    Information and Communication Systems Including Artificial Intelligence and Big Data as Objects of International Legal Protection

    The objective of this study is identifying prospective for international legal protection of information and communication systems including artificial intelligence on the universal and regional levels, and analysis of legal instruments for protection of artificial intelligence and Big Data in the context of regulation of relations in the global information society. A complex of general scientific and philosophical methods, including the logical, comparative-legal, formal-legal, systemic-structural, and problematic-theoretical methods, as well as methods of analysis and synthesis, generalization and description were used in the research. It was found that the existing international agreements in the field of intellectual property protection take no account of the particular features of protection of complex objects. Complex objects comprise information and communication systems including artificial intelligence and Big Data. There is an objective necessity to establish a legal regime for complex objects on the universal level. The findings can be used in activities of international organizations in execution of their functions of unification and harmonization of the international information law

    System Management Approach in Crop Production and Protection

    The complexity of agricultural systems and the need to fulfill multiple objectives in sustainable agro-ecosystems call for interdisciplinary analyzes and input from a wide variety of disciplines in order to better understand the complete agronomic production system. Systems approaches have been developed to support these interdisciplinary studies; their development and use have increased strongly in the past decades. Systems analysis in agronomic systems implies the use of various types of knowledge and model-simulations. It provides concepts and tools for structured analysis, synthesis and design of systems at different scales. Each problem requires its own research approach. Based on the output requirements and data availability, the proper systems approach has to be selected. System management approach is now more relevant and important than at any previous time because of increasing realization of the inter-relatedness between components of fragile ecosystems; as comprehensive interdisciplinary analysis of agricultural production systems is seen as a necessary condition for the development of innovative, sustainable systems for the future. This paper presents an overview about system approach and its application in crop production and crop protection; in particular it reports the significance of implementation of system management approach in mitigation of pest problem in crop production.     The complex methods of diagnosis investigation of the wood artifacts state and proper materials for their protection against decay are very important goals in cultural heritage. This chapter focuses on the recent trends in micro- and nanostructured polymer systems for application in cultural heritage and on wood preservation, especially. The synthesis, properties, and applications, as well as the relevant analysis techniques to reveal the structures and properties of polymer systems, are discussed, too. To overcome the specific problems that exist for wood artifacts, some aspects should be treated: effects of the environmental factors, as moisture and pollutant absorption into the wood fibers, over-exposure effect of sun or artificial light sources, biological attack of different microorganisms, and the effects of the protective and decorative coatings

    Design of Learning Media with Visual Communication Design Methodology

    Abstract: This paper is the result of research entitled 'Designing Learning Media Based on Information Technology' which aims to design / create prototype multimedia instructional media software, where the product is finally recorded in DVD disc with certain protection system. The methodology applied in the research is a 'design research methodology' covering three stages: analysis, synthesis, and evaluation. In the analysis process, identification and analysis of the story board of each section of teaching materials to adjust the learning objectives, as well as identification of key factors related to the media production techniques. In the synthesis process, organizing and compiling the database (interactive programming), as well as improvements according to recommendation/input from evaluation result, to produce software system with security system. Evaluation is done by trial and product verification based on problem identification and learning objectives. The benefit of this research is to make it easier for teachers in universities in the learning process of the subjects that are managed, and can also be used by the parties who need it. Furthermore, the systems, methods, and patterns that have been generated can be expanded-apply to other courses.     Agricultural Growth Accounting and Total Factor Productivity in South Asia: A Review and Policy Implications

    Productivity growth in agriculture is essential for the development of the sector. This paper has reviewed the developments in agricultural productivity related to the South Asian countries, namely Bangladesh, India, Nepal, Pakistan, and Sri Lanka. The TFP growth and its contribution in production growth have been summarised for South Asia over the past three decades. Crop-specific TFP growth figures have been updated for India by using more recent micro farm level data for three decades. A discussion and synthesis on changes in TFP and its sources of growth for the major crops, major crop systems, crops and livestock sectors for the countries of South Asia have also been presented. Methodological framework for computation of TFP and its growth has also been presented. Policies towards food-secure South Asia have been outlined under the sub-heads (i) Arresting deceleration in total factor productivity, (ii) Enhancing yield of major commodities, (iii) Accent on empowering the small farmers, (iv) Environment protection, and (v) Strengthening of national agricultural research system. This paper would provide useful information to the people interested in doing research on these issues.     Implementation of International Standards for Determining an Efficient Civil Law Remedy by a National Court

