    Hypotheses and their dynamics in legal argumentation

    We investigate some legal interpretation techniques from the viewpoint of the Argentinian jurisprudence. This allows the proposal of a logical framework –from a computer science perspective– for modeling such specific reasoning techniques towards an appropriate construction of legal arguments. Afterwards, we study the usage of assumptions towards construction of hypotheses. This is proposed in the dynamic context of legal procedures, where the referred argumentation framework evolves as part of the investigation instance prior to the trial. We propose belief revision operators to handle such dynamics, preserving a coherent behavior with regards to the legal interpretation used. Abduction is finally proposed to construct systematic hypothesization, with the objective to bring semi-automatic recommendations to push forward the investigation of a legal case

    A model for predicting court decisions on child custody

    Awarding joint or sole custody is of crucial importance for the lives of both the child and the parents. This paper first models the factors explaining a court''s decision to grant child custody and later tests the predictive capacity of the proposed model. We conducted an empirical study using data from 1, 884 court rulings, identifying and labeling factual elements, legal principles, and other relevant information. We developed a neural network model that includes eight factual findings, such as the relationship between the parents and their economic resources, the child''s opinion, and the psychological report on the type of custody. We performed a temporal validation using cases later in time than those in the training sample for prediction. Our system predicted the court''s decisions with an accuracy exceeding 85%. We obtained easy-to-apply decision rules with the decision tree technique. The paper contributes by identifying the factors that best predict joint custody, which is useful for parents, lawyers, and prosecutors. Parents would do well to know these findings before venturing into a courtroom

    An approach to temporalised legal revision through addition of literals

    As lawmakers produce norms, the underlying normative system is affected showing the intrinsic dynamism of law. Through undertaken actions of legal change, the normative system is continuously modified. In a usual legislative practice, the time for an enacted legal provision to be in force may differ from that of its inclusion to the legal system, or from that in which it produces legal effects. Even more, some provisions can produce effects retroactively in time. In this article we study a simulation of such process through the formalisation of a temporalised logical framework upon which a novel belief revision model tackles the dynamic nature of law. Represented through intervals, the temporalisation of sentences allows differentiating the temporal parameters of norms. In addition, a proposed revision operator allows assessing change to the legal system by including a new temporalised literal while preserving the time-based consistency. This can be achieved either by pushing out conflictive pieces of pre-existing norms or through the modification of intervals in which such norms can be either in force, or produce effects. Finally, the construction of the temporalised revision operator is axiomatically characterised and its rational behavior proved through a corresponding representation theorem.Fil: Moguillansky, Martin Oscar.
