Das Verbot des Missbrauchs einer marktbeherrschenden Stellung gemÀà Art. 102 AEUV im Bereich Rundfunk und Telekommunikation
Das nationale und das europÀische Wettbewerbsrecht zielt generell darauf ab, den
Wettbewerb selbst und seine Teilnehmer zu schĂŒtzen. Dabei stehen insbesondere die Artikel
101 und 102 AEUV im Vordergrund. WĂ€hrend Artikel 101 AEUV kartellrechtswidrige
Absprachen zwischen Unternehmen zum eigenen Vorteil und zum Nachteil anderer
Marktteilnehmer bzw. des Wettbewerbs selbst verbietet, beschÀftigt sich Artikel 102 AEUV
mit verschiedenen missbrÀuchlichen Verhaltensweisen marktbeherrschender Unternehmen,
welche andere Marktteilnehmer in ihren wirtschaftlichen Möglichkeiten einschrÀnken oder
ĂŒberhaupt vom Markt verdrĂ€ngen und somit im Ergebnis fĂŒr alle Marktteilnehmer, auch fĂŒr
die Endkonsumenten, nachteilige Wirkungen haben.
Die Industriesektoren Telekommunikation und Rundfunk sind lange Zeit von staatlichen
Monopolen geprĂ€gt gewesen und aufgrund ihrer verhĂ€ltnismĂ€Ăig spĂ€ten Liberalisierung in
den meisten LĂ€ndern noch nicht durch so intensiven Wettbewerb ausgestaltet wie andere
ehemals monopolistisch organisierte Bereiche. Neben den Vorschriften des allgemeinen
Wettbewerbsrechts sind fĂŒr die beiden genannten Bereiche auch spezielle sektorspezifische
Regelungen zu beachten, welche sich in Sondergesetzen finden. Neben den ex-post
MaĂnahmen, welche das allgemeine Wettbewerbsrecht zur VerfĂŒgung stellt, sind hier im
sektorspezifischen Bereich auch ex-ante MaĂnahmen zur Verhinderung des Missbrauchs einer
marktbeherrschenden Position möglich. Insbesondere ist aufgrund der technischen
KomplexitÀt der beiden Industriegebiete besonders genaue Betrachtung und auch Fachwissen
erforderlich fĂŒr die PrĂŒfung, wann missbrĂ€uchliche Verhaltensweisen tatsĂ€chlich vorliegen
und wie sie zu beurteilen sind.
Diese Arbeit beschÀftigt sich mit der Konkretisierung der Details des Missbrauchsverbots im
Zusammenhang mit den MĂ€rkten Rundfunk und Telekommunikation, beispielsweise der
Abgrenzung der relevanten MĂ€rkte, der Bestimmung der Marktbeherrschung und der
beispielhaften Anwendung von missbrÀuchlichen Verhaltensweisen. Zudem wird die
praktische Relevanz der einzelnen Missbrauchstypen erlÀutert. Ausserdem wird ein Blick auf
die möglichen Sanktionen im Falle eines VerstoĂes geworfen und der Verbraucher, seine
Möglichkeiten und seine Stellung als immer stÀrker beachtetes Schutzziel des
Wettbewerbsrechts beleuchtet.The national and the european competition law is geared towards protecting competition itself
and its participants. The main regulations in this context are articles 101 and 102 AEUV.
Article 101 AEUV deals with agreements between companies, which cause positive economic
effects for the companies themselves, but negative effects for other companies, the
competition on the specific market and also the consumers. The problems, that may arise, are
the same in article 102 AEUV, but the perpetrators are here one or more companies, who have
alone or together a dominant position on the market. This dominant position gives them the
possibility to reduce the competition force of other companies or to even knock them off the
market. Such actions have clearly quite negative on the market and its participants.
The industry segments telecommunication and broadcasting were characterized by the
existence of monopoles for a long time in the past. As the liberalisation happened here quite
late, those segments do not yet show the same intensity of competition as some others already
do. The specialty in this context is, that there are not only the rules of general competition law
to be noticed, but also do special regulations for the two mentioned segments exist. Because
of this structure are not only ex-post sanctions for competition-damaging behaviour possible,
but also ex-ante measures, which are part of the specific segment law. Regarding the technical
complexity of telecommunication and broadcasting and their developments there is also some
specialist know-how necessary for these markets and their competition and will be even more
in the future.
This paper deals with the detailed elements of article 102 AEUV and their concretization, the
distinction of the relevant markets, the details of damaging conduct and dominant positions.
In addition also the different sanctions of article 102 AEUV are studied and so are the
possibilities of the consumer to go for his interests. Another essential point of interest is to
show the practical relevance of the competition rules in telecommunication and broadcasting
in europe

The working report looks at the actual situation of the German broadband cable market in the context of merger control and sector specific regulation. A crucial problem in dealing with the cable market whether in antitrust cases or in the regulatory context is the precise assessment of the economic conditions, especially the arguable question if the network has still characteristics of a natural monopoly still a common argument in network industries. The report therefore uses the basic concept of the disaggregated identification of network-specific market power. The unique structure of the German broadband cable industry with its horizontal and vertical separation of the distribution network shows a highly contestable market with elements of competitive franchise bidding. On the other hand the cable market is suffering from that separation due to problems of inefficiency, especially in times of dynamic changes in communications with powerful intermodal competitors like Deutsche Telekom AG (DTAG) with an innovative IPTV infrastructure. Zur EuropÀisierung des Verwaltungsrechts
 Die EuropĂ€isierung des Verwaltungsrechts ist ein fortschreitender, nicht endender Prozess. Betroffen sind Kernmaterien der innerstaatlichen Rechtsordnung wie etwa das Allgemeine Verwaltungsrecht, das Verwaltungsverfahrensrecht und das Verwaltungsprozessrecht. Der Beitrag analysiert die Einwirkungen des supranationalen Unionsrechts auf jene Rechtsgebiete und weist nach, dass das systematisch angelegte deutsche Verwaltungsrecht und die gut strukturierte Rechtsdogmatik in der Lage sind, die EuropĂ€isierung der innerstaatlichen Rechtsordnung zu bewĂ€ltigen. Dabei zeigt sich, dass das Europarecht nicht nur Herausforderungen fĂŒr das nationale Recht und das ĂŒberkommene Rechtsdenken bereithĂ€lt, sondern auch Impulse fĂŒr die Modernisierung des deutschen Verwaltungsrechts setzt.