    The article is devoted to studying the effectiveness of protection of violated, unrecognised or disputed rights, freedoms or interests of individuals, rights and interests of legal entities, the interests of the state in civil proceedings. The purpose of the article is to study how to implement international standards for determining an efficient civil law remedy by the court: (based on the case-law of the European Court of Human Rights and national case law). Clarification of the essence of novels of substantive and procedural law in determining the court's effective way to protect private law as the final judicial procedure of the right to judicial protection was by comparative law, methods of analysis, modelling and synthesis with the implementation of related elements of classical methods of protection and reception of the best acquisitions of legal systems of foreign countries, norms of the Convention of the case-law of the European Court of Human Rights (from now on – ECtHR). The dialectical method of cognition and the qualitative empirical method were also the main ones, by means of which the legal nature of the category "efficiency" and "determination by the court of an effective way of protection of private law and interest" were clarified.     This article justifies, that questions of environmental protection, protection of natural resources, ecological safety are the most actual for effective development of economic systems. In the modern economic situation, coherence and administrative leverage in total with ecological taxation and insurance are forceful instruments to move towards the model of «green» economy. The main goal is to consult the theoretical and practical experience of formation the ecological safety under the paradigm of «green» economy of European countries and the Republic of Belarus based on analysis of main financial instruments of the state ecological policy. The main tasks are: identifying mechanism of formation of ecological safety in conditions of green economy in European countries and in the Republic of Belarus; identify and systematization of main financial instruments for state ecological policy; justification of necessity and directions for improvement the ecological taxation and insurance. Methodology of the study is based on the principles of the system analysis, formal logic and interdisciplinary scientific approach to the problem. Monographic and descriptive method, method of analysis and synthesis, statistical data analysis method were used to complete the tasks of research. Novelty of this research is that systematization of theoretical practical foundations of state management of ecological safety through financial instruments of green economy can increase the effectiveness of the stable development of the economic system

    Development Of A Customer Service System In Electronic Commerce

    Information technologies and systems are developing rapidly. Therefore, there are significant changes in business entities’ interaction. E-business is an effective tool to make settlements with customers, expand markets for goods and services, seek new partners, and create a positive image. Certain business types are more favourable to introduce e-commerce; thus, their development level is higher. These are trade in intangible goods, securities, banking services, software development and implementation, information services, distance learning, etc. The purpose of this paper is to determine electronic commerce features in customer warranty and service. The following methods were used: bibliometric and content analysis in processing and searching literary sources; comparing protection of consumers’ interests; analysis and synthesis; consolidation and systematization, particularly in the analysis of legislation, literature, and statistics. Service and warranty are key commerce elements. They are customer services. For proper service and to be ahead of competitors, the consumers’ feedback, complaints, suggestions, recommendations, claims, constant response should be set up. Protecting consumer rights in e-commerce is ensured by “On consumer rights protection”, “On electronic commerce”, etc. Improving regulations between a consumer and a seller, and finding new implementing ways are necessary. Ukraine should fulfill its international legal obligations. Despite the fact that protection of consumer rights is regulated, e-commerce is not properly established and there is a negative experience in using it because of poor government control. E-commerce stores’ trends will allow achieving excellence, high ratings, and buyers’ confidence. The country should have a high-quality e-commerce service

    Ensuring Healthcare Efficiency in the Context of the Medical and Pharmaceutical Staff Regulation

    This article aims to substantiate the impact of socio-economic labor protection for healthcare professionals based on developing legislative regulations in some OECD and EAEU countries and identifying their relationship with the efficiency of healthcare systems. The methodology includes general scientific methods (systemic analysis, synthesis, comparison, abstraction, induction, deduction, and modeling) and special research methods (formal logical, structural, and functional). The results of international rankings evaluating healthcare systems were used to determine the list of states for comparative legal analysis. Also, empirical methods were used: meetings, questionnaire surveys, and interviews held in 2021 with medical and pharmaceutical workers in Kazakhstan. The research results showed that states with special labor regulations for medical and pharmaceutical personnel occupy stable leading positions in international rankings regarding healthcare evaluation. On the other hand, based on the example of the EAEU countries with an insufficient level of specialization in labor regulation for these categories of workers, some states occupy weak positions in similar international ratings. This paper is novel because previously, there was no debate in the literature justifying the finding that specifics in the labor regulation of medical and pharmaceutical staff, along with other factors, influence the healthcare system's efficiency and development. Doi: 10.28991/ESJ-2022-06-06-05 Full Text: PD
