    VDT workplace design and effects on muscle disorders and eye strain among students at an educational institute

    The advancement of information technology encouraged schools, universities and other educational institutions to use visual display terminal (VDT) in conducting lectures rendering services and developing various systems. The use of personal computer (PC) and laptops are common among students. Classrooms are equipped with liquid crystal display (LCD) screens for lecturers to display their lectures for students. Many cases have not been reported because of lack of awareness and understanding on ergonomic. However, Poor ergonomics of the physical environment of VDT can cause musculoskeletal disorders (MSDs); the inappropriateness of school design may influence student achievement negatively. The viewing distance and position of the screens have been found as the main factors causing MSDs. The students’ satisfactions on VDT used in the education institute were determined. The effects of VDT workplace design parameters on muscle disorder and eye strain among students were determined. Ergonomically positions of VDT for safer and comfortable use among students were proposed. Data obtained from 215 LCD projector users and 103 desktop monitor users were analyzed using frequency tables, one sample t-test and Spearman’s rank order correlation coefficient. The frequency analysis for the level of satisfaction among LCD projector users showed that most of the users (88.4%) were satisfied with the viewing distance, and were least satisfied with the lighting(51.6%). For the monitor user, the users were highly satisfied with user/ screen position (80.6%) and least satisfied with the viewing distance (61.2%). Most of the LCD projector users (36.7%), experienced eye pain while performing study tasks on the projector screen, and the least pain were for head pain (22.8%). Most of the desktop monitor users (54.9%) were experienced head pain while performing study tasks on the monitors, and only (32%) experienced back pain. The relationship between the level of satisfaction for physical environment and MSDs was determined using Spearman’s rank order correlation coefficient. Results showed that, there were a significant and negative relationship between satisfaction of lighting and the level of back pain (rs = - 0.213, p < 0.001), head pain (rs = - 0.266, p < 0.001), neck pain (rs = - 0.119, p < 0.034) and eye pain (rs = - 0.292, p < 0.001) levels. Significant relationships were found between the level of distance satisfaction and the level of back pain (rs = - 0.148, p < 0.01) and eye pain (rs = - 0.151, p < 0.04). The results of association between satisfaction of position and MSDs pain indicated that only the relationship between satisfaction of position and the eye pain (rs = - 0.151, p < 0.005) was significant and negative. The results implied that the eye is the part of the body which is affected by all the other variables (lighting, distance, and position), but particularly more affected by problems with lighting in the study hall. In conclusion, this study has demonstrated that there is a lack of satisfaction with respect to some items within the physical environment, and there were MSDs disorders associated with VDT use, especially the lighting. These all likely to play a significant role in affecting the user’s health, and subsequently their performance. Thus providing enough lighting sources above the students and nearby the ( monitor/ p- screen), added to the windows in the classrooms and libraries. Also, ensure the proper distance like an arm's length for monitor users and (2 to 10 ) meters for the presentation screen users added to the students position directly in front of the monitor or p- screen with considering the study hall design ( sloped or flat) to provide viewing angle ( 0° to -20°), which allow the students to read the text at or slightly below eyes level, all of those are suggested to reduce the MSDs among UPM students

    Levels of Free Speech Scrutiny

    Inconsistencies abound throughout current exacting, strict, and most exacting scrutiny doctrines. Formalism also runs throughout recent cases that have opportunistically relied on the First Amendment in matters peripherally concerned with core principles of free speech. Jurisprudence that relies on the exacting scrutiny standard remains significantly under-theorized. The uncertainty creates doctrinal flux that shifts from case-to-case. The same unexplained malleability appears in the most exacting scrutiny jurisprudence. The Court, moreover, sometimes refers to these two standards as equivalent to strict scrutiny. On the other hand, during the last decade, and most recently in 2021, various opinions have also used exacting scrutiny as a poorly defined hybrid form of intermediate scrutiny. This Article proposes to cure the existing inconsistencies through a tripartite model for noneconomic speech. Exacting scrutiny should apply to cases reviewing disclosure requirements on charities or political contributions. That standard should function as proportional scrutiny that treats secondary effects on speech differently than censorship of ideas and perspectives. As to strict scrutiny, its narrow tailoring requirement should apply in cases of content discrimination. Most exacting scrutiny is best fit for review of viewpoint discrimination that targets ideas, conjectures, and discourses. Levels of scrutiny should not be formulaic but reflective of the fundamental principles of free speech protection: self-expression, self-governance, and the search for truth. Clear distinctions between various levels of heightened scrutiny would provide a functional means for checking government censorship while retaining traditional authority to detect and punish fraud

