    A Convenient Untruth: Fact and Fantasy in the Doctrine of Odious Debts

    The few years since the U.S. incursion into Iraq in 2003 have witnessed an explosion in the literature on odious debts - that is, debts incurred (a) without the consent of the people (e.g., by a despotic regime); (b) from which no benefits accrued to the people; and (c) when the creditors had knowledge of the foregoing. The key question in the literature is whether successors to the despotic regime are obligated to pay the debts of the despot. That is, whether the newly democratic nation of Iraq is obligated to pay the debts of Saddam Hussein. The starting point for almost every discussion - scholarly or popular - of this doctrine is an obscure legal scholar named Alexander Nahum Sack, variously described as the pre-eminent scholar on public debts of his time, a former minister to Tsar Nicholas II, and a Russian professor of law who penned the doctrine of odious debts while teaching in Paris. This Article excavates the background of Alexander Sack, separating the reality of his life from the myth perpetuated in the odious debts literature. Instead of the heroic and eminent Tsarist exile, the evidence reveals a peripatetic legal scholar who taught in five different universities on two continents, and after being fired from a tenured position, ended his life penniless. We are left then with these questions: What does the reality of Sack mean for the legal status of the odious debts doctrine? And how is it that he achieved this iconic status when even minimal inquiry would have revealed a far more murky reality

    Hard Lessons about Philanthropy & Community Change from the Neighborhood Improvement Initiative

    Between 1996 and 2006, the William and Flora Hewlett Foundation invested over $20 million in the Neighborhood Improvement Initiative (NII), an ambitious effort to help three neighborhoods in the Bay Area reduce poverty and develop new leaders, better services, more capable organizations, and stronger connections to resources. On some counts NII succeeded, and on others it struggled mightily. In the end, despite some important accomplishments, NII did not fulfill its participants' hopes and expectations for broad, deep, and sustainable community change. In those accomplishments and shortcomings, and in the strategies that produced them, however, lies a story whose relevance exceeds the boundaries of a single initiative. Our goal is to examine this story in the context of other foundation sponsored initiatives to see if it can help philanthropy support community change and other types of long-term, community-based initiatives more effectively.As we began to review materials and conduct interviews, we learned of NII's accomplishments in each neighborhood, including new organizations incubated, new services stimulated, and new leaders helped to emerge. We also quickly discovered multiple, and often conflicting, perspectives on NII's design, implementation, and outcomes that were hard to reconcile. Some of this Rashomon effect is to be expected in a complex, long-term community change initiative that evolves over time with changing players. Some can also be attributed to the different dynamics and trajectories in each of the three sites.We have tried to describe all points of view as accurately as possible without favoring any one perspective. Moreover, we have tried to look beyond the lessons drawn exclusively from NII and to position all of these varied opinions within a broader field-wide perspective, wherever possible.The frustrations of NII's participants and sponsors are mirrored in many other foundations' major initiatives. Indeed, our reviewers -- who have been involved in many such initiatives as funders, evaluators, technical assistance providers, and intermediaries -- all underscored how familiar they were with the challenges and pitfalls described here, both those related specifically to community change efforts and those pertinent to other initiatives. Because the opportunity to discuss the frustrations candidly has been limited, however, they often are relegated to concerns expressed sotto voce. So it was particularly important throughout the review to solicit from our interviewees ideas or suggestions for improving their work together. We offer these along with our own observations as a way to stimulate further reflection and debate, because we believe that philanthropy has an important role to play in improving outcomes for poor communities and their residents. Few foundations have been willing to contribute to this level of honest and sometimes painful public dialogue. But by commissioning this retrospective analysis, the Hewlett Foundation demonstrates a desire to help the field learn and move forward, and we applaud that

    Kuhn Losses Regained: Van Vleck from Spectra to Susceptibilities

    We follow the trajectory of John H. Van Vleck from his 1926 Bulletin for the National Research Council (NRC) on the old quantum theory to his 1932 book, The Theory of Electric and Magnetic Susceptibilities. We highlight the continuity of formalism and technique in the transition from dealing with spectra in the old quantum theory to dealing with susceptibilities in the new quantum mechanics. Our main focus is on the checkered history of a numerical factor in the Langevin-Debye formula for the electric susceptibility of gases. Classical theory predicts that this factor is equal to 1/3. The old quantum theory predicted values up to 14 times higher. Van Vleck showed that quantum mechanics does away with this "wonderful nonsense" (as Van Vleck called it) and restores the classical value 1/3. The Langevin-Debye formula thus provides an instructive example of a Kuhn loss in one paradigm shift that was regained in the next. In accordance with Kuhn's expectation that textbooks sweep Kuhn losses under the rug, Van Vleck did not mention this particular Kuhn loss anywhere in his 1926 NRC Bulletin (though he prominently did flag a Kuhn loss in dispersion theory that had recently been regained). Contrary to Kuhn's expectations, however, he put the regained Kuhn loss in susceptibility theory to good pedagogical use in his 1932 book. Kuhn claimed that textbooks must suppress, truncate, and/or distort the prehistory of their subject matter if they are to inculcate the exemplars of the new paradigm in their readers. This claim is not borne out in this case. Because of the continuity of formalism and technique that we draw attention to that Van Vleck could achieve his pedagogical objectives in his 1932 book even though he devoted about a third of it to the treatment of susceptibilities in classical theory and the old quantum theory in a way that matches the historical record reasonably well.Comment: This paper will be published in: Massimiliano Badino and Jaume Navarro (eds.), Research and Pedagogy: A History of Early Quantum Physics through its Textbooks, Berlin: Edition Open Access, forthcoming.
