Constitutional Bait and Switch: Executive Reinterpretation of Arms Control Treaties
A new constitutional crisis has been thrust upon the American body politic. The crisis arises from a dispute concerning the allocation of legal authority for the interpretation, and especially for the reinterpretation, of international agreements. Messaging and the Political Symbolism of the Face Mask
Political ideology develops through the process of socialization. Political ideology influences public attitudes toward a variety of issues. A perplexing question relates to the development of the face mask as a divisive political symbol. The messaging of President Donald J. Trump is examined to analyze the potential influence of messaging on public use of face masks. Findings indicate mask usage among Americans in 2020 varied by party identification. Those who identified as Republican were less likely to wear a face mask than non-Republicans. The findings indicate political ideology should be considered when developing messaging about public health recommendations
Injury-in-Fact, Justice-in-Fiction: Toward a More Realistic Definition of Injury in the Context of Unenforced Criminal Laws
This article argues that the prosecution or the credible threat of prosecution standard endorsed by the Supreme Court of the United States to analyze standing in challenges to criminal laws is too narrow. Part I seeks to counter the notion of unenforced criminal laws as dead words and harmless empty shadows by reviewing recent research from multiple disciplines, including psychology, sociology, and economics, which shows that unenforced laws have as strong an effect on individuals and society as prosecution or the threat of prosecution. Part II traces the history and rationale of the notion of standing and the requirement of injury and examines recent standing cases, arguing that there is room in Article III standing for a wider definition of injury caused by criminal laws
The U.S. M-Business Market: Fad or the future
M-Business is information available on any device, anywhere and at anytime, offering businesses in any industry the potential to expand markets, improve their services and reduce costs. The U.S. m-business market is still in its infancy and is a few years away from becoming a growth market. This is due to a few reasons, which are the lack of standards for connectivity and service, no real applications to support the market and the lack of strong encryption to support m-business and e-commerce. M-business is not a fad but a potential new channel for business operations. This thesis will address the issues of why the U.S. m-business is slow to mature and what is required for the U.S. m-business to become a growth market
