    Impact of technological synchronicity on prospects for CETI

    For over 50 years, astronomers have searched the skies for evidence of electromagnetic signals from extraterrestrial civilizations that have reached or surpassed our level of technological development. Although often overlooked or given as granted, the parallel use of an equivalent communication technology is a necessary prerequisite for establishing contact in both leakage and deliberate messaging strategies. Civilization advancements, especially accelerating change and exponential growth, lessen the perspective for a simultaneous technological status of civilizations thus putting hard constraints on the likelihood of a dialogue. In this paper we consider the mathematical probability of technological synchronicity of our own and a number of other hypothetical extraterrestrial civilizations and explore the most likely scenarios for their concurrency. If SETI projects rely on a fortuitous detection of leaked interstellar signals (so called "eavesdropping") then without any prior assumptions N \geq 138-4991 Earth-like civilizations have to exist at this moment in the Galaxy for the technological usage synchronicity probability p \geq 0.95 in the next 20 years. We also show that since the emergence of complex life, coherent with the hypothesis of the Galactic habitable zone, N \geq 1497 extraterrestrial civilizations had to be created in the Galaxy in order to achieve the same estimated probability in the technological possession synchronicity which corresponds to the deliberate signaling scenario.Comment: 15 pages, 7 figures, 1 table, accepted for publication in the International Journal of Astrobiolog

    We survey 384 CFOs and Treasurers, and conduct in-depth interviews with an additional two dozen, to determine the key factors that drive dividend and share repurchase policies. We find that managers are very reluctant to cut dividends, that dividends are smoothed through time, and that dividend increases are tied to long-run sustainable earnings but much less so than in the past. Rather than increasing dividends, many firms now use repurchases as an alternative. Paying out with repurchases is viewed by managers as being more flexible than using dividends, permitting a better opportunity to optimize investment. Managers like to repurchase shares when they feel their stock is undervalued and in an effort to affect EPS. Dividend increases and the level of share repurchases are generally paid out of residual cash flow, after investment and liquidity needs are met. Financial executives believe that retail investors have a strong preference for dividends, in spite of the tax disadvantage relative to repurchases. In contrast, executives believe that institutional investors as a class have no strong preference between dividends and repurchases. In general, management views provide at most moderate support for agency, signaling, and clientele hypotheses of payout policy. Tax considerations play only a secondary role. By highlighting where the theory and practice of corporate payout policy are consistent and where they are not, we attempt to shed new light on important unresolved issues related to payout policy in the 21st century.

    Patent claims are supposed to clearly and succinctly describe the patented invention, and only the patented invention. This Article hypothesizes that a substantial amount of language in patent claims is in fact not about the core invention, which may contribute to well-documented problems with patent claims. I analyze the claims of 40,000 patents and applications, and document the proliferation of “clutter”—language in patent claims that is not about the invention. Although claims are supposed to be exclusively about the invention, clutter appears across industries and makes up approximately 25% of claim language. Patent clutter may contribute several major problems in patent law. Extensive clutter makes patent claims harder to search. Excessive language in patent claims may be the result of over-claiming—when patentees describe potential corollaries they do not possess—thereby making the patent so broad in scope as to be invalid. More generally, it strains the comprehensibility of patents and burdens the resources of patent examiners. After arguing that patent clutter may contribute to these various problems, this Article turns to reforms. Rejections based on prolix, lack of enablement, and lack of written description can be crafted to dispose of the worst offenders, and better algorithms and different litigation rules can allow the patent system to adapt (and even benefit from) the remaining uses of excess language. The Article additionally generates important theoretical insights. Claims are often thought of as entirely synonymous with the invention and all elements of the claim are thought to relate equally strongly to the invention. This Article suggests empirically that these assumptions do not hold in practice, and offers a framework for restructuring conceptions of the relationship between claims and the invention
