    The Proficiency of Experts

    Expert evidence plays a crucial role in civil and criminal litigation. Changes in the rules concerning expert admissibility, following the Supreme Court\u27s Daubert ruling, strengthened judicial review of the reliability and the validity of an expert\u27s methods. Judges and scholars, however, have neglected the threshold question for expert evidence: whether a person should be qualified as an expert in the first place. Judges traditionally focus on credentials or experience when qualifying experts without regard to whether those criteria are good proxies for true expertise. We argue that credentials and experience are often poor proxies for proficiency. Qualification of an expert presumes that the witness can perform in a particular domain with a proficiency that non-experts cannot achieve, yet many experts cannot provide empirical evidence that they do in fact perform at high levels of proficiency. To demonstrate the importance ofproficiency data, we collect and analyze two decades of proficiency testing of latent fingerprint examiners. In this important domain, we found surprisingly high rates of false positive identifications for the period 1995 to 2016. These data would qualify the claims of many fingerprint examiners regarding their near infallibility, but unfortunately, judges do not seek out such information. We survey the federal and state case law and show how judges typically accept expert credentials as a proxy for proficiency in lieu of direct proof of proficiency. Indeed, judges often reject parties\u27 attempts to obtain and introduce at trial empirical data on an expert\u27s actual proficiency. We argue that any expert who purports to give falsifiable opinions can be subjected to proficiency testing and that proficiency testing is the only objective means of assessing the accuracy and reliability ofexperts who rely on subjective judgments to formulate their opinions (so-called black-box experts ). Judges should use proficiency data to make expert qualification decisions when the data is available, should demand proof of proficiency before qualifying black-box experts, and should admit at trial proficiency data for any qualified expert.     Promoting Intermodal Connectivity at California’s High Speed Rail Stations

    High-speed rail (HSR) has emerged as one of the most revolutionary and transformative transportation technologies, having a profound impact on urban-regional accessibility and inter-city travel across Europe, Japan, and more recently China and other Asian countries. One of HSR’s biggest advantages over air travel is that it offers passengers a one-seat ride into the center of major cities, eliminating time-consuming airport transfers and wait times, and providing ample opportunities for intermodal transfers at these locales. Thus, HSR passengers are typically able to arrive at stations that are only a short walk away from central business districts and major tourist attractions, without experiencing any of the stress that car drivers often experience in negotiating such highly congested environments. Such an approach requires a high level of coordination and planning of the infrastructural and spatial aspects of the HSR service, and a high degree of intermodal connectivity. But what key elements can help the US high-speed rail system blend successfully with other existing rail and transit services? That question is critically important now that high-speed rail is under construction in California. The study seeks to understand the requirements for high levels of connectivity and spatial and operational integration of HSR stations and offer recommendations for seamless, and convenient integrated service in California intercity rail/HSR stations. The study draws data from a review of the literature on the connectivity, intermodality, and spatial and operational integration of transit systems; a survey of 26 high-speed rail experts from six different European countries; and an in-depth look of the German and Spanish HSR systems and some of their stations, which are deemed as exemplary models of station connectivity. The study offers recommendations on how to enhance both the spatial and the operational connectivity of high-speed rail systems giving emphasis on four spatial zones: the station, the station neighborhood, the municipality at large, and the region

    Machine learning and its applications in reliability analysis systems

    In this thesis, we are interested in exploring some aspects of Machine Learning (ML) and its application in the Reliability Analysis systems (RAs). We begin by investigating some ML paradigms and their- techniques, go on to discuss the possible applications of ML in improving RAs performance, and lastly give guidelines of the architecture of learning RAs. Our survey of ML covers both levels of Neural Network learning and Symbolic learning. In symbolic process learning, five types of learning and their applications are discussed: rote learning, learning from instruction, learning from analogy, learning from examples, and learning from observation and discovery. The Reliability Analysis systems (RAs) presented in this thesis are mainly designed for maintaining plant safety supported by two functions: risk analysis function, i.e., failure mode effect analysis (FMEA) ; and diagnosis function, i.e., real-time fault location (RTFL). Three approaches have been discussed in creating the RAs. According to the result of our survey, we suggest currently the best design of RAs is to embed model-based RAs, i.e., MORA (as software) in a neural network based computer system (as hardware). However, there are still some improvement which can be made through the applications of Machine Learning. By implanting the 'learning element', the MORA will become learning MORA (La MORA) system, a learning Reliability Analysis system with the power of automatic knowledge acquisition and inconsistency checking, and more.     Students with Disabilities in Dutch VET: An Exploratory Study

    [Excerpt] The inclusion of persons with disabilities in general programmes of vocational training has been called for by the ILO in international labour standards over many years, including standards relating to Human Resources Development and disability-related standards. This call is taken up strongly in the UN Convention on the Rights of Persons with Disabilities which calls on States Parties to take appropriate steps to enable persons with disabilities to have effective access to general tertiary education, vocational and life-long learning without discrimination and on an equal basis with others, and to ensure that reasonable accommodation is provided to that effect. While many countries have expressed commitment to this vision of inclusive vocational training, progress has been limited, even in countries which have adopted policies to promote, and there has been limited analysis of the factors hindering the effective implementation of such policies. It was thus appropriate for the ILO to undertake this exploratory study, to seek to pinpoint elements of policy and practice that might need to be addressed, if these policies on inclusion are to make a difference to persons with disabilities seeking to develop their skills with a view to obtaining decent jobs. The issues identified in this study will hopefully contribute to the wider policy debate, particularly on the matter of instructor preparation for disability inclusion and on the impact of funding arrangements. It will also hopefully stimulate further research to establish whether the patterns identified here are general patterns to be found and tackled elsewhere
