    'Palestine is Thus Brought Home to England': The Representation of Palestine in British Travel Literature, 1840-1914

    This thesis reviews a selection of around forty travelogues on Palestine produced from 1840 to 1914 by British traveller-writers, in addition to a range of supporting material relating to Palestine travel. It argues that this genre of texts has had a profound influence on Palestine’s history. This thesis aims to define what image of Palestine and its people was embodied in the travelogue genre in the last decades of the Ottoman Empire, and what its influence has been, through posing four questions. How was the Palestinian people represented by British traveller-writers? How was the land of Palestine itself represented? How did these representations serve to advance a colonial, or settler-colonial, claim upon Palestine? And how have they influenced subsequent colonial and settler-colonial ideologies and practices, specifically those of the British Mandate administration and the Zionist movement before 1948, and the State of Israel afterwards? Chapters are dedicated to the representation of Palestine’s Muslims and Islam, Christians and Christianity, Jews and Judaism, and smaller social and religious minorities; to representations of Palestine as a land of the past and of the existing landscape; to representations of Palestine’s urban environments; and to prototypes of settler colonialism devised by British travellers in the late Ottoman period. Theoretical frameworks of Orientalism and settler colonialism are used throughout in considering how travel narratives took on a life off the page, becoming actualised in the attitudes, beliefs and choices of two classes of colonisers, the British and the Zionist movement

    Jewish identity is a perennial concern, as Jews seek to define the major features and categories of those who “belong,” while at the same time draw distinctions between individuals and groups on the “inside” and those on the “outside.” From a variety of perspectives, scholarly as well as confessional, there is intense interest among non-Jewish and Jewish commentators alike in the basic question, “Who is a Jew?” This collection of articles draws diverse historical, cultural, and religious insights from scholars who represent a wide range of academic and theological disciplines. Some of the authors directly address the issue of Jewish identity as it is being played out today in Israel and Diaspora communities. Others look to earlier time periods or societies as invaluable resources for enhanced and deepened analysis of contemporary matters. All authors in this collection make a concerted effort to present their evidence and their conclusions in a way that is accessible to the general public and valid for other scholars. The result is a richly textured approach to a topic that seems always relevant. If no single answer appeals to all of the authors, this is as it should be.     "For many centuries Jews and Germans were economically and culturally of significant importance in East-Central and Eastern Europe. Since both groups had a very similar background of origin (Central Europe) and spoke languages which are related to each other (German/Yiddish), the question arises to what extent Jews and Germans in Eastern Europe share common historical developments and experiences. This volume aims to explore not only entanglements and interdependences of Jews and Germans in Eastern Europe from the late middle ages to the 20th century, but also comparative aspects of these two communities. Moreover, the perception of Jews as Germans in this region is also discussed in detail.

    The Protection of Foreign Investments in Armed Conflicts

    This thesis examines the international legal framework that governs the protection of foreign investments in times of armed conflict. It addresses the laws of armed conflict and the international law of foreign investment and their regulation of investments in particular situations. The thesis provides an overall argument that the potential for conflict between investment law and international humanitarian law is a significant issue of growing relevance, as the two regimes, through their different norms, may regulate the same conduct with different objectives in mind, but that international law mostly (but not entirely) has the tools to resolve any such conflict through the rules of interpretation or through rules of priority. The thesis first establishes that the outbreak of hostilities does not, ipso facto, abrogate the operation of investment treaties. Then, the analysis proceeds to assess the application of investment treaties and their standards of protection in situations of armed conflict. In this respect, the thesis analyzes the legal frameworks that govern the dispossession and destruction of foreign investments, the treatment of investments under the contemporary laws of targeting, and the obligation to protect foreign investments from the effects of armed conflict (precautionary obligation). Having dealt with the substantive standards of protection, the thesis examines whether the occurrence of armed conflicts can be used to exempt, excuse, justify, or carve-out investment obligations during armed conflict. Finally, the analysis deals with the consequences of the State’s failure to guarantee the protection of foreign investments as required by international law and the obligation to award ‘adequate’ compensation for losses owing to armed conflic

    The history of biblical archaeology and of the archaeology of the Near East has been the subject of many publications until now. Those histories usually offer the reader a detailed account of progressive facts on a long and linear chronology, in which England stares as the main character, later losing its role to the United States. Besides those totalising explanations, there are other ways to interpret the history of Western archaeological interest in the Near East. In this thesis, the emphasis lays upon Germany, which is traditionally attributed a secondary role. German’s peculiar relation to the Orient, as the only western country to settle in Palestine even in the 19th century, or as the only western country to adopt a friendly position towards the Ottoman rulers, allowed German scientific exploration to develop under unique conditions. While studying the development of German archeological interest in Palestine from 1871 to 1945, I intend to present a different perspective on this scenario of western competition for the Holy Land
