    The law of trade secrets is often conceptualized in bilateral terms, as creating and enforcing rights between trade secret owners, on the one hand, and misappropriators on the other hand. This paper, a chapter in a forthcoming collection on the law of trade secrets, argues that trade secrets and the law that guards them can serve structural and institutional roles as well. Somewhat surprisingly, given the law’s focus on secrecy, among the institutional products of trade secrets law are commons, or managed openness: environments designed to facilitate the structured sharing of information. The paper illustrates with examples drawn from existing literature on cuisine, magic, and Internet search.

    Transactions on biomedical research outcomes bring into play strategies that are determined by leveraging resources into quasi-markets and on options based on expectations. To govern such transactions, the choice of appropriate governance structures and the governance of interaction are all too often in remittance of risk and uncertainty. Organisation and communities are prompted by issues concerning intellectual property (IP) to underwrite information, which is inherently fraught with difficulties of discerning ownership and quantifying qualitative business variables. Against that backdrop, we enquire on the mechanisms underpinning value dissipation and value appropriation of biomedical research outcomes to make proposition on the organisational antecedence to innovation. It is a preamble study with the view to developing a meso-level framework to describe mechanisms of value appropriation of upstream biomedical (non-invasive) research at Public Research Organisation. The challenge that faces the municipality is to eliminate the division that has been forming since the time gave impetus to the rail.Today is not only the railway passing through the sector but also the commuter train.The two sectors clearly formed because of this communication system were even more sharply divided during the construcction of the so called million housing program.I have proposed a subway train. The media library has the purpose to contain several features that appeal to the publicon both sides of the line and thus generate a social contact that can develop good communication and cooperation. It was considered the young generation and their needs without leaving aside elderly.The design, the differens spaces and rooms, the buliding facilities, are intended to generate communication and unification among the users.Den Mediateket ingår i en övergripande plan för utveckling i centrala Sollentuna. Kommunen har en plan som de syftar till att avsluta år 2030. Syftet med denna konstruktion är att främia enande och kommunikation i den centrala delen av Sollentuna. Uttmaningen som  kommunenär har i framtiden är att eliminera den klyfta som har bildas efter järnvägskonstruktion. Järnvägen (och pendeltåget)passera genom området. De två sektorerna, tydligt utformade på grund av detta kommunikationssytem, var ännu kraftig isäer under byggande av den så kallade milljonprogramm. Skillnaden i både ekonomisk och social karakter blev tydligt markerade.Den mediabiblioteken har till syfte att innehålla flera funktioner som tilltalar allmänheten på båda sidor on linjen och därmed generera en social kontakt som kan utveckla en god kommunication och samarbete. Jag har övervägt den yngre generationen och deras behov utan all lämna åt sidan den äldre generationen.     The FTC's Challenge to Intel's Cross-Licensing Practices

    After an investigation lasting several months, in June 1998 the Federal Trade Commission brought an antitrust lawsuit against Intel Corporation based on Intel's conduct towards Intergraph, and similar conduct towards Digital Equipment Corporation and Compaq, all in the context of disputes where Intel was accused of patent infringement. The FTC charged that Intel's practices were an abuse of Intel's monopoly position in microprocessors. Is Intel's conduct anti-competitive and thus illegal under the antitrust laws? That is the central question explored in this paper. An introductory section provides some background for the case by discussing the tension between intellectual property rights and antitrust law, a tension that is evident in the FTC's dispute with Intel, and by describing the role of patents in the semiconductor industry. Section 3 provides a succinct summary of the facts surrounding Intel's conduct in each of the three patent disputes identified by the FTC. Section 4 explains the FTC's theory of how Intel's conduct was anti-competitive. Section 5 presents Intel's response. Section 6 describes the settlement reached between the FTC and Intel. The final section discusses legal and economic developments since the case was settled and remarks on the lasting implications of the Intel case.

    Towards an Intellectual Property Rights Strategy for Innovation in Europe

    On October 13, 2009 the Science and Technology Options Assessment Panel (STOA) together with Knowledge4Innovation/The Lisbon Forum, supported by Technopolis Consulting Group and TNO, organised a half-day workshop entitled ‘Towards an Intellectual Property Rights Strategy for Innovation in Europe’. This workshop was part of the 1st European Innovation Summit at the European Parliament which took place on 13 October and 14 October 2009. It addressed the topics of the evolution and current issues concerning the European Patent System as well as International Protection and Enforcement of IPR (with special consideration of issues pertaining to IP enforcement in the Digital Environment). Conclusions drawn point to the benefits of a comprehensive European IPR strategy, covering a broad range of IP instruments and topics

    Koyaanisqatsi is a Hopi Indian word that translates into English as 'life out of balance,' 'crazy life,' 'life in turmoil,' 'life disintegrating,' all meanings consistent with indicating 'a way of life which calls for another way of living.” While not wishing to suggest either that the international regime of intellectual property rights protection scientific and technical data and information is “crazy” or that it is “in turmoil”, this paper argues that the persisting drift of institutional change towards towards a stronger, more extensive and globally harmonized system of intellectual property protections during the past two decades has dangerously altered the balance between private rights and the public domain in data and information. In this regard we have embarked upon “a way of life which calls for another way of living.” High access charges imposed by holders of monopoly rights in intellectual property have overall consequences for the conduct of science that are particularly damaging to programs of exploratory research which are recognized to be critical for the sustained growth of knowledge-driven economies. Lack of restraint in privatizing the public domain in data and information has effects similar to those of non- cooperative behaviors among researchers in regard to the sharing of access to raw data-steams and information, or the systematic under- provision the documentation and annotation required to create reliably accurate and up-to-date public database resources. Both can significantly degrade the effectiveness of the research system as a whole. The urgency of working towards a restoration of proper balance between private property rights and the public domain in data and information arises from considerations beyond the need to protect the public knowledge commons upon which the vitality of open science depends. Policy-makers who seek to configure the institutional infrastructure to better accommodate emerging commercial opportunities of the information-intensive “new economy” – in the developed and developing countries alike –therefore have a common interest in reducing the impediments to the future commercial exploitation of peer-to-peer networking technologies which are likely to be posed by ever-more stringent enforcement of intellectual property rights.

    A Prospect Theory of Privacy

    Privacy law has languished for decades while the other information law doctrines have flourished. This paradox can be explained by the relative weight assigned respectively to moral argument versus economic argument. Privacy law is unique in that it continues to be steered foremost by moral intuition. What qualifies as a “violation” of privacy is predicated largely on the moral reprehensibility of the act in question. By stark contrast, the intellectual property regimes have long since converted to being led primarily by economic considerations, and only secondarily by noneconomic factors. That distinction is counterproductive and nonsensical. Personal data is an informational good like any other. The same economic justifications for intellectual “property” can be extended to intellectual “privacy”— nonexclusivity harms the incentives to generate new information that can further the progress of social knowledge. Where moral rhetoric has failed to advance robust recognition of privacy interests, economic reasoning may prove more effective. In particular, this Essay offers Edmund Kitch’s prospect theory as an important counterweight to prior economic critiques of privacy, which have frowned on restraints on alienation of information. Prospect theory shows that the social value of recognizing exclusive claims is not just to shield information that already exists, but also to shield deeper investigations of that information to unearth further information that would not be otherwise discoverable
