    Quantifying the impact of technical barriers to trade : a framework for analysis

    There has been increasing use of technical regulations as instruments of commercial policy in the context of multilateral, regional, and global trade. These nontariff barriers are of special concern to developing countries, which may bear additional costs in meeting mandatory standards. Many industrial and developing countries express frustration with regulations that vary across their export markets, require duplicative conformity procedures, and are continually revised to exclude imports. The authors provide a comprehensive overview of the policy debate and methodological issues surrounding product standards and technical barriers to trade. They begin with a review of the policy context driving demand for empirical analysis of standards in trade, then provide an analytical overview of the role of standards and their relationship to trade. They then review methodological approaches that have been used to analyze standards and theirimpact on trade. Their main interest lies in advancing techniques that are practical and may be fruitfully extended to the empirical analysis of regulations and trade. They discuss concrete steps that could be taken to move forward a practical, policy-relevant program of empirical research.     Chapter The languages of wine: negotiating intercultural exchanges through translation

    This paper discusses the cultural and linguistic mediation strategies involved in the compilation of a terminological tool aimed at facilitating the intercultural exchanges between Italy and China in the field of oenology, by taking the Dictionary of Italian wines and grape varieties (Italian - Chinese) (Bosc et al. 2019) as a case study. The main objectives of the dictionary compilation were the popularization of specialized wine language, the standardization of the names of Italian wines and grape varieties, and the translation of the Italian lexicographical definitions in Chinese. For this process to be effective in terms of intercultural communication and mediation, the negotiation of standardization and translation strategies needed to take into account the differences between the two cultures and languages involved as well as the constraints of the lexicographical genre. After delineating the historical background and presenting the purpose of the dictionary from the lexicographical perspective, the paper delves into the choices made in the compilation of the Chinese text

It is too often incapable of producing just outcomes that are proportional to the problems brought to it or reflective of the needs of the people it is meant to serve.     Progressive Era Conceptions of the Corporation and the Failure of the Federal Chartering Movement

    Despite the economic integration of the several states and the broad regulatory authority of the federal government, the internal affairs of business corporations remain primarily governed by state law. The origins of this system are closely tied to the decentralized history of the United States, but the reasons for its continued persistence—in the face of significant federalization pressures—are not obvious. Indeed, federalization of corporate law was a major political goal during the Progressive Era, a period which witnessed significant expansion of federal involvement in the national economy. By examining the historical record of Progressive Era policy debates, this Article bridges the analytical gap between historical and corporate legal scholarship, bringing to light the specific reasons why a federal corporation law was never enacted. Drawing on primary source evidence, the conclusions of this Article are as follows. First, proponents of federal chartering were deeply divided in their attitudes toward corporations, some viewing them as a dangerous threat, others viewing them as central to economic progress. These divisions led to conflicting views on the very purpose of corporate regulation, making agreement on the content of a federal corporation act unlikely. Second, notwithstanding these divisions, many reformers viewed corporations as directly accountable to the public interest. Legislative proposals were therefore framed in terms of benefiting the public, and only secondarily addressed the shareholder interests that dominate corporate law today. Finally, it was the conflicted nature of the political support for federal chartering legislation—not any specific policy preference for maintaining corporate law federalism—that led to the persistence of state-based corporate law. Ultimately, the absence of federal corporate law was a product of historical circumstance, rather than any conscious determination of legal or economic policy

    A study of selected campus groups' ratings of national standards as components of current mission, future mission, and performance of housing and residential life programs in small private colleges

    The purposes of this study were (a) to investigate the extent to which faculty, administrators, trustees, students, and student affairs professionals rated the CAS Standards as important components of the current and future mission of the housing and residential life program in small private colleges, and (b) to examine the degree to which housing and residential life programs at small private colleges complied with the CAS Standards. Faculty members, administrators, student affairs professionals, and junior and senior resident students from five small private colleges in North Carolina were surveyed for the research data. A survey instrument was developed which was used by participants to rate the importance of the CAS Standards to current and future mission of the housing and residential life programs at their campuses. Participants also rated the degree to which their institutions complied with the Standards. T-test analysis of the ratings of each group concerning the Standards' importance to current and future mission revealed significant differences between each group's ratings, with all groups rating the Standards as more important to future mission than to current mission
