilization of legal intermediaries, both individual and institutional. A mutually enhanced relationship is thus formed; between the formal, official organization and its governance counterpart aided by its associated ‘local’ public sphere. Referring to Susan Sturm, the Harris v Forklift Systems Inc. (1930) decision of the Supreme Court of the United States in the field of sexual harassment is used as an example. Using only one institutional example to illustrate how the co-originality thesis can be improved is not sufficient to rebuild the thesis but this is as much as can be achieved in this article. In Part Two, the paper examines, still at the institutional level, how Sturm develops an overlooked sense of impartiality, especially in the derivation of social norms; i.e. multi-partiality instead of neutral detachment (section 4). These two ideas should be combined as the criterion for impartiality to evaluate the legitimacy of the joint decision-making processes of both the formal official organization and ‘local’ public sphere. Sturm’s emphasis on the deployment of intermediaries, both institutional and individual, can also enlighten the discourse theory. Intermediaries are essential for connecting the disassociated social networks, especially when a breakdown of communication occurs due to a lack of data, information, knowledge, or disparity of value orientation, all of which can affect social networks. If intermediaries are used, further communication will not be blocked as a result of the lack of critical data, information, knowledge or misunderstandings due to disparity of value orientation or other causes. The institutional impact of the newly constructed co-originality thesis is also discussed in Part Two. Landwehr’s work on institutional design and assessment for deliberative interaction is first discussed. This article concludes with an indication of how the ‘local’ public sphere, through e-rulemaking or online dispute resolution, for example, can be constructed in light of the discussion of this article

    Deliberative Public Engagement with Science: An Empirical Investigation

    The purpose of this book is to share some results and the data from four studies in which we used experimental procedures to manipulate key features of deliberative public engagement to study the impacts in the context of deliberations about nanotechnology. In this chapter, we discuss the purpose of this book, which is to advance science of public engagement, and the overarching question motivating our research: What public engagement methods work for what purposes and why? We also briefly review existing prior work related to our overarching goal and question and introduce the contents of the rest of the book. Given the potential for negative—or at least controversial—effects of new technologies upon the societies in which various publics must live, what could be more democratic than promoting public involvement in decisions about those new technologies? Unless, of course, it turns out that public involvement, which can sometimes be costly, is ineffective, unnecessary, or actually makes things worse. Some have suggested this may be the case (e.g., Sunstein, 2000, 2002), but, for better or worse, public engagement with and about new technologies is happening all around us.     How Deliberation Happens: Enabling Deliberative Reason

    We show, against skeptics, that however latent it may be in everyday life, the ability to reason effectively about politics can readily be activated when conditions are right. We justify a definition of deliberative reason, then develop and apply a Deliberative Reason Index (DRI) to analysis of 19 deliberative forums. DRI increases over the course of deliberation in the vast majority of cases, but the extent of this increase depends upon enabling conditions. Group building that activates deliberative norms makes the biggest difference, particularly in enabling participants to cope with complexity. Without group building, complexity becomes more difficult to surmount, and planned direct impact on policy decisions may actually impede reasoning where complexity is high. Our findings have implications beyond forum design for the staging of political discourse in the wider public sphere

    Exploring planners’ facilitation styles in public participation : an inductive analysis

    This thesis addresses the underexplored area of facilitation within public participation processes, particularly focusing on the strategic communication of the planners working as facilitators. Through inductive analysis with the help of grounded theory, this study developed a content analysis approach. It employs a set of analytical categories —functional element, turn, and episode —to track and make sense of both verbal and non-verbal actions of facilitators from a functional perspective. The research conducted a case study, reviewing the facilitation practice in public consultation of a large regional planning project in the United States. The results provided thick descriptions of facilitation styles and revealed various communicative characteristics in facilitation. This study proposes a preliminary categorization to describe and classify facilitation styles. In this categorization, different styles are categorized as variants with secondary characteristics under two primary types. Richness and complexity are introduced as new metrics to measure facilitators’ strategic communication. This tentative categorization, combined with the analytical categories, can be seen as a step toward a more nuanced classification of facilitation styles

    Democratising biotechnology?: Deliberation, participation and social regulation in a neo-liberal world

    There is now significant policy and academic interest in the governance of science and technology for sustainable development. In recent years this has come to include a growing emphasis on issues of public understanding of science and innovative processes of deliberative and inclusive policy-making around controversial technologies such as nuclear power and agricultural biotechnology. Concern with such issues coincides with rising levels of interest in deliberative democracy and its relationship to the structures and processes of global governance. This article connects these two areas through a critical examination of ‘global’ deliberations about agricultural biotechnology and its risks and benefits. It draws on an extensive survey concerned with the diverse ways in which a range of governments are interpreting and implementing their commitments under the Cartagena Protocol on Biosafety regarding public participation and consultation in order to assess the potential to create forms of deliberation through these means. The article explores both the limitations of public deliberation within global governance institutions as well as of projects whose aim is to impose participation from above through international law by advocating model approaches and policy ‘tool kits’ that are insensitive to vast differences between countries in terms of capacity, resources and political culture