    The Future of Roe and the Gender Pay Gap: An Empirical Assessment

    In Dobbs v. Jackson Women’s Health Organization, the Supreme Court upheld a Mississippi law that prohibits nearly all abortions after the fifteenth week of pregnancy and overruled the holding in Roe v. Wade. Among the many arguments raised in Dobbs in an attempt to overturn Roe, the State of Mississippi argued that due to “the march of progress” in women’s role in society, abortion rights are no longer necessary for women to participate equally in economic life. It has also been argued that there is no empirical support to the relationship between abortion rights and women’s economic success in society. This Article will empirically examine both of these arguments, and it provides compelling evidence to reject each of them. To do so, we adopt a novel methodology that utilizes the enforcement of Targeted Regulation of Abortion Providers (TRAP) laws as proxies for abortion restrictions. We study the effects of over forty years of legislation on the participation of American women in the labor market. Our findings suggest that the introduction of TRAP laws has widened the gender pay gap between women of childbearing age and the rest of the population. Our analysis offers two potential explanations regarding the mechanisms based on which TRAP laws widen this gap: they push women out of the labor force and into choosing lower-paying jobs. Ultimately, these findings foreshadow the future landscape of gender inequality in the United States in the post-Roe era

    In the Best Interests of Whom?: An Analysis of Judicial Bias in Custody Disputes Involving Transgender Children

    Anti-transgender discrimination and bias loom large in many areas of our society, but perhaps one of the most concerning settings is within the four walls of a courtroom. Evidence suggests that judicial decision making in custody determinations involving transgender children are influenced by anti-transgender bias. In this Note, I examine the current best practice for treating transgender children, the affirmative model, and explore the legal landscape of custody cases involving parents who disagree on how to treat their transgender child. I then suggest a model of comprehensive judicial education reform to help eliminate antitransgender bias from family courts in the United States

    Frivolous Floodgate Fears

    When rejecting plaintiff-friendly liability standards, courts often cite a fear of opening the floodgates of litigation. Namely, courts point to either a desire to protect the docket of federal courts or a burden on the executive branch. But there is little empirical evidence exploring whether the adoption of a stricter standard can, in fact, decrease the filing of legal claims in this circumstance. This Article empirically analyzes and theoretically models the effect of adopting arguably stricter liability standards on litigation by investigating the context of one of the Supreme Court’s most recent reliances on this argument when adopting a stricter liability standard for causation in employment discrimination claims. In 2013, the Supreme Court held that a plaintiff proving retaliation under Title VII of the Civil Rights Act must prove that their participation in a protected activity was a but-for cause of the adverse employment action they experienced. Rejecting the arguably more plaintiff-friendly motivating-factor standard, the Court stated, “[L]essening the causation standard could also contribute to the filing of frivolous claims, which would siphon resources from efforts by employer[s], administrative agencies, and courts to combat workplace harassment.” Univ. of Tex. Sw. Med. Ctr. v. Nassar, 570 U.S. 338, 358 (2013). And over the past ten years, the Court has overturned the application of motivating-factor causation as applied to at least four different federal antidiscrimination statutes. Contrary to the Supreme Court’s concern that motivating-factor causation encourages frivolous charges, many employment law scholars worry that the heightened but-for standard will deter legitimate claims. This Article empirically explores these concerns, in part using data received from the Equal Employment Opportunity Commission (EEOC) through a Freedom of Information Act (FOIA) request. Specifically, it empirically tests whether the adoption of the but-for causation standard for claims filed under the Age Discrimination in Employment Act and by federal courts of appeals under the Americans with Disabilities Act has impacted the filing of discrimination claims and the outcome of those claims in federal court. Consistent with theory detailed in this Article, the empirical analysis provides evidence that the stricter standard may have increased the docket of the federal courts by decreasing settlement within the EEOC and during litigation. The empirical results weigh in on concerns surrounding the adoption of the but-for causation standard and provide evidence that the floodgates argument, when relied on to deter frivolous filings by changing liability standards, in fact, may do just the opposite by decreasing the likelihood of settlement in the short term, without impacting the filing of claims or other case outcomes

