    Are ChatGPT and Other Similar Systems the Modern Lernaean Hydras of AI?

    The rise of Generative Artificial Intelligence systems (“AI systems”) has created unprecedented social engagement. AI code generation systems provide responses (output) to questions or requests by accessing the vast library of open-source code created by developers over the past few decades. However, they do so by allegedly stealing the open-source code stored in virtual libraries, known as repositories. This Article focuses on how this happens and whether there is a solution that protects innovation and avoids years of litigation. We also touch upon the array of issues raised by the relationship between AI and copyright. Looking ahead, we propose the following: (a) immediate changes to the licenses for open-source code created by developers that will limit access and/or use of any open-source code to humans only; (b) we suggest revisions to the Massachusetts Institute of Technology (“MIT”) license so that AI systems are required to procure appropriate licenses from open-source code developers, which we believe will harmonize standards and build social consensus for the benefit of all of humanity, rather than promote profit-driven centers of innovation; (c) we call for urgent legislative action to protect the future of AI systems while also promoting innovation; and (d) we propose a shift in the burden of proof to AI systems in obfuscation cases

    Slave to the Algorithm? Why a \u27Right to an Explanation\u27 Is Probably Not the Remedy You Are Looking For

    Algorithms, particularly machine learning (ML) algorithms, are increasingly important to individuals’ lives, but have caused a range of concerns revolving mainly around unfairness, discrimination and opacity. Transparency in the form of a “right to an explanation” has emerged as a compellingly attractive remedy since it intuitively promises to open the algorithmic “black box” to promote challenge, redress, and hopefully heightened accountability. Amidst the general furore over algorithmic bias we describe, any remedy in a storm has looked attractive. However, we argue that a right to an explanation in the EU General Data Protection Regulation (GDPR) is unlikely to present a complete remedy to algorithmic harms, particularly in some of the core “algorithmic war stories” that have shaped recent attitudes in this domain. Firstly, the law is restrictive, unclear, or even paradoxical concerning when any explanation-related right can be triggered. Secondly, even navigating this, the legal conception of explanations as “meaningful information about the logic of processing” may not be provided by the kind of ML “explanations” computer scientists have developed, partially in response. ML explanations are restricted both by the type of explanation sought, the dimensionality of the domain and the type of user seeking an explanation. However, “subject-centric explanations (SCEs) focussing on particular regions of a model around a query show promise for interactive exploration, as do explanation systems based on learning a model from outside rather than taking it apart (pedagogical versus decompositional explanations) in dodging developers\u27 worries of intellectual property or trade secrets disclosure. Based on our analysis, we fear that the search for a “right to an explanation” in the GDPR may be at best distracting, and at worst nurture a new kind of “transparency fallacy.” But all is not lost. We argue that other parts of the GDPR related (i) to the right to erasure ( right to be forgotten ) and the right to data portability; and (ii) to privacy by design, Data Protection Impact Assessments and certification and privacy seals, may have the seeds we can use to make algorithms more responsible, explicable, and human-centered

    From lethal drones to cancer diagnostics, humans are increasingly working with complex and artificially intelligent algorithms to make decisions which affect human lives, raising questions about how best to regulate these human-in-the-loop systems. We make four contributions to the discourse. First, contrary to the popular narrative, law is already profoundly and often problematically involved in governing human-in-the-loop systems: it regularly affects whether humans are retained in or removed from the loop. Second, we identify the MABA-MABA trap, which occurs when policymakers attempt to address concerns about algorithmic incapacities by inserting a human into a decision-making process. Regardless of whether the law governing these systems is old or new, inadvertent or intentional, it rarely accounts for the fact that human-machine systems are more than the sum of their parts: they raise their own problems and require their own distinct regulatory interventions. But how to regulate for success? Our third contribution is to highlight the panoply of roles humans might be expected to play, to assist regulators in understanding and choosing among the options. For our fourth contribution, we draw on legal case studies and synthesize lessons from human factors engineering to suggest regulatory alternatives to the MABA-MABA approach. Namely, rather than carelessly placing a human in the loop, policymakers should regulate the human-in-the-loop system

    Broadcasting and Speech

    It is illegal to speak over the airwaves without a broadcast license. The FCC grants those licenses, and decides whether they will be renewed, on the basis of a vague public interest standard. The resulting system of broadcast regulation conflicts, starkly and gratuitously, with ordinary free speech philosophy. In this Article, the author argues that that inconsistency is crucially linked to inadequacies in free speech theory itself Conventional free speech theory ignores the extent to which imbalances of private power limit freedom of expression. It presupposes that public discourse takes place on a rational plane. The author explores the link between the philosophical failings of broadcast regulation and the empirical failings offree speech theory by identifying competing legal visions that underlie discussions of broadcasting and freedom of speech. The first of these visions, which forms the bases for ordinary free-speech philosophy, emphasizes hard-edged rules, individualism, a belief in overall private autonomy, and a sharp public-private distinction. The second, at the heart of our broadcast regulatory system, emphasizes situationally sensitive standards, altruism, the pervasive role of the government in structuring private ordering, and the pervasiveness of dependence and constraint. These competing visions, the author submits, are fundamentally irreconcilable; our speech regulatory law is driven by the contradiction between them
