Habitat Benefit Assessment and Decisionmaking: A Report to the National Marine Fisheries Service

Habitats and the services they provide are part of our nation’s portfolio of natural capital assets. As for many components of this portfolio, it is difficult to assess the value of their services, and this complicates regulators’ investment decisions, especially when the alternative use is measurable. The principal objective of this report is to suggest possible strategies for the National Marine Fisheries Service (NMFS) as it applies economic analyses and arguments in support of the agency’s trustee responsibilities. Many approaches are possible, and as we discuss, the “right” strategy will depend on the questions asked, the resources available, and the agency’s role in the consultation process. We discuss in detail bioeconomic modeling and ecosystem indicator approaches to habitat value assessment. Although the approaches are discussed independently, multiple tools could be used simultaneously across different regions or within the same region on different aspects of one consultation.Bioeconomic, ecological indicators, ecosystem services

The King's many bodies: the self-deconstruction of law's hierarchy

The article connects two strands of the recent sociolegal debate: (1) the empirical discovery of new forms of spontaneous law in die Course of globalization, and (2) the emergence of deconstructive theories of law that undermine the law's hierarchy. The article puts forward the thesis that law's hierarchy has successfully resisted all old and new attempts at its deconstruction; it breaks, however, under the pressures of globalization that produced a global law without the state, as self-created law of global society that has no institutionalized support whatsoever in international poliucs and public international law. Consequently, the article criticizes deconstructive theories for their lack of autological analysis. These theories do not take into account the historical condicions of deconstruction. Accordingly, deconstructive analysis of law would have to look for new legal distinctions that are plausible under the new condicions of a doubly fragmented global society. Development of methodologies and procedures for identifying STS users and uses

A study was conducted to identify new uses and users of the new Space Transporation System (STS) within the domestic government sector. The study develops a series of analytical techniques and well-defined functions structured as an integrated planning process to assure efficient and meaningful use of the STS. The purpose of the study is to provide NASA with the following functions: (1) to realize efficient and economic use of the STS and other NASA capabilities, (2) to identify new users and uses of the STS, (3) to contribute to organized planning activities for both current and future programs, and (4) to air in analyzing uses of NASA's overall capabilities