    Patenting Genetic Information

    The U.S. biotechnology industry got its start and grew to maturity over roughly three decades, beginning in the 1980s. During this period genes were patentable, and many gene patents were granted. University researchers performed basic research— often funded by the government—and then patented the genes they discovered with the encouragement of the Bayh-Dole Act, which sought to encourage practical applications of basic research by allowing patents on federally funded inventions and discoveries. At that time, when a researcher discovered the function of a gene, she could patent it such that no one else could work with that gene in the laboratory without a license. She had no right, however, to control genes in nature, including in human bodies. Universities licensed their researchers’ patents to industry, which brought in significant revenue for further research. University researchers also used gene patents as the basis for obtaining funding for start-up enterprises spun out of university labs. It was in this environment that many of today’s biotechnology companies started. In 2013, the Supreme Court held that naturally occurring genes could no longer be patented. This followed a 2012 decision that disallowed patents on many diagnostic processes. These decisions significantly changed the intellectual property protections in the biotechnology industry. Nevertheless, the industry has continued to grow and thrive. This Article investigates two questions. First, if some form of exclusive rights still applied to genes, would the biotech industry be even more robust, with more new entrants in addition to thriving, well-established companies? Second, does the current lack of protection for gene discoveries incentivize keeping such discoveries secret for the many years that it can take to develop a therapeutic based thereon—to the detriment of patients who could benefit from knowledge of the genetic associations, even before a treatment is developed? The Article concludes by analyzing what protection for discovering genetic associations, if any, will most increase social welfare

    Experience Prototyping for Automotive Applications

    In recent years, we started to define our life through experiences we make instead of objectswe buy. To attend a concert of our favorite musician may be more important for us thanowning an expensive stereo system. Similarly, we define interactive systems not only by thequality of the display or its usability, but rather by the experiences we can make when usingthe device. A cell phone is primarily built for making calls and receiving text messages,but on an emotional level it might provide a way to be close to our loved ones, even thoughthey are far away sometimes. When designing interactive technology, we do not only haveto answer the question how people use our systems, but also why they use them. Thus,we need to concentrate on experiences, feelings and emotions arising during interaction.Experience Design is an approach focusing on the story that a product communicates beforeimplementing the system. In an interdisciplinary team of psychologists, industrial designers, product developers andspecialists in human-computer interaction, we applied an Experience Design process to theautomotive domain. A major challenge for car manufacturers is the preservation of theseexperiences throughout the development process. When implementing interactive systemsengineers rely on technical requirements and a set of constraints (e.g., safety) oftentimescontradicting aspects of the designed experience. To resolve this conflict, Experience Prototypingis an important tool translating experience stories to an actual interactive product. With this thesis I investigate the Experience Design process focusing on Experience Prototyping.Within the automotive context, I report on three case studies implementing threekinds of interactive systems, forming and following our approach. I implemented (1) anelectric vehicle information system called Heartbeat, communicating the state of the electricdrive and the batteries to the driver in an unobtrusive and ensuring way. I integrated Heartbeatinto the dashboard of a car mock-up with respect to safety and space requirements butat the same time holding on to the story in order to achieve a consistent experience. With (2)the Periscope I implemented a mobile navigation device enhancing the social and relatednessexperiences of the passengers in the car. I built and evaluated several experience prototypesin different stages of the design process and showed that they transported the designed experiencethroughout the implementation of the system. Focusing on (3) the experience offreehand gestures, GestShare explored this interaction style for in-car and car-to-car socialexperiences. We designed and implemented a gestural prototypes for small but effectivesocial interactions between drivers and evaluated the system in the lab and and in-situ study. The contributions of this thesis are (1) a definition of Experience Prototyping in the automotivedomain resulting from a literature review and my own work, showing the importanceand feasibility of Experience Prototyping for Experience Design. I (2) contribute three casestudies and describe the details of several prototypes as milestones on the way from a anexperience story to an interactive system. I (3) derive best practices for Experience Prototypingconcerning their characteristics such as fidelity, resolution and interactivity as well asthe evaluation in the lab an in situ in different stages of the process.Wir definieren unser Leben zunehmend durch Dinge, die wir erleben und weniger durchProdukte, die wir kaufen. Experience Design ist eine Disziplin, die sich auf Geschichten konzentriert,die ein Produkt erzählt, bevor es tatsächlich implementiert wird. In einem interdisziplinären Team aus Psychologen, Industrie-Designern, Produktentwicklernund Spezialisten der Mensch-Maschine-Interaktion wurde ein Prozess zur Erlebnis-Gestaltung im automobilen Kontext angewandt. Die Bereitstellung von Erlebnis-Prototypen ermöglicht die Übersetzungvon Geschichten in interaktive Produkte und wirkt daher diesem Konflikt entgegen. Im Rahmen dieser Dissertation untersuche ich den Prozess zur Erlebnis-Gestaltung hinsichtlichder Bedeutung von Erlebnis-Prototypen. Ich berichte von drei Fallbeispielen im automobilenBereich, die die Gestaltung und Implementierung verschiedener interaktiver Systemenumfassen. (1) Ein Informationssystem für Elektrofahrzeuge, der Heartbeat, macht den Zustanddes elektrischen Antriebs und den Ladestand der Batterien für den Fahrer visuell undhaptisch erlebbar. Nach der Implementierung mehrerer Prototypen wurde Heartbeat unterBerücksichtigung verschiedener technischer und sicherheitsrelevanter Anforderungen in dieArmaturen eines Fahrzeugmodells integriert, ohne dass dabei das gestaltete Erlebnis verlorengegangen ist. (2) Das Periscope ist ein mobiles Navigationsgerät, das den Insassensoziale Erlebnisse ermöglicht und das Verbundenheitsgefühl stärkt. Durch die Implementierungmehrere Erlebnis-Prototypen und deren Evaluation in verschiedenen Phasen des Entwicklungsprozesseskonnten die gestalteten Erlebnisse konsistent erhalten werden. (3) ImProjekt GestShare wurde das Potential der Interaktion durch Freiraumgesten im Fahrzeuguntersucht. Dabei standen ein Verbundenheitserlebnis des Fahrers und soziale Interaktionenmit Fahrern anderer Fahrzeuge im Fokus. Es wurden mehrere Prototypen implementiert undauch in einer Verkehrssituation evaluiert. Die wichtigsten Beiträge dieser Dissertation sind (1) eine intensive Betrachtung und Anwendungvon Erlebnis-Prototypen im Auto und deren Relevanz bei der Erlebnis-Gestaltung,beruhend auf einer Literaturauswertung und der eigenen Erfahrung innerhalb des Projekts; (2) drei Fallstudien und eine detaillierte Beschreibung mehrere Prototypen in verschiedenenPhasen des Prozesses und (3) Empfehlungen zu Vorgehensweisen bei der Erstellung vonErlebnis-Prototypen hinsichtlich der Eigenschaften wie Nähe zum finalen Produkt, Anzahlder implementierten Details und Interaktivität sowie zur Evaluation im Labor und in tatsächlichenVerkehrssituationen in verschiedenen Phasen des Entwicklungsprozesses
